`BACKGROUND AND PROSECUTION HISTORY
`
`This is an appeal from a final Office Action dated January 31, 2022. Applicant Fredericia
`
`Furniture A/S ("Applicant") manufactures housewares in a small peninsular city in southeastern
`
`Denmark, named after Frederick III.
`
`On May 13, 2021, Applicant filed a trademark application for the mark “FREDERICIA”
`
`(“Mark”) under Section 66(a) of the Trademark Act with the United States Patent and Trademark
`
`Office ("USPTO"). Applicant filed the application in International Classes 11, 20, and 35 for
`
`various houseware goods and attendant services.
`
`On October 9, 2021, the Trademark Office refused to register the Mark, asserting that the
`
`Mark is, somehow, primarily geographically descriptive under section 2(e)(2) of the Trademark
`
`Act, 15 U.S.C. § 1052(e)(2). The Office provided a Columbia Gazetteer extract, a Wikipedia
`
`Entry, a U.S. Embassy & Consulate extract for Denmark, and an undated extract from the website
`
`<www.thecrazytourist.com>.
`
`On January 4, 2022, Applicant responded, arguing that the Office had failed to meet the
`
`government’s burden to justify refusal under section 2(e)(2) of the Trademark Act. Specifically,
`
`Applicant argued that FREDERICIA is not a generally known geographic location for American
`
`consumers, of housewares, or otherwise. Applicant provided evidence that Fredericia, Denmark is
`
`a remote, little known fishing town whose principal industry is oil refining. Additionally,
`
`Applicant pointed the Office to USPTO prosecution records for Applicant’s prior U.S. registration,
`
`U.S. Reg. No. 4,239,814 wherein no refusal under Section 2(e) (2) was rendered and no disclaimer
`
`of “FREDERICIA” was required.
`
`On January 31, 2022, the Office issued a final Office Action in which the government
`
`continued the section 2(e)(2) refusal to register the Mark as primarily geographically descriptive.

`In continuing the government’s refusal, the Office noted that Frederica is “one of Denmark’s
`
`largest traffic hubs” and that Denmark as a country in its entirety attracts a few hundred thousand
`
`U.S. tourists, annually.
`
`On July 29, 2022, Applicant filed a Request for Reconsideration addressing each of the
`
`issues raised and providing additional evidence. Applicant again argued that the Office had not
`
`demonstrated that “FREDERCIA” is a generally known geographic location and, therefore, that
`
`FREDERCIA is primarily geographically descriptive for American consumers. Nota bene,
`
`Applicant provided evidence that “FREDERICIA” has alternative commercial meanings, e.g., as
`
`a possible feminine first name, and thus, was unlikely to be viewed as primarily geographically
`
`descriptive in the U.S. marketplace.
`
`Applicant, also on July 29, 2022, filed a timely Notice of Appeal. Subsequently, on August
`
`26, 2022, the Office denied Applicant’s Request for Reconsideration, citing the final Office Action
`
`dated September 20, 2017. The Office maintained that the Mark was primarily geographically
`
`descriptive, and provided evidence that Fredericia appears on copious maps of Denmark and has
`
`a commercial port, and provided a handful of incidental references to Fredericia in U.S.
`
`publications, e.g., a 1993 article noting that a resident of a nursing home in a small Florida town
`
`celebrated her 100th birthday – and that she had been born in Fredericia, Denmark.

`ARGUMENT
`
`I.
`
`Applicable Law
`
`Section 2(e)(2) of the Trademark Act prohibits the registration on the Principal Register of
`
`a mark which “when used on or in connection with the goods of the applicant is primarily
`
`geographically descriptive of them,” 15 U.S.C. § 1052(e)(2). To refuse registration of a mark on
`
`the ground that it is primarily geographically descriptive, the USPTO must show:
`
`(1) The mark is the name of a place known generally to the public;
`
`(2) The goods for which applicant seeks registration originate in the geographic place
`
`identified in the mark; and
`
`(3)
`
`Purchasers would be likely to believe that the goods originate in the geographic
`
`place identified in the mark.
`

`

`
`S.A., 824 F.2d 957, 3 USPQ2d 1450, 1452 (Fed. Cir. 1987); In re Hollywood Lawyers Online, 110
`
`USPQ2d 1852, 1853 (TTAB 2014). The “relevant public is the purchasing public in the United
`

`States of [the] types of goods [and services]” identified in the involved application. In re Broken
`
`Arrow Beef & Provision, LLC, 129 USPQ2d 1431, 1432 (TTAB 2019) [precedential].
`
`Accordingly, in the case at bar, the Office is required to demonstrate that Frederica, Denmark is a
`
`place generally known to American housewares purchasers, and attendant thereto, that purchasers
`
`would believe that their housewares originate in Fredericia, Denmark. Id. at 1432; In re Nantucket,
`
`Inc., 213 USPQ 889, (TTAB 1982) (noting that “of primary consideration is whether or not there
`
`is an association in the public mind of the product with the particular geographical area, as for
`
`example perfumes and wines with France, potatoes with Idaho, rum with Puerto Rico, and beef
`
`with Argentina”).
`
`II.
`
`FREDERICIA, When Used with Housewares, is not Primarily Geographically
`Descriptive
`
`
`
`
`
`A. The Office has not shown that Fredericia, Denmark is known for Housewares
`
`The Office’s evidence of record does not demonstrate that “FREDERICIA” is a generally
`
`known geographic location to the American housewares consumer, and thus, the government has
`
`not carried its burden of persuasion. See In re Roy J. Mankovitz, 90 USPQ2d 1246, 1251 (TTAB
`
`2009).
`
`Rather, the Office has demonstrated that Fredericia, Denmark appears on maps. E.g.,
`
`Alamy Stock Photo Map, University of Texas Danish Map Data, Nationsonline.org Danish Map
`
`Data (August 26, 2022 Reconsideration Letter p11-28). The Office has even demonstrated that
`
`some American consumers may purchase Danish maps and even animated decorative maps of
`
`Denmark (Maps.com Danish Map for Sale Listing, AllPosters.Com Danish Map for Sale Listing,
`
`Etsy.Com Artisanal Danish Map for Sale Listing (August 26, 2022 Reconsideration Letter p29-
`
`34).
`

`The Office has demonstrated that Fredericia has a commercial port (E.g., ShipNext Extract
`
`(August 26, 2022 Reconsideration Letter at p6)) and that goods are shipped through this port. Id.
`
`The Office has shown that some Americans have Danish ancestry (US Census Data and DHS 2020
`
`Yearbook; August 26, 2022 Reconsideration Letter p63-66) and some others travel to Denmark
`
`generally (U.S. Embassy Data (Undated) October 9, 2021 Office Action p8). The Office has
`
`further shown that in 2004 an American duathlete borrowed a bike in Fredericia, Denmark (“Lost
`
`Bicycle No Problem” January 31, 2022 Final Office Action, p8 ); in 1996 a cheese from Fredericia,
`
`Denmark competed in Green Bay Wisconsin cheese-off (“Competition is Intense at this Week’s
`
`World Cheese Championship” August 26, 2022 Reconsideration Letter (“noting that [an] entry
`
`from came in from such exotic places as Frederica […] in Denmark”) (January 31, 2022 Final
`
`Office Action p14); that Disney Cruises began stopping in Fredericia, Denmark only just before
`
`the global COVID pandemic (“New Disney Cruises Explore Europe” January 31, 2022 Final
`
`Office Action p14), and even that one genetically blessed Floridian who was born in Fredericia,
`
`Denmark celebrated her 100th birthday in 1993 (“Woman Celebrates 100th Birthday” August 26,
`
`2022 Reconsideration Letter p58).
`
`However, none of the Office’s evidence demonstrates that Fredericia, Denmark is known
`
`for lighting or furniture or housewares generally. Rather, the Office has proffered evidence that
`
`Fredericia if known at all to Americans, is known as a port city with a petroleum and
`
`chemical/petrochemical industry. See, e.g., University of Texas industry map data (August 26,
`
`2022 Reconsideration Letter at p16)( listing chemicals and oil refining near Frederician,
`
`Denmark), Columbia Gazetteer of the World Data (October 9, 2021 Non-Final Office Action at
`
`p2) (“Manufactures include, inter alia, refined petroleum), ShipNext Extract (August 26, 2022
`
`Reconsideration Letter at p6 (detailing that chief Danish exports shipped from Fredericia port are,
`

`e.g., crude oil, liquified petroleum gas (LPG) fertilizers)); “Denmark Saves on Energy with Waste
`
`Energy” (August 26, 2022 Reconsideration Letter at p51) (1981 article discussing waste water
`
`produced by Fredericia, Denmark’s several chemical plants and efforts to convert waste water);
`
`“CB&I Awarded $175M Contract” (January 31, 2022 Final Office Action p.23-24) (2013 article
`
`that references pipe oil terminal located in Fredericia, Denmark); “Waste-to-Energy Plant
`
`Considered” (August 26, 2022 Reconsideration Letter at p45) (2017 article discussing applying
`
`technology used to convert Fredericia, Denmark’s waste energy to clean up Massachusetts waste
`
`sites).
`
`Notably, the Office relies chiefly on Gazetteer, Google, and Wikipedia data hits. However,
`
`“[t]he internet (and websites such as Wikipedia) contains enormous amounts of information: some
`
`of it is generally known, and some of it is not. … the mere entry in a gazetteer or the fact that a
`
`location is described on the internet does not necessarily evidence that a place is known generally
`
`to the relevant public.” Newbridge Cutlery, 113 USPQ2d at 1450-51.
`
`The Office attempts to buttress the government’s refusal by noting that Denmark has a lot
`
`of tourists and that some of these tourists may or may not visit Fredericia, Denmark and that they
`
`may go shopping while in town.
`
`These carefully culled references simply do not support the Office’s narrative that
`
`Fredericia, Denmark is generally known to American consumers of lighting and furniture and
`
`attendant services. See In re Newbridge Cutlery, 113 USPQ2d at 1450 (“That Newbridge is the
`
`second largest town in County Kildare and the seventeenth largest in the Republic of Ireland
`
`reveals nothing about what the relevant American purchaser might perceive the word ‘Newbridge’
`
`to mean and is too insignificant to show that Newbridge is a place known generally to the
`
`American purchasing public.”); In re Societe Generale des Eaux Minerals de Vittel S.A., 824 F.2d

`957, 3 USPQ2d 1450, 1452 (Fed. Cir. 1987) (noting that fact that PTO had established that Vittel
`
`was a small resort town with a spa was insignificant evidence that that the bulk of [US] cosmetics
`
`purchasers, or even a significant portion of them, would upon seeing the word Vittel on a bottle
`
`of skin lotion or the like, conclude that it is a place name and that the lotion came from there,
`
`rather than simply a trademark or trade name. See also, In re Bavaria St. Pauli Brauerei AG, 222
`
`USPQ 926, 927-28 (TTAB 1984) (“JEVER” and design for “beer” produced in the German town
`
`of Jever has an obscure geographical meaning and is not primarily geographically descriptive), In
`
`re Brauerei Aying Franz Inselkammer KG, 217 USPQ 73, 75 (TTAB 1983) (“AYINGER,” in
`
`“AYINGER BIER” (“BIER” disclaimed) for “beer” produced in the German town of Aying, has
`
`a minor, remote, or obscure geographical significance and not is primarily geographically
`
