`On August 18, 2008,

`the Examining Attorney issued a final

`refusal

`to register

`Applicant’s distinctive BIOPET mark on the ground that when used on or in connection with the
`
`identified goods, merely describes Applicant’s goods. There is no competitive need to use
`
`Applicant’s mark to identify goods related to those goods identified in App1icant’s application.

`Therefore, Applicant respectfully requests that the Examining Attorney reconsider his position,
`
`withdraw the refusal to register Applicant’s mark, and issue the Notice of Publication.

`THE TRADEMARK OFFICE HAS CONSISTENTLY HELD THAT MARKS COMBINING BIO WITH
`ANOTHER TERM ARE SUGGESTIVE

`The Examining Attorney maintained the registration refusal based on the assumption that

`the terms B10 and PET are merely descriptive and because the identification of goods description
`
`contains the term “biodegradable” and “polyethylene trephthalate.”

`marks identified in the chart.) The Examining Attorney will note that none of the above identified
`
`marks were required to disclaim the term BIO or claim distinctiveness as it concerns the term BIO.
`
`The Examining Attorney will further note that the Trademark Office has also registered
`
`marks containing the term BIO that are much more descriptive than App1icant’s mark. For
`
`example, BIO FABRICPEGS was registered for biodegradable plastic pegs or securing fabric, BIO-
`
`STAKE was registered for biodegradable non-metal stakes, and B10 SOLVE was registered in
`
`connection with a biodegradable solution. (See, supra, Exhibits 1,4, and 5.) The above registrations
`
`clearly establish that the Trademark Office considers the term BIO warrant registration on the
`
`Principal Register when such term is combined with other terms even highly descriptive terms
`
`despite the fact that the identification of goods for such marks include the term biodegradable in the
`
`identification of goods description.
`
`Additionally, the Trademark Office has registered several marks that contain the term PET
`
`in connection with goods that include the term “polyethylene terephthalate” in the identification of
`
`goods description. The following marks are registered on the Principal Register:

`marks identified in the chart.) The Examining Attorney will note that none of the above identified
`
`marks were required to disclaim the term PET or claim distinctiveness as it concerns the term PET.
`
`The Examining Attorney will further note that the Trademark Office has registered marks
`
`even when the mark includes the combination of two acronyms. For example, the mark CC-PET is
`
`a combination of two acronyms CC for “Combi-Crystal” and PET for “Polyethylene
`
`Terephthalate.” (See, supra, Exhibit 17.) The Trademark Office approved the CC-PET mark for
`
`publication and is therefore willing to register such mark despite the combination of two acronyms
`
`and the term polyethylene terephthalate in the identification of goods description. Accordingly,
`
`while the terms contained in the above marks may be considered descriptive individually, the
`
`Trademark Office considers the combination of such descriptive terms to create a unitary mark that
`
`warrants registration on the principal registry even despite the fact that the identification of goods
`
`description contains the term polyethylene terephthalate. Likewise here, Applicant has combined
`
`the term BIO with the term PET,
`
`terms which the Trademark Office has determined warrant
`
`registration on the principal registry as shown by the numerous registrations noted above even for
`
`products comprised ofpolyethylene terephthalate
`
`

`
`Accordingly, Applicant’s unique unitary BIOPET mark is not merely descriptive and therefore
`
`should be allowed on the principal register.
`
`11.
`
`APPLICANT’S BIOPET MARK IS SUGGESTIVE 01-‘ APPLICAN'I"S Goons
`
`Generally,
`
`the Trademark Trial and Appeal Board employs, among others,
`
`the
`
`“competitors’ use test” to determine whether a mark is suggestive. No Nonsense Fashions. Inc.
`
`v. Consolidated Foods Corp, 226 U.S.P.Q. 502, 507 (T.T.A.B. 1985). The application of this
`
`test demonstrates that Applicant’s BIOPET mark is suggestive of “Extruded polyethylene
`
`terephthalate resins for use in manufacturing custom fabricated biodegradable plastic products.”
`
`The availability of other tenns to describe goods or services is relevant
`
`to the
`
`determination of whether a mark is merely descriptive or suggestive. E.g., Sperry Road Corp. v.
`
`Sunbeam Corp, 442 F.2d '979, 980 (C.C.P.A. 1971); In re Shutts, 217 U.S.P.Q 363, 365
`
`(T.T.A.B. 1983).
`
`In fact, the absence of a competitive need to use specific terms to describe
`
`goods or services is compelling because this fact negates an important policy for leaving certain
`
`terms in thepublic domain for all to use; namely, to prevent the owner of a mark from inhibiting
`
`competition in the sale of particular goods or services.
`

`
`In Shutts, the Trademark Trial and Appeal Board
`
`stated:
`
`. must relate to general and
`.
`The concept of mere descriptiveness .
`readily recognizable word formulations and meanings, either in a
`popular or technical usage context, and should not penalize coinage
`of hitherto unused and somewhat incongruous word combinations
`whose import would not be grasped without some measure of
`imagination and "mentalpause. ”
`
`Shutts, at 364-65 (emphasis added). No third-party use of a specific term or combination of
`
`terms corroborates an applicant’s contention that its mark is not merely descriptive.
`

`

`Applicant is unaware of any third-party use or legitimate need to use the BIOPET mark
`
`in connection with extruded polyethylene terephthalate resins. A search of the Internet for
`
`plastic manufacturers revealed no use of the BIOPET term in connection with any type of plastic l
`
`resin. Competitors in the plastic manufacturing industry do not use or need to use the term
`
`BIOPET to describe extruded polyethylene terephthalate resins in general. The following list is
`
`a representative sample ofplastic manufactures that offer extruded plastic resins:

`the chart.) These Web sites show there is not even one singe use of the term BIOPET. The
`

`Examining Attorney should note that the terms polyethylene, HDPE, LDPE, and PE are the
`
`common terms used by other extruded plastic manufacturers to describe polyethylene material.
`
`Furthermore, these Web sites demonstrate that there are numerous alternative terms that are used
`
`to describe polyethylene material. For example, Reiss Manufacturing, Inc. uses “High Density
`
`Polyethylene (HDPE)” and “Low Density Polyethylene (LDPE).”
`
`(See, supra, Exhibit 19.)
`
`HPE Extruded Solutions uses “Ultra High Density Polyethylene” and “HDPE.” (See, supra,
`
`Exhibit 20.) Finally, Profile Plastics, Inc. uses “Polyethylene/PE.” (See, supra, Exhibit 25.)
`
`If it is unnecessary for members of the industry to use a term to describe their goods or
`
`services, then it is unlikely that consumers will interpret the term as merely descriptive. As in
`
`Shutts, Applicant should not be penalized by the concept of mere descriptiveness and prevented
`
`from coining BIOPET when there is no current use of the term or a competitive need to use the
`
`term in connection with extruded polyethylene terephthalate resins for use in manufacturing
`
`custom fabricated biodegradable plastic products. Furthermore, as Applicant stated in its Office
`
`Action response, the registration of Applicant’s BIOPET mark will not prevent others from using
`
`the terms B10 and PET individually to describe “biodegradable” matter or “polyethylene.”
`
`CONCLUSION
`
`Applicant ‘s mark BIOPET as applied to Applicant’s goods is not merely descriptive.
`
`Applicant has demonstrated that there is no actual use or need to use its BIOPET mark in
`
`connection with extruded polyethylene terephthalate resins for use in manufacturing custom
`
`fabricated biodegradable plastic products. BIOPET is suggestive and entitled to registration on
`
`the Principal Register. Therefore, Applicant respectfully requests that the Examining Attorney
`
`withdraw the refusal to register Applicant’s mark and issue the Notice of Publication.
