`Applicant files this Request for Reconsideration in response to the Examining

`Attorney' s May 25, 2017 Final Office Action ("Final Office Action") refusing
`
`registration of Applicant's mark ROCKSTAR BLACKOUT for "Energy drinks" based
`
`on an alleged likelihood of confusion with BLACK OUT (Reg. No. 4422400) for
`
`"Dietary and nutritional supplements; dietary supplements" (the "Cited Mark").
`
`The Examining Attorney based her refusal to register on supposed similarities
`
`between the marks and the cited goods. Applicant respectfully disagrees with the
`
`Examining Attorney's assessment. Applicant's evidence shows that energy drinks and
`
`dietary and nutritional supplements (for brevity, "supplements") are not related goods,
`
`nor are they marketed in a way that would lead consumers to believe that they emanate
`
`from the same source. Consequently, consumers are unlikely to be confused as to the
`
`source of energy drinks and supplements, even those sold under identical, or near(cid:173)
`
`identical, marks. Moreover, Applicant's mark differs from the Cited Mark in sight,
`
`sound, and commercial impression, further minimizing any likelihood of confusion.
`
`Applicant therefore respectfully requests that the Examining Attorney reconsider her
`
`refusal to register.

`I.
`
`The1·e Is No Likelihood of Confusion Because Ene1·gy Dl'inks and Dietary
`Supplements Are Dissimilar
`
`In this case, it is proper to begin the likelihood of confusion analysis with the
`
`similarity of goods because, if the goods are not similar, "even if the marks are identical,
`
`confusion is not likely." TMEP § 1207.0l(a)(i); see also TMEP § 1207.0l(a)(iv) ("The
`
`facts in each case vary and the weight to be given each relevant du Pont factor may be
`
`different in light of the varying circumstances."); In Re Thor Tech, Inc. , 113 U.S.P.Q.2d
`
`1546 (T.T.A.B. Jan. 26, 2015) ("[T)he identity of the marks alone is not sufficient to
`
`establish likelihood of confusion in the absence of probative evidence that the goods are
`
`related.").
`
`a.
`
`The Goods Are Not Similar
`
`For the pmposes of dete1111ining likelihood of confusion, goods are similar if they
`
`are "related in some manner and/or the circumstances smTounding their marketing are
`
`such that they can give rise to the mistaken belief that [the goods) emanate from the same
`
`source." Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369 (Fed. Cir.
`
`2012).
`
`1.
`
`Energy drinks and supplements are not related
`
`Energy drinks are "a usually carbonated beverage that typically contains caffeine
`
`and other ingredients (as taurine and ginseng)" whose purpose is "to increase the
`
`drinker's energy." See Applicant's April 14, 2017 Response to Office Action ("ROA"),
`
`Exhibit A (Merriam-Webster dictionary definition). As conventional beverages, energy
`
`drinks are regulated by the Food and Drug Administration and must be labeled in
`
`compliance with the Federal Food, Drug and Cosmetic Act and FDA regulations. See
`
`ROA, Exhibits E & F; see also Exhibit A. Applicant's ROCKSTAR BLACKOUT
`

`energy drinks, in the market since Fall 2016, are labeled and sold as conventional
`
`beverages that contain b-vitamins and guarana. See Exhibit B; see also ROA, Exhibit G
`
`(Rockstar is one of many energy drink producers who have committed to labeling its
`
`products as beverages and not as dietary supplements).
`
`Supplements are "a product taken orally that contains one or more ingredients
`
`(such as vitamins or amino acids) that are intended to supplement one's diet and are not
`
`considered food. " See Exhibit C. Supplements may be found in a variety of forms, such
`
`as tablets, capsules, softgels, gelcaps, liquids, or powders (the most common form is a
`
`solid tablet) and serve a variety of purposes. See Exhibits D & E (supplements for skin
`
`health, sleep support, stress support, bone and joint support, hea1t health, etc.). Because
`
`supplements can have strong effects on people, including negative and unintended side
`
`effects, supplements are more akin to medicine than food or beverages, and consumers
`
`are more likely to exercise caution in purchasing supplements, and do not take them on a
`
`simple ad hoc basis (unlike energy drinks). See Exhibit F (informing consumers to " [!]et
`
`your health care providers (including doctors, phannacists, and dietitians) know which
`
`dietary supplements you ' re taking ... . Keep a record of the supplements you take in one
`
`place, just as you should be doing for all of your medicines."). Registrant's BLACK
`
`OUT supplement is a powder pre-workout body building supplement, advertised as
`
`providing "greater vascularity and muscular pumps," "enhanced nitric oxide (N.O.)
`
`levels," "heightened energy and mental focus," and "increased endurance and training
`
`intensity," and containing ingredients such as L- Arginine AKG, Beta Alanine, Creatine,
`
`and L-Citrnlline Malate. Exhibit G (specimen submitted by Registrant, noting that claims
`
`regarding performance "have not been evaluated by the Food and Drng Administration."
`

`and warning consumers that the product can cause negative side effects including heart
`
`attack and stroke and may contain ingredients banned in sports as perfomrnnce-enhancing
`
`substances).
`
`Because supplements cover such a wide breadth of products, a small subset of
`
`supplements may, admittedly, be liquids that contain caffeine as an ingredient. However,
`
`it does not automatically follow that consumers believe that supplements and energy
`
`drinks are related or that they emanate from the same source. See TMEP 1207.0l (a)(iv)
`
`(no rule that certain goods are per se related). " It is ... not enough to find one term that
`
`may generically describe the goods. More must be shown: that is, a commercial or
`
`technological relationship must exist between the goods such that the use of the
`
`trademark in commercial transactions on the goods is likely to produce opportunities for
`
`purchasers or users of the goods to be misled about their source or sponsorship." General
`
`Electric Company v. Graham Magnetics Inc. , 197 U.S.P.Q. 690 (T.T.A.B. Oct. 27, 1977).
`
`Here, there is no such commercial or technological relationship.
`
`2.
`
`The goods are not marketed in a way that would mistakenly lead
`consumers to believe that the goods emanate from the same source
`
`Applicant's evidence shows that energy drinks and nutritional supplements are
`
`marketed in a way such that there is no confusion as to source. The companies that
`
`manufacture 95 percent of the energy drinks sold in the United States have committed to
`
`refrain from marketing their products as supplements. See Exhibit H. Major national
`
`news sources, including CBS, CNN, and ABC, reported to large national audiences on
`
`energy drink producers' commitment not to sell supplements. See Exhibit I. Indeed, a
`
`review of the websites of the top three energy drink producers in the United States-
`
`Monster, Red Bull, and Applicant-show that they do not sell supplements and only sell
`

`beverages. See ROA, Exhibit B. Because of energy drinks producers ' concerted efforts
`
`to distinguish their products from supplements-including by complying with applicable
`
`food safety laws and regulations-and their commitment to refrain from selling
`
`supplements (i.e., refrain from causing consumers to believe that energy drinks and
`
`supplements emanate from the same source), consumers are not likely to believe energy
`
`drinks and supplements sold under the same mark are sold by the same company. (And
`
`here, the respective products are not sold under identical marks.)
`
`Third-party registrations for identical, or near identical marks, for energy drinks
`
`on the one hand and dietary supplements on the other, further support such a finding. 1
`
`Here, the reasoning employed in the precedential decision of Jn re Thor Tech, Inc., 113
`
`U.S.P.Q.2d 1546 (T.T.A.B. 2015) is instructive. There, the question was whether trucks
`
`and "recreational vehicles, namely, towable trailers" emanated from the same source.
`
`The examining attorney submitted two third-party registrations for marks that included
`
`both tmcks and recreational vehicle trailers as evidence that the goods emanated from the
`
`same source. In rebuttal, the applicant submitted almost fifty pairs of substantially
`
`similar marks for trucks on the one hand and recreational vehicles on the other, owned by
`
`different entities. The Board found that, based on the evidence, the similarity of goods
`
`factor weighed against likelihood of confusion:
`
`"The existence of almost fifty pairs of substantially identical marks for
`
`land motor vehicles and for towable recreational vehicle trailers on the
`

`federal Trademark Register suggests to us that businesses in these two
`
`industries believe that their respective goods are distinct enough that
`
`confusion between even identical marks is unlikely .... [T]he third-party
`
`registrations ofrecord suggest that consumers are aware that [the goods]
`
`are offered by different companies under the same or similar marks."
`
`Id at ':'4; see also In Re Hyundai Motor Am. , 2009 WL 4086577, at ':'4 (T.T.A.B. Sept.
`
`14, 2009) ("[T]he fact that there are numerous third-party registrations for similar marks
`
`owned by different entities for tires and automobiles is consistent with the conclusion that
`
`trademark owners in these respective industries do not believe that there is a likelihood of
`
`confusion between these marks for the listed goods."); In re E. I. Du Pont de Nemours &
`
`Co., 476 F.2d 1357, 1363 (C.C.P.A. 1973) ("It is at least difficult to maintain a subjective
`
`view that confusion will occur when those directly concerned say it won' t. A mere
`
`assumption that confusion is likely will rarely prevail against uncontroverted evidence
`
`from those on the firing line that it is not.").
`
`Applicant submitted 30 third-party registrations of identical, or near-identical,
`
`marks for energy drinks and supplements owned by different owners in its Response to
`
`Office Action. Applicant hereby submits an additional 12 third-party registrations to
`
`further confirm that energy drinks and supplements do not commonly emanate from the
`
`same source. See Exhibit J. These third-party registrations indicate that energy drink
`
`producers and supplement producers both believe that their respective markets are
`
`distinct and that consumers are aware that energy drinks and supplements sold under
`
`identical, or near-identical, marks do not emanate from the same source.
