`This request is made pursuant to 37 C.F.R. 2.142(d) and TBMP 1207.02 to remand
`
`jurisdiction to the Examining Attorney to permit Applicant to submit supplemental evidence
`
`relating to the weakness of the cited registration, namely, U.S. Registration No. 3,880,840 of the
`
`GOT YOUR BACK mark in Classes 25, 35, and 36. This request is being made prior to the
`
`deadline for Applicant to submit its appeal brief, and Applicant believes good cause exists to
`
`consider this supplemental evidence prior to Applicant’s and the Examining Attorney’s briefs
`
`being filed.
`
`The supplemental evidence that Applicant wishes to have considered bears on the
`
`strength/weakness of the cited registration, and includes (1) specimens and current use of the
`
`third—party federal registrations cited in Applicant’s response to the first Office action and
`
`discussed therein and in Applicant’s request for reconsideration, and (2) additional evidence of
`
`current third-party use of GOT YOUR BACK and Variants thereof for clothing and retail
`

`The supplemental evidence is being submitted with this request, along with a
`
`declaration regarding when the supplemental evidence was obtained.
`
`A primary area of disagreement between the Examining Attorney and Applicant is the
`
`strength or weakness of the cited registration of the GOT YOUR BACK mark for clothing, retail
`
`services, and charitable fundraising services in Classes 25, 35, and 36. Applicant submits that
`
`the cited mark is a weak mark, and previously has submitted evidence of many third-party
`
`registrations and allowed applications for marks that include GOT YOUR BACK and variants
`
`thereof for goods and services in these Classes and/or which Applicant submits are more similar
`
`to the cited registration than the goods in Applicant’s refused application to register the GOT
`
`YOUR BAK mark for goods in Classes 18 and 21. The Examining Attorney disagrees with
`
`Applicant and submits that the cited mark is a strong mark that is entitled to a broad scope of
`
`protection. Applicant believes the concurrently submitted supplemental evidence entitles a more
`
`complete consideration of the strength/weakness of the cited mark and may preserve resources
`
`by preventing the need for the appeal.
`
`The supplemental evidence was obtained by Applicant recently, after the filing of its
`
`request for reconsideration and Notice of Appeal.
`
`In full candor, Applicant is not taking the
`
`position that the evidence did not previously exist or could not have been obtained, and thus
`
`submitted, prior to initiation of this appeal. Applicant believed that it and the Examining
`
`Attorney would be in better agreement as to the strength/weakness of the cited mark after
`
`consideration of Applicant’s request for reconsideration, but Applicant was mistaken. Applicant
`
`is hopeful that consideration of the proffered supplemental evidence will enable Applicant and
`
`the Examining Attorney to agree upon the relative strength/weakness of the cited mark, which is
`
`the foundation of the refusal of registration that is being appealed. The Examining Attorney may
`

`still maintain the refusal of registration, but the issues to be briefed and decided on appeal will
`
`still be reduced.

`If the Examining Attorney withdraws the refusal of registration after

`considering the supplemental evidence, then the appeal will not be necessary.

`In View of the above, Applicant submits that good cause exists to grant Applicant’s
`
`request and permit consideration of Applicant’s supplemental evidence. Applicant also submits
`
`that the fact that this request is being submitted prior to the filing of Applicant’s appeal brief also
`
`is a factor that favors granting of Applicant’s request.

`For the Examining Attomey’s convenience in connection with the supplemental evidence

`relating to (l), a copy of an updated printout from TESS for Applicant’s previously cited and

`currently relied upon third-party registrations is

`included along with the corresponding

`specimens showing use of the marks for the corresponding goods and/or services. For many of
`
`these registrations and applications, Applicant also is submitting current evidence showing how
`
`the marks are used in commerce, including online and in retail settings.
`

`THE IDEA
`
`Hello there, my name is Doe Zitscher and I would like to thank you for taking the time to
`investigate more about me and this new concept.
`
`WITH THAT AN IDEA WAS BORN
`
`I am proud to say that I’ve been a part of this wonderful beauty industry as a designer
`and salon owner for about 40 years now. In those years, this industry has been so
`instrumental in sculpting my life that I cannot speak more passionately. Especially as a
`woman who worked through a time when we weren’t given the encouragement to
`pursue our own desired careers, but… that’s a whole other issue!
`
`As a single mother many years ago, the beauty industry allowed me to pursue a career
`where the sky was the limit! I was given the ability to work as many or few hours as I
`wanted so that I could enjoy countless precious moments with my son. Ultimately, I was
`able to open my own salon, which was a dream come true!
`
`As a modern day designer, I have seen how time has become such an important factor in
`all of our lives. Your client’s time is important and so is yours because, after all, time is
`money!
`
`I once wondered just how many haircuts or color services I had performed in 40 years.
`In those times, I tried to think about how many times I had to stop to adjust and readjust
`my cape to get rid of that frustrating bunch of fabric in the back or change capes to a
`hot, heavy plastic one for color service. That to me was not only wasted time, but a
`source of unnecessary aggravation in needing to adjust and readjust, change capes and
`double the laundry.

`WHAT IF, I DESIGNED AN ALL IN ONE
`
`CAPE?

`One where the obstruction of fabric in the back is removed. A cape with enoug
`fabric to actually protect all of the client. One that is made of a multi-function
`comfortable, breathable, water-resistant, and easy to launder fabric. That, in m
`mind would be the ultimate salon cape!
