`The Office Action makes final the refusal based on the two cited registrations which are both owned by
`Small World Trading Co.:

`Registration No. 2146626 of the mark EO for "skin and bath preparations, namely, bath and shower
`soaps, non-medicated bath salts, bath and body oils, shower gels, skin cleansers, skin toners, skin
`moisturizers, skin lotions, clarifiers, creams; sunscreen preparations" in Class 3; and
`
`Registration No. 4089642, the former provisionally cited Application No. 85008791, of the mark EO
`and Design for "Antibacterial skin soaps; Antibacterial soap; Aromatherapy body care products, namely,
`body lotion, shower gel, cuticle cream, shampoo, conditioner, non-medicated lip balm, soap, body
`polish, body and foot scrub and non-medicated foot cream; Bath gel; Bath soaps; Bath soaps in liquid,
`solid or gel form; Body cream soap; Cosmetic preparations for skin renewal; Cosmetic preparations,
`namely, skin balsams; Cosmetic products in the form of aerosols for skin care; Cosmetic soaps;
`Deodorant soap; Hair gels; Hair rinses; Hair shampoo; Hair shampoos and conditioners; Lip balm; Non-
`medicated foot cream; Non-medicated foot lotions; Non-medicated skin care preparations; Non-
`medicated skin care preparations, namely, creams, lotions, gels, toners, cleaners and peels; Non-
`medicated skin creams; Non-medicated stimulating lotions for the skin; Shampoo-conditioners;
`Shampoos" in Class 3, which matured into registration on January 24, 2012.

`These citations are erroneous and should be withdrawn. There is no likelihood of confusion. The present
`mark includes the distinctive term "Mousa" which allow consumers to immediately distinguish it from
`each registered mark. As stated in the Response filed on March 16, 2012, the term "Mousa" is the name
`of a goddess (in ancient Greek mythology any of the 9 daughters of Zeus and Mnemosyne). The
`Response filed on March 16, 2012, included an Exhibit stating "EO is a common abbreviation for
`Essential Oil" and an Exhibit stating "EO is a common soapmaking abbreviation for Essential Oil."
`
`There are numerous parties using the term "Essential Oils" in the relevant trade. This is shown by the
`Exhibits filed herewith which are web pages that were obtained from the Internet today.
`
`Applicant submits that the application should be approved for publication. In the alternative, Applicant
`submits that a new issue has been raised by the presently submitted evidence, and that a new, non-final
