`Afier carefiil consideration ofthe law and facts of the case, the examining attorney must deny the
`request for reconsideration and adhere to the final action as written since no new facts or reasons have
`been presented that are significant and compelling with regard to the point at issue.
`
`Accordingly, applicant’s request for reconsideration is denied. The time for appeal runs from the date
`the final action was issued/mailed. 37 C.F.R. Section 2.64(b); TMEP Section 715.03(c). If applicant
`has already filed a timely notice of appeal, the application will be forwarded to the Trademark Trial and
`Appeal Board (TTAB).

`In further support of the final refusal, the following is added to the record:

`SECTION 2(d) REFUSAL — LIKELIHOOD OF CONFUSION MAINTAINED
`
`Registration of the applied-for mark is refiased because of a likelihood of confusion with the mark in
`U.S. Registration No. 3194667. Trademark Act Section 2(d), 15 U.S.C. §lO52(d); see TMEP §§1207.01
`et seq.
`
`Comparison of the Marks
`
`In a likelihood of confusion determination, the marks are compared for similarities in their appearance,
`

`sound, meaning or connotation and commercial impression. In re E. I. du Pont de Nemours & C0., 476
`F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b). Similarity in any one of
`these elements may be sufficient to find a likelihood of confusion. In re White Swan Ltd., 8 USPQ2d
`1534, 1535 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP
`§l207.01(b).
`
`Applicant has stated that the analysis that was performed in the final action was without legal authority.
`
`It is true that the marks are compared in their entireties under a Trademark Act Section 2(d) analysis.
`See TMEP §1207.0l(b). Nevertheless, one feature of a mark may be recognized as more significant in
`creating a commercial impression. Greater weight is given to that dominant feature in determining
`whether there is a likelihood of confusion. In re Nat '1 Data Corp., 753 F.2d 1056, 224 USPQ 749 (Fed.
`Cir. 1985); Tektronix, Inc. v. Daktronics, Inc., 534 F.2d 915, 189 USPQ 693 (C.C.P.A. 1976); In reJM.
`Originals Inc., 6 USPQ2d 1393 (TTAB 1987); see TMEP §1207.0l(b)(viii), (c)(ii). The last Office
`action specifically stated the reasons for holding the word ZACOL as the dominant wording in the
`registered mark. The wording is dominant visually and in terms of significance. The attached
`registrations showed frequent use of letters at the end of marks in the pharmaceutical industry. As a
`result ofthis frequent use, these registrations tend to show that consumers are accustomed to seeing such
`additional letters and thus, would not likely look as closely to added letters when differentiating the
`source of marks and their respective products.
`
`Comparison of the Goods
`
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood
`of confusion. See Safety-Kleen Corp. v. Dresser Indus, Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480
`(C.C.P.A. 1975); TMEP §1207.0l(a)(i). Rather, they need only be related in some manner, or the
`conditions surrounding their marketing are such that they would be encountered by the same purchasers
`under circumstances that would give rise to the mistaken belief that the goods and/or services come from
`a common source. In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP
`§1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87, 56 USPQ2d
`1471, 1475-76 (Fed. Cir. 2000); In re Martin ‘s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 1566-68,
`223 USPQ 1289, 1290 (Fed. Cir. 1984).
`Applicant has also made repeated references to app1icant’s website as well applicant’s own searches of
`the marketplace; however, please note that an applicant may not restrict the scope of the goods covered
`in a registration by extrinsic argument or evidence. See, e.g., In re Bercut-Vandervoort & Co., 229
`USPQ 763, 764 (TTAB 1986).
`It is also repeated that a determination of whether there is a likelihood of confusion is made solely on the
`basis of the goods and/or services identified in the application and registration, without limitations or
`restrictions that are not reflected therein. In re Dakin ’s Miniatures, Inc., 59 USPQ2d 1593, 1595 ('I'I‘AB
`1999); TMEP §1207.01(a)(iii). Ifthe cited registration describes the goods and/or services broadly and
`there are no limitations as to their nature, type, channels of trade or classes of purchasers, then it is
`presumed that the registration encompasses all goods and/or services of the type described, that they
`move in all normal charmels of trade, and that they are available to all potential customers. In re
`Linkvest SA., 24 USPQ2d 1716, 1716 (TTAB 1992), In re Elbaum, 211 USPQ 639, 640 (TTAB 1981);
`TMEP §1207.01(a)(iii).
`
`It is therefore maintained that it is proper for the examining attorney to assume that applicant’s “anti-
`infectives” may be for use in the respiratory tract.
`In that case, the goods of the parties would be very
`highly related.
`
`Regardless, the examining attorney attaches additional evidence showing that one entity in the
`

`pharmaceutical industry often markets preparations for the respiratory tract as well as for the digestive
`tract under the same mark. Please note that such printouts have been held to have probative value to the
`extent that they serve to suggest that the goods and/or services listed therein are of a kind that may
`emanate from a single source. In re Infinily Broad. Corp., 60 USPQ2d 1214, 1217-18 (TTAB 2001); In
`re Albert Trostel & Sons C0,, 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck A/Iustard Co.,
`6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).
`
`Regarding applicant’s arguments concerning the fact that registrant appears to only sell its products in
`Italy, please note that as a Section 66(a) applicant, it was not required to show use in commerce prior to
`registration. Section 68(a)(3) ofthe Trademark Act, 15 U.S.C. §1l41h(a)(3). However, after
`registration, periodic affidavits of use or excusable nonuse are required to maintain a registered
`extension of protection. Section 71 of the Trademark Act, 15 U.S.C. §1141k. Nevertheless, it is proper
`for the examining attorney to cite a 66(a) registration under Section 2(d). The Trademark Act requires
`that any registered mark be cited against a pending application if the examining attorney determines that
`confusion is likely. The extract from 15 U.S.C. §1052 states the following: “No trademark by which
`the goods of the applicant may be distinguished from the goods of others shall be refused registration on
`the principal register on account of its nature unless it
`(d) Consists of or comprises a mark which so
`resembles a mark registered in the Patent and Trademark Office.” The Trademark Manual of Examining
`Procedure also does not single out 66(a) registrations. It states: “In the ex parte examination of a
`trademark application, a refusal under §2(d) is normally based on the examining attorney’s conclusion
`that the applicant’s mark, as used on or in connection with the specified goods or services, so resembles
`a registered mark as to be likely to cause confiision.” TMEP §1207.01.
`
`Therefore, based on the totality of arguments and evidence presented, the refusal of registration under
`Section 2(d) is maintained and the request for reconsideration is DENIED.
