`A. Goods and Marketing Channels and Scope of Identifications of Goods

`HOVERBOARD No. 3,685,723 - The identification of goods in Cited Registration
`HOVERBOARD No. 3,685,723 specifically identifies "terrestrial" transportation.
`The definition of "terrestrial transportation " is "land transport" as defined in Wikipedia as
`"the transport or movement of people, animals, and goods from one location to another
`on land. The two main forms of land transport are rail transport and road transport". The

`HOVERBOARD BY ZR No. 4762381 - The identification of goods in Cited
`Registration HOVERBOARD BY ZR No. 4762381 specifically identifies "water-jet
`propulsion", specifically, "apparatus for locomotion by air or water, namely, personal
`water-jet propulsion devices capable of operating in the air or over or under water,
`comprised of a motorized thrust unit, boots, and a flat surface on which the operator can
`sit or stand; and motor driven water vehicles".
`
`OMNI HOVERBOARDS Serial No. 87158258 -The identifcation of goods in
`Applicant's application for OMNI HOVERBOARDS Serial No. 87158258 is
`specifically for aircrafts, as amended: "singularly piloted aeronautical standing
`platform vehicles, namely, propeller-based boards that are aircrafts used to fly and stay
`hovering in the air, and which do not contain wheels nor use ground terrain to roll on,
`and which do not contain water-jet propulsion nor use a body of water to expel and push
`out from for momentary flight".

`Examining Attorney held that:
`
`"The application uses broad wording to describe the goods, namely "Singularly
`piloted aeronautical standing platform vehicles, namely propeller-based boards",
`which presumably encompasses all vehicles and goods of the type described,
`including registrants' more narrow goods, namely " Apparatus for locomotion by air
`or water, namely, personal water-jet propulsion devices capable of operating in the
`air or over or under water, comprised of a motorized thrust unit, boots, and a flat
`surface on which the operator can sit or stand ; and motor driven water vehicles" and
`"Electrically powered two wheeled scooter for terrestrial human transportation ." See,
`e.g. , Sw. Mgmt., Inc. v. Ocinomled, Ltd., 115 USPQ2d 1007, 1025 (TTAB 2015); In
`re N.A.D. , Inc., 57 USPQ2d 1872, 1874 (TTAB 2000). Additionally, the goods and/or
`services of the parties have no restrictions as to nature, type, channels of trade, or
`classes of purchasers and are "presumed to travel in the same channels of trade to
`the same class of purchasers." In re Viterra Inc., 671F.3d1358, 1362, 101 USPQ2d
`1905, 1908 (Fed. Cir. 2012) (quoting Hewlett-Packard Co. v. Packard Press, Inc.,
`281F.3d1261 , 1268, 62USPQ2d1001 , 1005 (Fed. Cir. 2002)). The relevant
`identifications of goods also state and specify that the goods in issue are all offered
`for the same main purpose, use and function, namely transportation of a person .

`Therefore, the goods are related as to purpose , function and use, namely
`transporting or carrying a person or human transportation." Examiner also states
`"There is nothing in the goods as identified in the cited registrations and in the
`instant application that limits the scope of the goods or differentiates the goods as to
`cost or quality or class of purchasers."
`
`i) The identification of goods in Applicant's Application No. 87158258 for
`OMNI HOVERBOARDS has been amended and excludes the goods of Cited
`
`Marks;
`ii) The definition of Cited Registrant's products should not be expanded to
`include Applicant's products. Cited Registration HOVERBOARD No.
`
`3,685,723 clearly states that the product is for land transportation; Cited
`Registration HOVERBOARD BY ZR No. 4762381 clearly states the product
`
`is " water-jet propulsion" apparatus; whereas the Applicant's OMNI
`
`HOVERBOARDS Serial No. 87158258 product is clearly an aircraft.
`
`The definition of Cited Registrant's products should not be expanded to
`
`include aircrafts. Permitting such expansion causes the scope of the Cited
`
`Marks and Registrations to extend beyond the actual products being
`
`provided.
`
`Accordingly, Examiner's overly broad interpretation of the scope of Cited
`
`Registrant's products is inconsistent both with how Cited Registrants actually use
`
`HOVERBOARD and how others in the market place and understand what the products
`
`actually are.
`
`Sophisticated Purchasers: Different Goods; Different Purchasing Lines.
`
`iii) The goods and purchasing lines are different and do not overlap.

`The product sold under Applicant's mark OMNI HOVERBOARD is a personal aircraft.
`The OMNI HOVEROARD is aeronautical in nature and therefore does not compete with
`the Cited Marks. This is further supported by the attached articles submitted which
`show that the Cited Marks are not mentioned in the product comparisons.
`

`Cited Registration No. 3685723
`Technologies is for an electrically powered two wheeled scooter for terrestrial human
`transportation. This board is not aeronautical and is used only on the ground. In fact,
`this wheeled-self-balancing scooter do not fly or hover as defined in the Wikipedia page
`(https://en.wikipedia.org/wiki/Self(cid:173)
`called
`"Self-balancing_scooter", see Exhibit F
`balancing scooter). The Washington Post expressly states that Cited Registrant's
`product is not actually a hoverboard ""Your fancy scooter is cool, but it's not a
`hoverboard. Why don't we have hoverboards
`yet?".

`in the record under Registration No. 3685723, the land vehicle is used on paved roads
`and tracks. As quoted in the Washington Post article, Jessica Contrera writes:
`
`"The name is a lie. Hoverboards, at least the ones you've been reading
`about since rapper Wiz Khalifa was arrested riding one, do not hover. They
`roll. They roll like a Segway without handlebars, because that's what they
`are ... Twentv-six vears ago, man dreamed of soaring through the air on a
`pink and green flying skateboard. He had seen "Back to the Future Part II."
`and he has been trying to copy it ever since."
`
`Cited Registration No. 4762381 for HOVERBOARD BY ZR is for a water vehicle as
`evidenced in the record "water-jet propulsion devices" and "motor driven water
`vehicles". The vehicle cannot hover above ground terrain and can only work with a
`body of water. The vehicle intakes the water and pushes it out to create enough
`pressure to jump, which disqualifies it from being a part of the same industry. See
`Exhibit H attached (https://zapata.com/flyboard/hoverboard ). Further, the inventor of
`the HOVERBOARD BY ZR, Franky Zapata, admits in an interview with NewAtlas
`(previously Gizmag) that his use of the term "hoverboard" originated from the film Back
`to the Future Part 11 as evidenced in Exhibit I attached
`(https://newatlas.com/hoverboard-by-zr-mixes-surfing-flyboarding/32533/). As shown in
`the record under Registration No. 4762381 , the water vehicle is used at beaches, lakes
`and open ocean. Whereas the Applicant's vehicle is an aircraft that flew within a soccer
`stadium at 10 meters above a hard ground surface, as depicted in this video:

`Due to their function and design, the goods serve different purposes, are highly
`specialized and offer different user experience that are not interchangeable. The
`Applicant respectfully asserts that the goods covered by the subject mark are non(cid:173)
`competitive, different completely in utility, and, in respect to their sales appeal, are not in
`common with the goods under the Cited Marks. By the nature of the differences, the
`amended goods are marketed toward a different type of consumer and through different
`trade channels than those offered under the Cited Marks.
`
`iv) Price Points
`
`The price point of Cited Registrant Hoverboard Technologies' product is approximately
`$1 ,500.00. The price of the Cited Registrant Ziph20 products range from
`approximately $5,000.00 - $20,000.00.
`
`Applicant's OMNI HOVERBOARD vehicles are aeronautical in nature and will be
`based on the internal-combustion-engine and have a price point between
`$150,000.00 for the single engine model and $200,000.00 for the dual-engine
`model. An electric vehicle might be released
