`ARGUMENT(S)
`In response to the substantive refusal(s), please note the following:
`
`The Final Office Action dated September 23, 2016 refuses registration on the grounds of descriptiveness under Section 2(e)(1) of the
`Trademark Act. Applicant respectfully submits that the applied-for mark is not descriptive. However, rather than providing further argument
`on this point, Applicant submits, pursuant to TMEP §1212.02(c), that the phrase “BEST OF LIVE TV” has acquired distinctiveness.
` Therefore, Applicant respectfully requests an amendment to its application to include a claim of acquired distinctiveness under Section 2(f)
`as stated more fully below. See 15 U.S.C. §1052(f). Applicant, concurrently with this Request for Reconsideration, has also filed a Notice of
`Appeal.

`Section 2(f) Claim
`
`The wording “BEST OF LIVE TV” has become distinctive of the goods and/or services as evidenced by the attached evidence. See
`Declaration of Glenn Samuel Eisen, attached as Exhibit 1. The Eisen Declaration, along with the thirty-two (32) Exhibits attached thereto,
`constitutes a prima facie case that the purchasing public has come to view the proposed mark as an indicator of origin. Briefly summarized, this
`evidences establishes:

`Applicant advertises the mark on national television, resulting in over one billion (1,000,000,000) household impressions.

`
`Applicant uses the mark in national direct mail advertising, including over five million (5,000,000) direct mail inserts.
`
`Applicant advertises the mark on a page web viewed by over one million (1,000,000) visitors.
`
`Websites and publications that cover Applicant’s industry have reported extensively on Applicant’s services using Applicant’s mark.
`This coverage includes, but is not limited to, coverage in industry publications such as Multichannel News, Cord Cutters News, and
`Streaming Observer; technology publications such as CNET, PC Magazine, and Engadget; and general interest publications such as the
`Los Angeles Times, the Denver Post, and NBC News.
`
`In addition to the foregoing media, Applicant also advertises on Facebook, Instagram, and podcasts.
`
`Applicant’s advertisements use the mark in a trademark manner, including prominent, set-off text and use of the TM symbol.
`
`Netflix, Amazon Video (Amazon Prime), and Hulu, which are the three largest OTT service providers, do not use BEST OF LIVE TV on
`their websites.
`
`The above-summarized evidence, along with the additional evidence included with the Eisen declaration, demonstrates that the mark has
`acquired distinctiveness indicating the origin of the services. In re Owens-Corning Fiberglas Corp., 774 F.2d 1116, 1125, 227 USPQ 417, 422
`(Fed. Cir. 1985); TMEP 1212.06.

`For the foregoing reasons, Applicant respectfully submits that its application be approved for publication, and such action is respectfully

`Sling TV has continuously used the phrase BEST OF LIVE TV as a trademark for OTT
`
`services since approximately September 1, 2015.

`Since September of 2015 when the BEST OF LIVE TV mark was first used, Sling TV
`
`has spent a substantial amount of money on advertising showing the BEST OF LIVE TV mark across all
`
`of the media that Sling TV advertises in. This advertising is described in greater detail below.

`a. BEST OF LIVE TV is used in national television advertising. Specifically, the mark has
`
`been used in a 60-second advertisement that has resulted in 1.18 billion Household
`
`Impressions since August 29, 2016.
`

`b. Sling TV hosts a website offering services under the BEST OF LNE TV mark at the
`
`domain www.sling.com. See Exhibit A. The site has had over 1.5 million visitors since July
`
`1, 2016. The mark also has been used in an advertisement that appears on YouTube, which
`
`has been viewed over 26,000 times. See https://www.youtube.com/watch?v=nkfbSTDEDFY.
`
`c. The BEST OF LIVE TV mark appears in at least four paid social media advertisements
`
`on Facebook and Instagram, and also in advertising in podcasts.
`
`d. The BEST OF LIVE TV mark is used in national direct mail advertising. Over 5.7
`
`million direct mail inserts using the mark were sent in 2016.
`
`e.

`In addition, BEST OF LIVE TV is promoted nationally in alternative media, such as
`
`package inserts, statement inserts, magazine inserts, value pack inserts, newspaper inserts, and
`
`change of address inserts. In 2016, Sling TV sent over 68.9 million such inserts.

`
`(CBS). CES is the premier consumer technology industry trade show and was
