`Applicant is requesting reconsideration of a final refusal dated January 22, 2006.

`Afier careful consideration of the law and facts of the case, the examining attorney must deny the
`request for reconsideration and adhere to the final action as written since no new facts or reasons have
`been presented that are significant and compelling with regard to the point at issue.
`
`Accordingly, applicant’s request for reconsideration is denied. The time for appeal runs from the date
`the final action was mailed. 37 C.F.R. Section 2.64(b); TMEP Section 715.03(c).

`However, applicant will note the following:
`
`(1) Applicant’s amended recitation of services is accepted
`(2) The examining attomey’s refusal is withdrawn as it applies to Class 35 — the present refusal
`applies only to Class 36

`Section 2(d) - Likelihood of Confusion Refusal
`The examining attorney initially refused registration under Trademark Act Section 2(d), 15 U.S.C.
`§1052(d), because the applicant’s mark, when used on or in connection with the identified services, so
`resembles the mark in U.S. Registration No. 2499924 as to be likely to cause confusion, to cause
`mistake, or to deceive. TMEP §§1207.01 et seq.
`
`The examining attorney must analyze each case in two steps to determine whether there is a likelihood
`of confiision. First, the examining attorney must look at the marks themselves for similarities in
`appearance, sound, connotation and commercial impression. In re E. I. DuPont de Nemours & C0,, 476

`services to determine if they are related or ifthe activities surrounding their marketing are such that
`confusion as to origin is likely. In re August Storck KG, 218 USPQ 823 (TTAB 1983); In re
`International Telephone and Telegraph Corp., 197 USPQ 910 (TTAB 1978); Guardian Products C0., v.
`Scott Paper Co., 200 USPQ 738 (TTAB 1978). TMEP §§1207.01 et seq.
`
`Applicant seeks to register the mark ELITEGROUP (and design) for “Human resources consultation;
`business consultation services, namely, consultation regarding health benefit plans for employees;
`Administration of business payroll for others,” in Class 35', and “Administration of employee benefit
`plans; Employee benefit plan administration consultation; Administration of employee retirement plans;
`Insurance brokerage and underwriting for employers in the field of property and casualty insurance,” in
`Class 36.”
`
`Registrant’s mark is ELITE MARKETING GROUP (and design) for “insurance brokerage in the fields
`of life, health, long-tenn care and annuity insurance.”
`
`Similarity ofMarks
`
`The terms ELITEGROUP (and design) and ELITE MARKETING GROUP (and design) are highly
`similar in appearance, sound and connotation.
`
`The examining attorney must compare the marks for similarities in sound, appearance, meaning or
`connotation. In re E. I. DuPont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).
`Similarity in any one of these elements is sufficient to find a likelihood of confusion. In re Mack, 197
`USPQ 755 (TTAB 1977). TMEP §§l207.0l(b) et seq.
`
`The examining attorney must look at the marks in their entireties under Section 2(d). Nevertheless, one
`feature of a mark may be recognized as more significant in creating a commercial impression. Greater
`weight is given to that dominant feature in determining whether there is a likelihood of confusion. In re
`National Data Corp, 224 USPQ 749 (Fed. Cir. 1985); Tektronix, Inc. v. Daktronics, Inc., 534 F.2d 915,
`189 USPQ 693 (C.C.P.A. 1976). In re JM. Originals Inc., 6 USPQ2d 1393 (TTAB 1988). TMEP
`§1207.0l(b)(viii).
`
`The mere deletion of wording from a registered mark is not sufficient to overcome a likelihood of
`confiision under Section 2(d). See In re Optical Int ’l, 196 USPQ 775 (TTAB 1977) (where applicant
`filed to register the mark OPTIQUE for optical wear, deletion of the term BOUTIQUE is insufficient to
`distinguish the mark, per se, from the registered mark OPTIQUE BOUTIQUE when used in connection
`with competing optical wear).
`In the present case, applicant’s mark does not create a distinct
`commercial impression because it contains the same common wording as registrant’s mark, and there is
`no other wording to distinguish it from registrant’s mark
`
`Also, when a mark consists of a word portion and a design portion, the word portion is more likely to be
`impressed upon a purchaser’s memory and to be used in calling for the goods or services. Therefore, the
`word portion is normally accorded greater weight in determining likelihood of confusion. In re Dakin ’s
`Miniatures Inc., 59 USPQ2d 1593, 1596 (TTAB 1999); In re Appetito Provisions Co., 3 USPQ2d 1553
`(TTAB 1987); Amoco Oil Co. v. Amerco, Inc., 192 USPQ 729 (TTAB 1976); TMEP §l207.0l(c)(ii).
`
`Finally, ifthe services ofthe respective parties are closely related, the degree of similarity between
`marks required to support a finding of likelihood of confusion is not as great as would apply with
`diverse goods or services. ECI Division ofE Systems, Inc. v. Environmental Communications Inc., 207
`USPQ 443 (TTAB 1980). TMEP §1207.01(b).

`Applicant’s allegation that the wording of respective marks is weak is insuflicient to preclude a
`likelihood of confusion -- even if applicant has shown that the cited mark is “weak,” such marks are still
`entitled to protection against registration by a subsequent user of the same or similar mark for the same
`or closely related goods or services. See Hollister Incorporated v. Ident A Pet, Inc., 193 USPQ 439
`(TTAB 1976) and cases cited therein. In the present application, applicant has failed to establish that the
`combination of “elite” and “group” is at all weak, especially in the field of insurance.
`
`Given that applicant has essentially merely deleted the descriptive term MARKETING from the
`registered mark, the marks are to be considered similar.
`
`Similarity ofServices
`
`The services of the parties need not be identical or directly competitive to find a likelihood of
`confusion. They need only be related in some manner, or the conditions surrounding their marketing be
`such, that they could be encountered by the same purchasers under circumstances that could give rise to
`the mistaken belief that the services come from a common source. In re Martin ‘s Famous Pastry
`Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Corning Glass Works, 229 USPQ
`65 (TTAB 1985); In re Rexel Inc., 223 USPQ 830 (TTAB 1984); Guardian Products C0., Inc. v. Scott
`Paper Co., 200 USPQ 738 (TTAB 1978); In re International Telephone & Telegraph Corp., 197 USPQ
`910 (TTAB 1978). TMEP §l207.01(a)(i).
`
`Applicant argues that property and casualty insurance, as opposed to life and health insurance, are
`distinct specialized fields. However, attached are copies of printouts from the USPTO X-Search
`database, which show third-party registrations of marks used in connection with the same or similar
`services as those of applicant and registrant in this case. These printouts have probative value to the
`extent that they serve to suggest that the services listed therein, namely (a) underwriting of property and
`casualty insurance and (b) life and health insurance underwriting, are of a kind that may emanate from a
`single source. See In re Infinity Broad. Corp., 60 USPQ2d 1214, 1217-1218 (TTAB 2001); In re Albert
`Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993)‘, In re Mucky Duck Mustard Co., Inc., 6
`USPQ2d 1467, 1470 at n.6 (TTAB 1988).
`
`In addition, the examining attorney has included various web pages demonstrating that the same parties
`ofien operate not only in the property/casualty field, but in the area of life and health insurance as well.
`See attached.
`
`Registrant’s insurance brokerage services are not limited to employees or employers, or any other
`consumer segment. Thus, it must be presumed that registrant’s brokerage services are provided in
`applicant’s more narrow trade charmels.
`
`Given that applicant and registrant both provide insurance brokerage services, the services are to be
`considered similar.
`
`Although the examining attorney has refused registration, the applicant may respond to the refusal to
`register by submitting evidence and arguments in support of registration.
