`The Examining Attorney has required a disclaimer of the term FIFTEEN within Applicant’s mark THE
`FULL FIFTEEN, on the grounds that same merely describes a feature of Applicant's goods. Applicant
`respectfully disagrees that any disclaimer is needed and submits that its mark is unitary, and that term
`FIFTEEN as used within its mark is at a minimum suggestive of Applicant’s goods.

`Unitary marks are marks which create a commercial
`iunregistrable component of the mark. See TMEP 1213.05. The Trademark Offlce must consider the
`i meaning of the terminology when making a determination regarding a disclaimer.
`Id. Even if a mark
`contains a descriptive word, if such term is combined with non—descriptive matter in such a way that the
`descriptive significance of the word in relation to the goods is lost, no disclaimer is needed. Id. Marks
`that may be unitary include double entendre marks, marks with incongruous meanings, marks with a l
`unique sound pattern, and slogan marks.

`This case is analogous to In re J. R. Carlson Laboratories, Inc., 183 USPQ 509 (TTAB 1974), a case
`involving an Applicant’s appeal to the Board of a disclaimer requirement for the term E within the mark E
`I
`E GEM for bath products containing vitamin E. The Board reversed the Examiner’s requirement for a E
`disclaimer, and held that the mark was a compound mark that would create a singular impression on
`consumers, such that no disclaimer was required. It stated “notwithstanding the fact that purchasers of
`applicant's goods would more or less recognize the significance of the letter “E“. ..[the term E] serves an
`iadditional function as a salient feature of applicant's trademark.” Id. at 511.
`In the case at hand,
`Applicant submits that consumers will not be likely to recognize the significance of the term FIFTEEN
`as used within Applicant’s mark, because ofthe inventive pairing of the terms FULL and FIFTEEN. In E
`addition, as inJ. R. Carlson, Applicant’s mark will create a singular impression on consumers. Because
`the mark is unitary, no term should be disclaimed.

`In the final refusal, the Examiner argued that a disclaimer is needed because “other wine sellers would I
`need to use the number FIFTEEN to describe the alcohol content of their wines, if they contain that
`percentage of alcohol”. However, registration of Applicant’s unitary mark without disclaimers would E
`

`not prevent others from using the term FIFTEEN in a descriptive manner. See J. R. Carlson at 111 ( E
`§“registration of a compound mark is ...recognition of rights in the mark as a whole”). The belowi
`referenced coexisting marks are illustrative.
`

`The first mark shown below contains the term 15 in a descriptive manner; the mark uses the term within
`_ the phrase “l5% TO 16% ALC BY VOLUME.” Consumers are certain to understand that “15”
`indicates a percentage of alcohol in this mark. In contrast, the Applicant’s mark, THE FULL FIFTEEN, f
`is unitary and does not employ a descriptive usage of the term FIFTEEN. Similarly, the second mark in
`the chart below incorporates the phrase “ALC. 13.0% BY VOLUME", which is disclaimed. This mark
`coexists with the mark 13.1 for the same goods, in which the number 13 or 13.1 is not disclaimed. Both _
`marks use the term THIRTEEN; however, one mark illustrates descriptive use and features an
`appropriate disclaimer, whereas the other illustrates usage within a unitary suggestive mark, such that no ;
`disclaimer is needed. Such examples support Applicant’s position that its mark does not incorporate a
`descriptive usage of the term FIFTEEN, and such term should not be disclaimed within its mark. More

`As stated above, courts have also acknowledged that unitary marks which combine arguably descriptive
`components are registrable without disclaimers if the pairing or juxtaposition of the words is inventive or:
`fihas an incongruous or unclear meaning as applied to the goods or services. For example, in In re:
`iHampshire-Designers, Inc., 199 USPQ 383 (TTAB 1978), the Board rejected an examining attomey’s
`iarguments that the term DESIGNERS within the mark DESIGNERS PLUS+ should be disclaimed,i
`because the mark as a whole was unitary. The Board noted that the meaning of the term DESIGNERS
`was “undoubtedly” well-known, but that the pairing of the term with “PLUS+” created a mark that,
`iwhen considered in its entirety, did not describe “with any degree of particularity some quality ori
`characteristic of the goods in connection with which it is used”, such that no disclaimer was appropriate.
`Id at 384. The Board emphasized that the appropriate analysis regarding whether a disclaimer was
`ineeded hinged upon the inquiry of whether the term “DESIGNERS” imparted a merely descriptive
`significance when within fig Applicant’s mark, rather than as used apart from the mark.

`In other words, a dissection of a term from the mark as a whole is not appropriate when
`determining whether a disclaimer is appropriate. Also see TMEP 1213.05.

`Similarly, the pairing of terms in Applicant’s mark is inventive as applied to Applicant's goods, and the
`iterm FIFTEEN as used in Applicant’s mark does not describe “with any degree of particularity”
`lApplicant’s goods. See also TMEP Section 1213.05 (“[A] descriptive word can be combined withé
`inondescriptive wording in such a way that the descriptive significance of the word in relation to the ;
`goods is lost and the combination firnctions as a unit...Anexample is the term “Black Magic,” [ini
`which] “black” is not intended to have color significance in relation to the goods, and should not be
`disclaimed even if the mark is applied to goods that are black in color). The term FIFTEEN also has
`varying significance when used in different contexts. The term has biblical significance, it indicates the
`ihalf—way point in many months, it has significance in sports and sporting events, and it is commonly.
`§used in the phrase “15 MINUTES FAME”. See Exhibit B. As used within Applicant’s mark, and
`behind the term FULL (which may suggest some quality relating to taste or flavor), the term certainly
`will not communicate “15% alcohol” to consumers.

`In this regard, Applicant notes there are numerous co-existing marks registered on the
`rincipal Register (or allowed) containing numerical terms for wines or other alcoholic beveragesi
`without disclaimers by the Office. Applicant notes in particular the marks SHIRAZ 9, 8 1/2 and Design,
`FIRST ELEVEN and TWELVE, all of which are associated with wines and do not feature;

`Enclosed as Exhibit C are copies of TARR printouts of the referenced marks, indicating that
`5 none of the registrations or allowed applications contain a disclaimer or the terms of interest in the above 1
`marks, nor are they based on acquired distinctiveness. Such marks indicate that the Trademark Office
`does not regard disclaimers for numerical terms that are not used descriptively within suggestive unitary
`marks. As Applicant's mark is suggestive and unitary, the term FIFTEEN likewise should not be
`disclaimed within its mark.

`Moreover, it is USPTO policy not to require disclaimers of individual terms within a registrable slogan

`registrable slogan, such that no disclaimers for terms within its mark are required.
