`The Examining Attorney refuses registration reasoning that the mark appears to be
`
`functional for packaging for chemical agents for personal self-defense and is therefore
`
`precluded from registration under §2(e)(5) of the Lanham Act. Applicant asserts that the
`
`pepper spray dispenser, which is the subject of this trademark application, is a unique and
`
`fanciful shape and provides no real utilitarian advantages to the user, but rather is simply
`
`one of many equally feasible, efficient, and competitive designs.

`While a configuration or shape of a container is not registrable for the container per
`
`se, it may be registrable for a particular product contained therein if the shape is non-
`
`functional in character and is, moreover, inherently distinctive or has acquired secondary
`
`meaning as an indication of origin for such goods. See In re Mogen David Wine Corp.,
`
`140 USPQ 575 (CCPA, 1964).
`
`The product packaging trade dress is inherently distinctive for reasons of its lean,
`
`elongated design, petite cylindrical shape, and fanciful grooves in the midsection. These
`
`features coupled with the protruding knurl, top button with, and bottom hole where fluid is
`
`released in totality create a unique and fanciful trade dress. The other competitive, equally
`
`feasible products are exemplified below in Section A.

`A. Evidence of Competitor’s Products

`The Applicant responds to Inquiry No. 3 with evidence contained in Exhibit A
`
`containing competitor’s products and packaging designs. This list is not nearly exhaustive
`
`because our search on Yahoo® yielded over 693,000 hits for the search term “pepper
`
`spray” with most websites appearing to sell various pepper spray devices. This evidence
`
`demonstrates a plethora of various hand activated, aim and push button pepper spray
`
`packaging devices (or equivalent thereof including Mace brand). Due to the large number
`
`of hits, only a small fraction of the evidence is exemplified below:
`
`1. Applicant’s spiral bound booklet entitled Chemical Defense Product
`
`Comparison makes thirty (30) examples by visual comparison between
`
`App1icant’s product and competitor’s products.
`
`2. Talley Security Personal Protection products demonstrate at least six
`
`different hand-held pepper spray devices, which can be used in
`
`conjunction with a keychain. The hand grips show various colors,
`
`appendages for fastening, as well as smooth or grooved grips.

`The Examining Attorney has requested disclosure of all existing and expired

`Kevin L. Parsons (“Parsons”) U.S. Patent No. 5,509,581, which issued on April 23,
`
`1996, pertains to a Chemical Irritant Dispenser and Parsons U.S. Patent No. 5,839,624,
`
`which issued on November 24, 1996, pertains to a Horizontal Release Aerosol Canister.
`
`On July 23, 2004, Parsons filed two patents applications with the United States Patent and
`
`Trademark Office, which are entitled Tactical Defense Aerosol Device and Tactical
`
`Defense Device Having Baton and Spray Dispensing Capabilities, respectively.
`
`U.S. Patent Nos. 5,509,581 and 5,836,624 and pending patent applications do not
`
`relate to the subject of this trademark application, but the utility feature contained within
`
`the dispenser. See Exhibit B. Various mechanisms for a powerful release of the chemical
`
`agent contained within the canister or dispenser is essentially the patentable subject matter
`
`of this application. The pepper spray canister is nothing more than a shell housing the
`
`functional aspect of the invention.

`. When Seconds Count.
`
`The cylindrical shape, color, grooves, and how the configuration is displayed is
`
`advertised as an indicator of source and is capable of registration.
`
`D. Cost to Manufacturer
`
`In response to the Examining Attomey’s inquiry regarding cost of manufacturing
`
`the pepper spray dispenser, the Applicant asserts that the product packaging design at issue
`
`does not result from a comparatively simple or inexpensive method of manufacture in
`
`relation to alternative designs for the container.

`E. Based on the Seabrook Factors, the Configuration of the Packaging is
`
`Distinctive
`
`The evidence provided in Exhibits A and C gives ample evidentiary support to the
`
`conclusion that the proposed mark consisting of the package configuration of a pepper
`
`spray dispenser with knurlingz (1) is not a common or basic shape or design for pepper
`
`spray or mace dispensers, (2) is unique and unusual in the personal defense field, and
`
`(3) creates distinctive commercial impression.
`
`Typically, dispensers containing an aerosol pepper spray or other irritant are found
`
`in a classic aerosol canister, and are held in a vertical position when deployed. There are
`
`plenty of variations of the vertically hand-held pepper spray dispensers, but these are mere
`
`refinements of the basic shape. The subject mark of this application contains a different
`
`style of dispenser altogether with different placements of the trigger on one side of the
`
`cylinder and the hole to dispense the pepper spray on the other.
`
`The packaging
`
`configuration of the pepper spray dispenser is wholly original in appearance and as a
`
`source indicator is distinguishable from the traditional aerosol dispenser.
`
`The threshold question is whether the packaging functions independently in
`
`identifying and distinguishing the goods of Armament Systems and Procedures, Inc. than
`
`others. Based on this fanciful and unique packaging, the answer is in the affirmative. See
`
`Seabrook, p. 291.

`The Applicant submits evidence of secondary meaning for purposes of proving

`acquired distinctiveness under §2(t) of the Trademark Act by virtue of a sworn declaration.

`Applicant’s use in commerce began fourteen (14) years ago in 1991, and the

`Applicant has considerable advertising and marketing product exposure via online, mail

`order, and retail store sales of the subject mark in this Application. The Applicant has

`continuously and exclusively used the mark in commerce for these 14 years and, as stated
`
`in the attached Declaration of Dr. Kevin L. Parsons, from 1998 until the present has sold
`
`nearly four million dollars worth of goods featuring the mark and has substantially
`
`exceeded four million dollars in sales from 1991 until present.

`Description of the Mark

`The Applicant hereby amends the description of the mark as follows:
