`This Request for Reconsideration is in response to the Final Office Action that issued on May 7,
`2014 (the “FOA”), in which the US. Patent & Trademark Office (“PTO”) maintained its refusal
`to register Big Apple Performing Arts Inc.’s (“BAPA”) YOUTH PRIDE CHORUS (Stylized)
`mark.
`
`Applicant has filed a Notice of Appeal. Applicant respectfully requests that its appeal be
`suspended pending the PTO’s reconsideration of the FOA on the grounds outlined in this
`response.
`
`Introduction
`
`In the FOA, the PTO maintained its refusal of BAPA’s YOUTH PRIDE CHORUS (Stylized)
`mark because, inter alia, BAPA’s evidence of acquired distinctiveness purportedly is insufficient
`to show secondary meaning in YOUTH PRIDE CHORUS (Stylized) for the applied—for services.
`(FOA at 4.)

`BAPA respectfully disagrees with these findings and requests that the PTO reconsider BAPA’s
`2(f) claim of acquired distinctiveness, for the reasons set forth below.
`
`Argument
`
`LEADERS IN THE LGBTIQA VOCAL ENTERTAINMENT SECTOR
`RECOGNIZE YOUTH PRIDE CHORUS (STYLIZED) AS DISTINCTIVE IN
`THE RELEVANT COMMUNITY OF CONSUNIERS
`
`To supplement the extensive evidence of acquired distinctiveness already submitted in this
`application, BAPA hereby submits with this Reconsideration Request as Exhibits A, E, and Q,
`the declarations of Robin Godfrey, Elven Hickrnon, and Christopher Verdugo, who all occupy
`leadership roles in the lesbian, gay, bisexual, transgender, intersex, queer/questioning, allied
`(“LGBTIQA”) youth choral ensemble sector. Ms. Godfrey is the Executive Director of GALA
`Choruses, the leading trade organization of the North American LGBTIQA choral movement.
`Her organization has more than 180 member vocal ensembles with 8,000 singers. See Exhibit A
`at 2. GALA’s signature event is its quadrennial Festival, which brings together over 130
`ensembles and 6,000 singers for the world’s largest LGBTIQA performing arts event. Id. Mr.
`Hickmon is General Manager for PerformOUTKC, located in Kansas City, Missouri, which is an
`organization that produces theatrical performances and choral concerts delivering messages of
`empowerment and comprised almost exclusively of LGBTIQA youth. See Exhibit B at 1-2. Mr.
`Verdugo is Executive Director for the Gay Men’s Chorus of Los Angeles, located in Los
`Angeles, California, one of the oldest LGBTIQA performing arts organizations in the nation and
`which promotes a youth vocal ensemble called “Outside Voices.” See Exhibit C at 1-2. None of
`these directors have a stake in the outcome of this application. See Exhibits A—C.
`
`Through more than five years’ worth of exposure to BAPA’s use of YOUTH PRIDE CHORUS
`(Stylized), they are readily aware of YOUTH PRIDE CHORUS (Stylized) as BAPA’s
`designation of source for its youth vocal ensemble services. Id. As Ms. Godfrey, Mr. Hickmon,
`and Mr. Verdugo all attest, YOUTH PRIDE CHORUS (Stylized) is recognized as one of the

`founding, if not oldest, youth vocal ensemble groups in the LGBTIQA movement. Id. In their
`view, YOUTH PRIDE CHORUS (Stylized) has become distinctive of BAPA’s services from
`those of competing organizations. Id.
`
`Moreover, Ms. Godfrey, Mr. Hickmon, and Mr. Verdugo are all representative of the relevant
`group of consumers and the relevant trade offering the services described in BAPA’s
`application. Their impressions of YOUTH PRIDE CHORUS (Stylized) in the marketplace
`should be taken into account when considering whether YOUTH PRIDE CHORUS (Stylized)
`has acquired distinctiveness through secondary meaning.
`
`2.
`
`BAPA’S EVIDENCE IS MORE THAN SUFFICIENT TO SHOW SECONDARY
`
`MEANING OF YOUTH PRIDE CHORUS (STYLIZED) AS THE SOURCE OF
`ITS SERVICES
`
`The FOA erringly dismisses the previously submitted Declarations of Peter Criswell, Executive
`Director of BAPA, filed September 13, 2013 (“Criswell Decl. 1”) and April 7, 2014 (“Criswell
`Decl. 2”) (collectively, the “Criswell Declarations”). In the FOA, the Examining Attorney
`implies that Mr. Criswell’s statements are “conclusory” and ought to be scrutinized more
`carefully due to his position within the applicant organization. (FOA at 5.) However, the
`Examiner should not be so dismissive of the Criswell Declarations. In both of his declarations,
`
`Mr. Criswell attests to more than ten years of continuous and exclusive use of the YOUTH
`PRIDE CHORUS (Stylized) mark with the applied-for services. Criswell Decl. 1, in particular,
`also propounds evidence of solicited and unsolicited media mentions, advertising, and exposure
`of the YOUTH PRIDE CHORUS (Stylized) mark to the consuming public to demonstrate its
`acquired distinctiveness in the relevant trade, and specifically, the following:
`
`1. Over ten (10) years of exclusive, substantial and continuous use of YOUTH
`PRIDE CHORUS (Stylized) in interstate commerce. (Criswell Decl. 1 11 5.)
`2. YOUTH PRIDE CHORUS (Stylized) services provided at nationally attended
`events with significant importance to the LGBTIQA community, including the
`GLAAD Media Awards, GLSEN’s Respect Awards, Broadway Backwards,
`and with Cyndi Lauper on her True Colors Tour and her Home for the
`Holidays concert benefitting homeless youth. (Id. 11 3.)
`. The initial YOUTH PRIDE CHORUS (Stylized) concert at Carnegie Hall M
`approximately 2,000 tickets. (Id. 11 4.)
`. Applicant routinely advertises its YOUTH PRIDE CHORUS (Stylized)
`performances in Time Out New York which has an approximate circulation of
`147,000 recipients. (Id. 11 4.)
`. Applicant broadcasts e—mail updates, notifications and news prominently
`displaying its YOUTH PRIDE CHORUS (Stylized) mark to approximately
`5,000 recipients each year. (Id. 11 4.)
`The Center, a non—profit organization affiliated with Applicant, broadcasts e-
`mail updates, notifications and news that include updates on services offered
`under Applicant’s YOUTH PRIDE CHORUS (Stylized) mark to over 20 000
`recipients each year. (Id. 11 4.)
`. Applicant, through its members, distributes at least 5,000 palm cards
`prominently displaying Applicant’s YOUTH PRIDE CHORUS (Stylized)

`mark to advertise for every YOUTH PRIDE CHORUS (Stylized) concert.

`. Applicant has performed YOUTH PRIDE CHORUS (Stylized) concerts at the
`Gay and Lesbian Association of Choruses (GALA) Festival twice (2008 and
`2012) reaching 4 000 consumers from different cities across the United States.

`. Applicant has performed two (2) YOUTH PRIDE CHORUS (Stylized)
`concerts per year for the last ten (10) years. Each concert sells 300 tickets. It
`is estimated that 6,000 ggests have attended a YOUTH PRIDE CHORUS
`(Stylized) concert during the last ten (10) years. (Id. 1T 4.)
`. Applicant’s YOUTH PRIDE CHORUS (Stylized) performances featuring
`“We’re Not Gonna Take It” and “Generations” were discussed in NYC Up
`Magazine and Out Magazine, reaching thousands of consumers. (Id. 1T 4.)
`. Applicant’s YOUTH PRIDE CHORUS (Stylized) Facebook page enjoys
`Lfl “likes”. (Id. 1] 5.)
`. Applicant’s YOUTH PRIDE CHORUS (Stylized) Twitter account enjoys %
`followers. (Id. 1l 5.)
`. Applicant’s YOUTH PRIDE CHORUS (Stylized) channel on YouTube has
`been viewed 126 821 times. (Id. 1l 5.)
`. Applicant’s YOUTH PRIDE CHORUS (Stylized) YouTube video, “It Gets
`Better,” has been viewed 103 382 times. (Id. 1] 5.)
`. Applicant’s video on YouTube video about YOUTH PRIDE CHORUS
`(Stylized) has been viewed 2,096 times. (Id. 1l 5.)
`. Applicant has enjoyed at least forty—eight (48) unsolicited media mentions,
`articles and interviews about its YOUTH PRIDE CHORUS (Stylized) events,
`including placement in The New York Times, New York Daily News, Time Out
`New York, Out Magazine, Playbillcom, NY1, and New York Magazine. (Id.
`W 5-6-)
`
`The Examining Attorney also claims that there is no information, solicited or unsolicited that
`shows the mark, YOUTH PRIDE CHORUS (Stylized) is perceived by consumers as a source
`identifier. (FOA at 5.) Applicant respectfully disagrees. The Criswell Declarations and the
`accompanying third party evidence that they proffer demonstrate that YOUTH PRIDE CHORUS
`(Stylized) is a source identifier for BAPA’s vocal ensemble services. For example, the print-outs
`from BAPA’s YOUTH PRIDE CHORUS (Stylized) channel on YouTube, attached to Criswell
`Decl. 1, shows BAPA’s YOUTH PRIDE CHORUS (Stylized) mark prominently displayed at the
`top of the page, and includes a section on “About Youth Pride Chorus,” “Inside Youth Pride
`Chorus,” and includes different links to YOUTH PRIDE CHORUS (Stylized) performances.
`The YouTube channel name is in fact called “Youth Pride Chorus”. How the Examining
`Attorney can arrive at the conclusion that YOUTH PRIDE CHORUS (Stylized) has not acquired
`secondary meaning, in light of over 126,000 views of YOUTH PRIDE CHORUS (Stylized)
`performances on YouTube or over 1,800 followers on social media platforms is confounding.
`
`In the FOA, the Examining Attorney continues to reassert her previous contention that the
`quantum and quality of BAPA’s evidence of acquired distinctiveness is insufficient. The FOA
`does not, however, justify this contention in light of BAPA’s significant evidence. Instead, it
`relies on an inapt analogy between YOUTH PRIDE CHORUS (Stylized) and “THE

`SCIENTIFIC APPROACH,” the mark at issue in In re Redken Labs, Inc, 170 U.S.P.Q. 526
`(T.T.A.B. 1971). The Examining Attorney repeatedly rests on Redken, as if the comparison
`between YOUTH PRIDE CHORUS (Stylized) and THE SCIENTIFIC APPROACH were afail‘
`accompli.
`In Redken, the Board determined that THE SCIENTIFIC APPROACH had not
`acquired distinctiveness, despite longstanding use and extensive investment efforts. (See, eg.,
`FOA at 5.) However, as discussed in Applicant’s prior Response to Office Action dated April 7,
`2014, the present case is clearly distinguishable from the Redken case for two reasons.
`
`First, and as explored in extensive depth previously in Applicant’s Response to Office Action
`dated April 7, 2014 (the “Second Response”), Applicant’s evidence of acquired distinctiveness in
`this case is far more extensive than the evidence submitted in the Redken matter. Nonetheless,
`
`the Examining Attorney continues to treat the Redken acquired distinctiveness evidence
`superficially despite Applicant’s exhaustive efforts explaining the differences between Redken
`and the present case and why Redken should not apply. (See Second Response at 3-5.)
`
`Not only is YOUTH PRIDE CHORUS (Stylized) far less descriptive than THE SCIENTIFIC
`APPROACH, and therefore requiring less, not more evidence of acquired distinctiveness, but
`the evidence proffered by BAPA clearly shows that the YOUTH PRIDE CHORUS (Stylized)
`mark has acquired distinctiveness in the minds of the relevant consumers (i.e. consumers of
`LGBTIQA youth vocal ensemble services). As established by the evidence proffered in the
`Criswell Declarations, BAPA’s YOUTH PRIDE CHORUS (Stylized) vocal ensemble services
`have been the subject of nearly 50 unsolicited media mentions; BAPA has performed live for
`thousands of patrons under the YOUTH PRIDE CHORUS (Stylized) mark; and BAPA’s popular
`YouTube channel identified under the YOUTH PRIDE CHORUS (Stylized) mark has been
`viewed over 126,000 times. (Criswell Dec]. 1
`4-6.) YOUTH PRIDE CHORUS (Stylized)
`services have been provided at nationally attended events with significant importance to the
`LGBTIQA community, including the GLAAD Media Awards, GLSEN’s Respect Awards,
`Broadway Backwards, and with Cyndi Lauper on her True Colors Tour and her Home for the
`Holidays concert benefitting homeless youth. (Id. 1] 3.) The Examining Attorney omits all
`discussion of this evidence entirely.
`
`Second, the mark at issue in the Redken case, THE SCIENTIFIC APPROACH, is far more
`
`descriptive than is Applicant’s YOUTH PRIDE CHORUS (Stylized) mark. A Google search of
`THE SCIENTIFIC APPROACH returns, among other generic sites, many different websites
`describing various scientific approaches in various different fields. By contrast, the top ten hits
`in a Google search of YOUTH PRIDE CHORUS (Stylized) all refer to BAPA’s YOUTH PRIDE
`CHORUS (Stylized) mark. These search results are attached as Exhibits D and
`As such,
`THE SCIENTIFIC APPROACH and YOUTH PRIDE CHORUS (Stylized) are manifestly
`different terms along the spectrum of distinctiveness. It is unclear how much evidence of
`secondary meaning it would take to render THE SCIENTIFIC APPROACH identifying most any
`good or service, whereas Applicant’s evidence of acquired distinctiveness more than satisfies the
`required minimum amongst consumers of LGBTIQA youth vocal ensemble services.
`

`THE EXAMINING ATTORNEY DISTORTS APPLICANT’S POSITION WITH
`RESPECT TO THE USE OF “YOUTH PRIDE” IN THE RELEVANT
`COMMUNITY

`In BAPA’s Second Response, BAPA stated that the term “Youth Pride” is not so commonly
`used in the LGBTIQA community as to be highly descriptive, yet recognizing that many
`LGBTIQA organizations have adopted the expression “Youth Pride” as a mode of
`empowerment. In the FOA, the Examining Attorney rnisinterprets these two points as
`contradictory, or worse, some sort of admission as to the highly descriptive nature of YOUTH
`PRIDE CHORUS (Stylized). (FOA at 5.) Neither is the case, however.
`
`Though there are examples of third party “Youth Pride” usage available online, the examples
`referenced by the Examiner in the FOA by no means demonstrate that “YOUTH PRIDE” is so
`commonplace a term amongst the majority of organizations who direct their products and
`services to LGBTIQA consumers, such that YOUTH PRIDE CHORUS (Stylized) could not,
`even with ten years of continuous and exclusive use, extensive media coverage, and
`prominently-held performances, have acquired distinctiveness. Indeed, searches of numerous
`online business directories listing LGBTIQA organizations show that the vast majority of such
`businesses and organizations incorporate neither “pride” nor “youth pride” in their names. And
`the vast majority are unrelated to music and performing arts services, and therefore irrelevant to
`BAPA’S application. Exemplar directory results are attached as Exhibit F. See, e.g., In re Savi
`Tech., 2014 WL 2174317 (T.T.A.B. May 12, 2014) (reversing refusal to register because the
`examining attorney had “not shown that relevant purchasers of applicant’s vehicle tracking
`software would .

`. perceive” the applied-for mark as merely descriptive) (non-precedential).
`
`Conclusion
`
`BAPA respectfully submits that its YOUTH PRIDE CHORUS (Stylized) mark has acquired
`distinctiveness sufficient to create secondary meaning in the minds of the relevant consumers of
`its services. It respectfully requests the PTO to reconsider both its previously-subrnitted
`evidence and the additional affidavits and evidence attached herein, and to pass its application to
`publication.
