`Applicant hereby timely responds to the Office Action dated November 25, 2014 as follows:
`
`AMENDMENT
`
`Please amend the description of goods as follows:
`--surgical and wound dressings, namely, a specialized drape to secure and seal an underlying
`absorbent wound dressing in International Class 10.--
`
`REMARKS
`
`The Examiner has issued a final rejection of the application and indicates that the likelihood of
`confusion between Applicant’s mark and U.S. Registration No. 3,429,340 is grounds for refusal
`under 15 U.S.C. § 1052(d).(cid:160) In response, Applicant respectfully argues that there exists no likelihood
`of confusion between the subject mark and the cited registration.(cid:160)
`
`NO LIKELIHOOD OF CONFUSION:
`
`Applicant reiterates the arguments made of record in its first response, dated October 12,
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`2014 (“First Response”) and again urges that due to the dissimilarity of the goods and services,
`dissimilarity of the trade channels, and dissimilarity of the marks, confusion between the marks is
`unlikely.(cid:160)
`
`(A)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Dissimilarity of the Goods/Services
`
`Applicant seeks to register the mark DERMATAC in connection with the following amended
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`goods:(cid:160) “surgical and wound dressings, namely, a specialized drape to secure and seal an
`underlying absorbent wound dressing” (“Applicant’s Goods”).
`(cid:160) In contrast, the services associated
`
`(cid:160)
`

`with the registered DERMATEC are described as “mail order services, retail store services,
`wholesale distributorship services, and on-line retail store services featuring infection control
`products and medical disposables, namely, latex and synthetic gloves, face masks and gowns.”
`(“Registrant’s Services”)
`(cid:160) Applicant urges that its own branded goods are so specialized and
`distinct that confusion is unlikely.
`
`The Examining Attorney argues in the Final Office Action that through third-party registrations
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`the evidence shows that Applicant’s Goods and Registrant’s Services may emanate from a single
`source under a single mark.(cid:160) Respondent respectfully disagrees based upon the specialized nature
`of Applicant’s Goods; however, even if they may emanate from a single source it is not enough to
`show that the goods and services would be encountered by the same purchasers.(cid:160) See In re Fesco
`Foods, Inc., 219 USPQ 437 (TTAB 1983).(cid:160) In this case, the TTAB stated that “the Board has not
`hesitated to find an absence of likelihood of confusion, even in the face of identical marks applied to
`goods used in a common industry, where such goods are clearly different from each other and there
`is insufficient evidence to establish a reasonable basis for assuming that the respective products
`and/or services as identified by their marks, would be encountered by the same purchasers or
`
`parties.” (cid:160) Id. at 438.(cid:160) (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Applicant’s Goods are specialty medical goods that are used to create an effective seal
`which will draw exudate into the absorbent dressing which is being used on a very specific type of
`wound.(cid:160) In fact, Applicant’s Goods are typically used to assist in the removal of exudate from
`chronic, acute, traumatic, subacute and dehisced wounds, partial-thickness burns, ulcers, (such as
`diabetic, venous or pressure), surgically closed incisions, flaps, and grafts.(cid:160) Registrant’s Services
`are related to the retail sale of medical goods of infection control products and medical disposables
`limited to latex and synthetic gloves, face masks and gowns.(cid:160) It is clear that Applicant’s Goods are
`in no way competitive with Registrant’s Services. (cid:160) “[W]here there is no competition, it is a corollary
`that likelihood of confusion decreases.” (cid:160) See Sunbeam Furniture Corp. v. Sunbeam Corp., 90
`U.S.P.Q. 43 (9th Cir. 1951).(cid:160) Applicant’s Goods are targeted to a different clientele than
`Registrant’s Services. (cid:160) Applicant’s Goods are used to remove exudate from a hard to heal wound
`so that the tissue from each side of the wound can connect and heal without the interference of the
`exudate.(cid:160) In fact, Applicant’s Goods are not used in connection with infection control and do not
`come into contact with the actual wound but instead advance the wound healing by sealing the
`absorbent dressing that is placed in contact with the wound.(cid:160) A consumer of Applicant’s Goods
`would be limited to a doctor who is looking for products to assist in the healing of hard to heal
`wounds. (cid:160) (cid:160) In this instance confusion is unlikely, since Applicant and Registrant’s goods and services
`would not be encountered by the same consumer at the same time.
`
`(B)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Dissimilarity of Trade Channels
`
`In addition, consumers of Applicant’s Goods will not likely encounter the Registrant’s
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`Services in the same marketing context.(cid:160) Applicant is a global wound care and regenerative medicine
`company providing innovative healing solutions that restore patient lives. Consumers of Applicant’s
`Goods are limited to medical professionals who are looking for products to assist in the healing of
`slow-to-heal wounds.(cid:160) Applicant’s Goods are not available for purchase through a medical supply
`

`company especially one such as Registrant which is limited to the sale of synthetic goods, latex
`gloves and gowns.(cid:160) Medical professionals looking to purchase a sophisticated specialized drape
`covering that assists in the removal of exudate in hard to heal wounds is not going to look to a
`general medical supply company to purchase those items. “If the goods of one party are sold to one
`class of buyers in a different marketing context than the goods of another seller, the likelihood that a
`single group of buyers will be confused by a similar trademark is less than if both parties sold their
`goods through the same channel of distribution.” (cid:160) 3 J. McCarthy, McCarthy on Trademarks and
`Unfair Competition Section 24:51(4th ed. 1998) citing Dyna Color Corp. v. Beckmann & Whitley, 134
`U.S.P.Q. 410 (T.T.A.B. 1962).(cid:160) Indeed, the channels of trade through which the Applicant’s goods
`and the cited services are offered decreases rather than increases, the likelihood of confusion as to
`the source of the services.
`
`(C)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Dissimilarity of the marks
`
`In DuPont, the CCPA emphasized the well established rule that marks must be compared in
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`their entireties using a number of factors, including appearance.(cid:160) DuPont, 476(cid:160)F.2d(cid:160)at 1362.
`(cid:160) In
`addition, the finding of a likelihood of confusion under §(cid:160)2(d) requires a reasonable probability of
`confusion.(cid:160) See 3(cid:160) J.(cid:160)Thomas McCarthy, McCarthy on Trademarks and Unfair Competition §(cid:160)23:2, at
`23-11 (4th ed. 1997) (citing, inter alia, American Steel Foundries v. Robertson, 269(cid:160)U.S.(cid:160)372,
`46(cid:160)S.(cid:160)Ct.(cid:160)160 (1926)).
`(cid:160) When Applicant’s mark and the cited mark are compared in their entireties as
`required by DuPont, it is clear that there is no reasonable probability of confusion between the
`marks.(cid:160)
`
`In terms of overall appearance, Applicant’s mark DERMATAC is dissimilar from the mark
`DERMATEC in the cited registration.(cid:160) Specifically, Applicant’s mark ends in –TAC which (cid:160) suggests a
`tacky or sticky substances while Registrant’s mark ends in –TEC which would suggest a
`technological connotation.(cid:160) No element of a mark is ignored simply because it is less dominant, or
`would not have trademark significance if used alone.(cid:160) See In re Electrolyte Laboratories, Inc., 929
`F.2d 645, 647 (Fed. Cir. 1990).(cid:160) These distinctions give Applicant’s mark an instantly apparent and
`significantly different overall appearance than that of the cited mark, making confusion between the
`marks unlikely.
`
`These differences become more important when you look at the scope of protection provided to
`DERMA marks.(cid:160) As Applicant argued in its First Response, DERMA marks receive weak protection
`due to the overwhelming number of DERMA* marks on the Registry.(cid:160) In support of these arguments
`Applicant’s submitted a chart citing twenty (20) additional marks that contained a phonetic version of
`the term DERMATAC (“Phonetic Equivalents”). (cid:160) Examiner rejected that chart stating that the
`registrations must be part of the record.(cid:160) Applicant is therefore submitting the complete electronic
`equivalent from the USPTO’s automated systems in accordance with the request to support its
`arguments in the First Response (See Exhibit A).(cid:160)
`
`Examiner also rejected the arguments associated with the Phonetic Equivalents based upon the fact
`that these registrations did not show use in the marketplace or in connection with similar goods and
`services.(cid:160)(cid:160)(cid:160) Applicant took note of Examiner’s argument that the registrations were not used in

`association with Applicant’s Goods and as such is attaching the complete electronic equivalent from
`the USPTO’s automated systems of more than fifty (50) additional (cid:160) Registrations that use the
`dominant term DERMA in association with medical devices and goods related to wounds and/or
`wound healing.(cid:160) (See Exhibit B).(cid:160) “[E]vidence of third party usage of third party usage of similar
`marks on similar goods is admissible and relevant to show that the mark is relatively weak and
`entitled to narrowed scope of protection.” General Mills Inc. v. Kellogg Co., 3 USPQ2d 1442, 1445
`(CA8 1987).(cid:160) Applicant further provides screenshots showing examples of use of a number of the
`DERMA registered marks in use in association with wound care products. (See Exhibit C).
`
`The fact of the matter is the dominant word DERMA in the marks that are the subject of the
`registrations is used by a large number of third parties in association with wound care related goods
`and services.(cid:160) “If the common element of conflicting marks is a word that is ‘weak’, then this
`reduces the likelihood of confusion.” (cid:160) McCarthy on Trademarks, § 23:48.(cid:160) Furthermore, it has been
`found that where a party chooses a trademark which is inherently weak, he will not be afforded wide
`latitude of protection which is afforded the owners of strong trademarks.(cid:160) See (cid:160) In re Central Soya
`Company, Inc., 220 USPQ 914, 917 (TTAB 1984).(cid:160) Due to the fact that(cid:160) so many different parties
`have elected to use (and register) DERMA as a dominant portion of its mark in the wound care
`industry, no one party can expect to enjoy the scope of protection afforded to more distinct marks.
`
`CONCLUSION:
`
`In light of the dissimilarity of the services, the trade channels, and the marks themselves,
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`Applicant urges that no likelihood of confusion exists between the requested mark DERMATAC and
`the cited mark.(cid:160) Applicant respectfully submits that the application is now conditioned to be passed to
`publication on the Principal Register, and such is earnestly requested.(cid:160) If a telephone conference
`may be of assistance in properly resolving any outstanding issues, the Examiner is respectfully
`requested to contact Applicant’s undersigned attorney.

`absorbent wound dressing in International Class 10.--

`REMARKS
`
`The Examiner has issued a final rejection of the application and indicates that the likelihood of
`confusion between Applicant’s mark and U.S. Registration No. 3,429,340 is grounds for refusal under
`15 U.S.C. § 1052(d).(cid:160) In response, Applicant respectfully argues that there exists no likelihood of
`confusion between the subject mark and the cited registration.(cid:160)
`
`NO LIKELIHOOD OF CONFUSION:
`
`Applicant reiterates the arguments made of record in its first response, dated October 12, 2014
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`(“First Response”) and again urges that due to the dissimilarity of the goods and services, dissimilarity
`of the trade channels, and dissimilarity of the marks, confusion between the marks is unlikely.(cid:160)

`Dissimilarity of the Goods/Services
`
`Applicant seeks to register the mark DERMATAC in connection with the following amended
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`goods:(cid:160) “surgical and wound dressings, namely, a specialized drape to secure and seal an underlying
`absorbent wound dressing” (“Applicant’s Goods”).
`(cid:160) In contrast, the services associated with the
`registered DERMATEC are described as “mail order services, retail store services, wholesale
`distributorship services, and on-line retail store services featuring infection control products and
`medical disposables, namely, latex and synthetic gloves, face masks and gowns.” (“Registrant’s
`Services”) (cid:160) Applicant urges that its own branded goods are so specialized and distinct that confusion is
`unlikely.
`
`The Examining Attorney argues in the Final Office Action that through third-party registrations
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`the evidence shows that Applicant’s Goods and Registrant’s Services may emanate from a single
`source under a single mark.(cid:160) Respondent respectfully disagrees based upon the specialized nature of
`Applicant’s Goods; however, even if they may emanate from a single source it is not enough to show
`that the goods and services would be encountered by the same purchasers.(cid:160) See In re Fesco Foods,
`Inc., 219 USPQ 437 (TTAB 1983).(cid:160) In this case, the TTAB stated that “the Board has not hesitated to
`find an absence of likelihood of confusion, even in the face of identical marks applied to goods used in
`a common industry, where such goods are clearly different from each other and there is insufficient
`evidence to establish a reasonable basis for assuming that the respective products and/or services as
`
`identified by their marks, would be encountered by the same purchasers or parties.” (cid:160) Id. at 438.(cid:160) (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)

`Applicant’s Goods are specialty medical goods that are used to create an effective seal which
`
`(cid:160)
`

`
`will draw exudate into the absorbent dressing which is being used on a very specific type of wound.(cid:160) In
`fact, Applicant’s Goods are typically used to assist in the removal of exudate from chronic, acute,
`traumatic, subacute and dehisced wounds, partial-thickness burns, ulcers, (such as diabetic, venous or
`pressure), surgically closed incisions, flaps, and grafts.(cid:160) Registrant’s Services are related to the retail
`sale of medical goods of infection control products and medical disposables limited to latex and
`synthetic gloves, face masks and gowns.(cid:160) It is clear that Applicant’s Go
