`specimen. (cid:160)(cid:160) See TMEP §§715.03(a)(ii)(B), 715.04(a).(cid:160) The final refusal is maintained because the specimen does not show the applied-for
`mark in the drawing in use in commerce in International Class(es) 41.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R.
`§§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i).(cid:160) Specifically, the original and substitute specimens display the mark as
`PROJECT 42 without any stylized font and/or any stippling and PROJECT and 42 are side by side.(cid:160) Also, the substitute specimen shows the
`number 42 in a stylized manner and with stippling, but there is no term “project” above it or anywhere near the stylized 42. (cid:160) In contrast, the
`drawing displays the mark as the term PROJECT above the number 42 in a stylized font and with stippling on top of the word and number.
