`Applicant United Life Science. Inc. seeks reconsideration of the final refusal on this application
`issued February 25. 20l9, and submits further argument and makes a further amendment to its
`identification of goods.
`
`Identification of Goods
`
`The office action asserts that Applicant’s Class 3 identification goes beyond the scope of the
`original pro se application. Applicant respectfully disagrees. The original application had the
`following identification of goods:
`
`“Vegan protein and floral extracts from legally produced industrial hemp. The end use
`will be as a Dietary and nutritional supplement. Dietary food supplement, Dietary
`supplements, Food supplements. Nutraceuticals and cosmetic use”.
`
`The identification was not drafted by an attorney, and does not use the syntax customary to
`trademark application identifications. However. it makes clear that the ultimate goods offered to
`consumers under the mark are various types of supplements and cosmetics. Although most of
`the goods fall in Class 5. it explicitly also includes cosmetics. which are Class 3 goods:
`
`“Vegan protein and floral extracts from legally produced industrial hemp. The end use
`will be [. . .] cosmetic use”.
`
`Therefore the amended identification falls within the original:
`
`“Cosmetics made from vegan protein and floral extracts from legally produced industrial
`hemp.”
`
`An applicant may clarify an identification that is indefinite to identify goods that are within the
`scope of the goods in the original identification. and may amend the identification to add an
`additional class if the amended identification does not exceed the scope of the original
`identification. TMEP §l402.06(b).
`
`Goods for cosmetic use fall within Class 3 so the amendment to encompass Class 3 is
`appropriate. The USPTO Manual does not accept either “vegan protein” or “floral extracts” as
`goods on their own. so the additional original language “[t]he end use will be. . .cosmetic use" is
`necessary to define the ultimate goods on which the mark will appear. The term “cosmetics” is
`acceptable in Class 3. so the identification “Cosmetics made from vegan protein and floral
`extracts from legally produced industrial hemp” is acceptable, and not an expansion of the
`original identification.
`
`Applicant now further amends its identification in response to the substantive refusal in the
`office action. as discussed below.
`
`Unlawful Use in Commerce
`

`The Examining Attorney has refused registration on the grounds that the goods are prohibited by
`the Controlled Substances Act, 21 U.S.C. §§ 801 61‘ seq. (the “CSA”) and the Federal Food, Drug
`and Cosmetics Act, 21 U.S.C. §§ 301 et seq. (the “FDCA”), specifically that the goods are
`comprised of cannabinoids, such as cannabidiols (“CBD”), that are found in parts of the cannabis
`plant.
`
`In response, Applicant further amends its identification of goods as follows:
`
`0 Applicant deletes the Class 5 goods, which were the sole basis for the Examining
`Attorney’s refusal under the FDCA.
`
`0 Applicant amends its Class 3 identification to clarify that these goods are not prohibited
`by the CSA or FDCA:
`
`“Cosmetics made from vegan protein and floral extracts from legally produced industrial
`
`hemp with a delta--9 tetrahydrocannabinol concentration of not more than 0.3 percent on
`a d3; weight basis.”
`
`The 2018 Farm Bill was signed into law on December 20, 2018 and removed “hemp” from the
`CSA’s definition of marijuana. As a result, cannabis plants and derivatives such as C BD that
`contain no more than 0.3% delta--9 tetrahydrocannabinol (“THC”) on a dry-weight basis are no
`longer controlled substances under the CSA.
`
`The Trademark Office has recognized the implications of the 2018 Farm Bill and issued Exam
`Guide 1-19 on May 2, 2019, making clear that it will permit the registration of marks claiming
`rights in goods comprised of “hemp” as defined in the 2018 Farm Bill, provided the application’s
`identification specifies that the goods contain less than 0.3% THC (see
`
`htt s://www.us to. oy/sites/default/files/documents/Exam%20Guide%20l-19. d1).
`
`Applicant’s goods are made from legalized industrial hemp, contain less than 0.3% THC, have
`been fully authorized by federal and state authorities and are otherwise fully compliant with
`federal and state law (see Exhibit A (including clips from Applicant” s website and a compliance
`report from 2017 evidencing Applicant’s then up to date federal and state licenses)).
`
`In light of the above, Applicant respectfully requests that the Examining Attorney reconsider the
`refusal to register and approve the application for publication.
