`Registration has been refused on the ground that the mark (the “Mark”) as used on the specimen
`is “merely a decorative or ornamental feature of the packaging for the goods; it does not function
`as a trademark.”
`
`The Mark consists of grid-like lines that depict a man in profile holding a glass oficy liquid,
`with the color red emanating from the man's back teeth. As shown on the specimen, the Mark is
`used on packaging for COLGATE SENSITIVE PRO-RELIEF toothpaste:

`For the reasons discussed below, Applicant disagrees and respectfully requests that the refusal be
`withdrawn.
`
`I. Applicant’s Mark Functions As A Source Indicator
`
`The Office action states that Applicant’s Mark as shown on the specimen is “merely ornamental
`becau.se it is a large pictorial image of a man drinking a cold drink and exhibiting nerve pain in
`the mouth as a result,” and, because the goods are sensitive teeth toothpaste, the “public
`perception of the applied—for mark would be merely a pictorial illustration of the problem the
`product aids in relieving.”
`
`Even if the Office action is correct in stating that the public would perceive the Mark as a
`pictorial illustration of the problem the product aids in relieving, this does not mean that the
`Mark does not also function as a trademark. A mark need not be only one or the other. See, e.g.,
`In re Clairol Inc, 173 USPQ 355 (CCPA 1972) (“a mark may be used for both a trademark
`

`purpose and a non—trademark purpose and still be a valid trademark”) Applicant believes that
`consumers perceive the Mark as both a source indicator and a pictorial representation.
`
`In the case ofln re Olin Corp, 181 U.S.P.Q. 182 (T.T.A.B. 1973), the Board found that a
`trademark that serves as ornamentation can, in fact, also serve a source-identifying function. The
`Olin case involved T-shirts bearing the applicant’s corporate logo, and the Office had refused
`registration on the ground that the design mark was mere ornamentation as applied to T—shirts.
`The Board disagreed, stating that “[i]t is a matter of common knowledge that T-shirts are
`‘ornamented’ with various insignia... or ‘ornamented’ with various sayings. ...The
`‘ornamentation’ of a T—shirt can be of a special nature which inherently tells the purchasing
`public the source of the T—shirt. ..,”
`at 182; see also In re Paramount Pictures Corp, 213
`U.S.P.Q. llll (T.T.A.B. 1982) (finding MORK & MINDY inherently registrable for
`“collateral” products such as decals). Despite the inforrnation—conveying function served by
`such ornamentation, the law is clear that such matter can also convey to purchasers information
`about the source of the goods.
`
`The nature of Applicant’s use of the Mark on the goods is technical trademark use in that the
`mark appears directly on the packaging for the goods. This is a typical manner in which
`trademarks are presented on packaging for consumer goods. Thus, while consumers may indeed
`perceive the Mark as a stylized illustration, this does not mean that they will not also perceive it
`as a trademark and source indicator.
`
`II. Pictorial Illustrations Can and Do Serve as Trademarks
`
`The Office action attached excerpts fiom an Amazon search for sensitive toothpaste for the
`purpose of “demonstrating that pictorial illustrations of mouths, teeth and other designs are
`commonly used on tooth care products to indicate the purpose of the goods.” Images of six
`products are displayed. (Because the entire web page for each product is included in the
`exhibits, there are 44 pages attached to the Office action, but only six pages display the relevant
`images.) Four of these are pictorial illustrations, whereas two appear to be actual photographs:
`the ice cubes shown on the Kiss My Face Sensitive Toothpaste packaging, and the mouth shown
`on the Plus White 5 Minute Speed Whitening Gel.
`
`Pictorial illustrations frequently serve as trademarks. Thus, even if these images are relevant to
`demonstrate that consumer perceive pictorial illustrations on tooth care products to indicate the
`purpose of the goods, this does not foreclose the possibility that the images also serve a
`trademark function.
`
`The Patent and Trademark Office Register is replete with registrations for marks that are
`pictorial illustrations of the problem that the product addresses, and that nonetheless operate as
`source-identifiers. Applicant searched the PTO Trademark Document Retrieval records for a
`sampling of such marks, and located specimens that show usage of the marks in a manner that is
`comparable to Applicant’s use of its mark. As illustrative examples, Applicant notes the
`following registered marks:

`a marked departure from Office practice to refuse registration in this case for the stated basis.

`As further support for the registrability of applicant’s mark, applicant notes the following. Also
`on the packaging for its COLGATE Sensitive Pro-Relief toothpaste is an image ofa tooth
`represented by grid—like lines (the “Grid Tooth”), with a red glow emanating from the left side of
`
`the tooth, and a blue glow emanating from the right side of the tooth:

`Applicant owns Reg. 4,05 6,866 for the Grid Tooth design. The specimen of use for that
`registration also was packaging for applicant’s COLGATE SENSITIVE PRO—RELIEF
`toothpaste:

`Like the Mark for which applicant seeks registration here, the Grid Tooth can also arguably be
`characterized as a “pictorial illustration of the problem that the product aids in relieving." Yet
`the Grid Tooth is also a registered trademark, demonstrating both that imagery on packaging for
`consumer goods can and does serve both functions, and that the Office practice is to register such
`marks despite their du.al function.
`
`In conclusion, as demonstrated above, the refusal is not Well- grounded in law or Office practice,
`and should be withdrawn.
