`Refusal to Register Under Trademark Act Section zgegglg

`The Examining Attorney has continued the refusal to register the mark
`
`CHRONOMETRIC SYSTEM on the ground that the mark is merely descriptive of App1icant’s
`
`goods within the meaning of Section 2(e)(1) of the Trademark Act, as amended. Applicant
`
`respectfully requests reconsideration in view of the foregoing and App1icant’s Amendment and
`
`Response to Office Action filed on November 12, 2004, which is incorporated herewith by
`
`reference.
`
`Arguments
`
`The well-established test for determining whether a term is merely descriptive or whether
`
`it is suggestive and therefore deserving of trademark protection is set forth in Stix Products, Inc.
`

`emphasis added):
`
`A term is suggestive if it requires imagination, thought and
`perception to reach a conclusion as to the nature of the goods. A
`term is descriptive if it forthwith conveys and immediate idea of
`the ingredients, qualities or characteristics of the goods.
`
`Again, Applicant notes that to be regarded as “merely descriptive,” a mark must have no
`
`significance other than a descriptive term in regard to the relevant goods and services. A
`
`suggestive mark, on the other hand, is one which “requires imagination, thought and perception
`
`to reach a conclusion as to the nature of the goods.”
`
`In the Office Action the Examining Attorney has indicted that the wording is merely
`
`descriptive because “[A]pplicant offers a chronometric system that measures the time for release
`
`of chemicals and substances into the body.” This is incorrect. Nothing in the record indicates
`
`that Applicant’s goods actually “measure” time in any way. It seems that the Examining
`
`Attorney has placed particular emphasis on the dictionary definition of “chronometric”, i.e., “of
`
`or relating to a chronometer or chronometry.” Applicant’s goods are not truly “chronometric” as
`
`defined by the dictionary, since they are not used for the measurement of time but rather for the
`
`gradual dispension of chemicals and substances over time. These products do not “measure”
`
`time as indicated by the Examining Attorney, per se, but rather achieve a time-released effect
`
`through the chemical composition of the pill or tablet.
`
`In order to be considered to be
`
`descriptive, it is understood that not all of the definitions of “chronometric” need to be satisfied
`
`as long as one of them describes a feature of a mark. However, as defined by the Examining
`
`Attorney, none of the definitions of “chronometric” directly applies to Applicant’s goods in that
`
`Applicant’s goods do not “measure” time. As such, the mark CHRONOMETRIC SYSTEM
`

`simply does not forthwith convey an immediate idea of the nature of Applicant’s goods.
`
`It is believed that the Examining Attorney has not given sufficient weight to the
`
`suggestive nature of Applicant’s mark as illustrated in the earlier filed Response in that
`
`imagination, thought and perception are required to associate the phrase with Applicant’s goods.
`
`Applicant again notes that it was necessary for the Examining Attorney to go through a series of
`
`metal steps to determine the exact nature of Applicant’s goods. As earlier noted, it is well
`
`established that the exercise of “mature thought” or a “multi-suggestive reasoning process” by a
`
`prospective customer is an indicator of the suggestiveness of the term. In re Tennis in the
`
`Round, Inc. 199 U.S.P.Q. 496, 498 (T.T.A.B. 1978). Furthermore, the combination of the
`
`individual components of Applicant’s mark results in a composite mark that requires a
`
`prospective consumer to use “imagination, thought and perception to reach a conclusion s to the
`
`nature of the [goods].” See 2 J.T. McCarthy, McCarthy on Trademarks & Unfair Competition, §
`
`11.-19 (4” ED. 2000); see also Lisscraft 0fH0lywo0d v. United Plastics Co., F.2d 694, 131
`
`U.S.P.Q. 55 (2d Cir. 1961). Based on this analysis, the wording CHRONOMETRIC SYSTEM
`
`is at most suggestive, rather than descriptive, of Applicant’s goods.
`
`In an analogous case, the mark THE MONEY SERVICES was found suggestive of
`
`financial services pertaining to the transfer of funds from remote locations because although the
`
`mark suggested some form of money service, it did not in any way describe the Applicant’s
`
`actual services. In that case, the Board stated:
`
`[The mark] suggests a number of things, but yet fall short of
`describing Applicant’s services in any one degree of particularity.
`To effect a readily understood connection between the Applicant’s
`mark and its services requires the actual or prospective customer to
`use thought, imagination and perhaps an exercise in extrapolation.
`
`In re TMS Corp. of the Americas, 200 U.S.P.Q. 57, 59 (T.T.A.B.). Similarly, the mark
`

`CHRONOMETRIC SYSTEM does not describe Applicant’s goods with any degree of
`
`particularity even if “chronometric” is perceived as related to the measurement of time.
`
`Accordingly, Applicant again notes that the phrase CHRONOMETRIC SYSTEM is at most
`
`suggestive, and therefore capable of registration. For this reason alone, Applicant’s mark should
`
`not be considered to be descriptive of its goods.
`
`Accordingly, in view of the above and the Response filed on November 12, 2004, the
`
`wording CHRONOMETRIC SYSTEM clearly does not posses any direct descriptive
`
`significance to the purpose, function, characteristic, or feature of Applicant’s goods and the
`
`wording should not be considered to be descriptive of Applicant’s goods.
`
`As earlier noted, in order to be descriptive, the “immediate idea” formed by the mark can
`
`not be a Vague notion but must be conveyed with a “degree of particularity.” In re TMS
`
`Corporation ofthe Americas, 200 U.S.P.Q. 57, 59 (TTAB 1978). The difference between
`
`descriptive and suggestive marks thus depends on the immediacy and directness of the
`
`consumer’s thought process leading from the mark to the particular characteristic of the goods.
`
`The wording CHRONOMETRIC SYSTEM in Applicant’s mark is in no way specific or definite
`
`in that impression to a degree that might describe Applicant’s goods. The use of the wording
`
`CHRONOMETRIC SYSTEM in connection with Applicant’s goods could mean any number of
`
`things and multi-step reasoning is absolutely required to arrive at each one since the initial
`
`concept is itself insufficient.
`
`If a consumer must use multi-stage reasoning to determine the nature of the goods, the
`
`mark is suggestive, not descriptive. Here, it is nearly impossible that one would ever determine
`
`the nature of the goods or a characteristic of them without using such a process in order to get
`
`there.

`As can be seen from the attached printout from www.merrriamwebster.com, the wording
`
`“CHRON” is a combining form meaning “time” (Exhibit A). It is clear from the record that the
`
`Trademark Office believes that marks containing the wording “CHRON” on or in connection
`
`with medication and the like are not descriptive. Applicant includes below an illustrative chart
`
`of a small sampling of various marks featuring the term “CHRON” used in connection with
`
`medication or the like. Also attached are the corresponding" registration and application records
`

`Each of the foregoing registrations and approved applications are similar in composition

`to Applicant’s mark, i.e., composed of “CHRON” in connection with other wording and are used

`in connection with goods in connection with medications and the like. Although the past
`
`practice of prior Examining Attorneys is not binding on the examination of the subject
`
`application, the record is clear that Examining Attorneys and prospective consumers do not find
`
`the wording “CHRON“ to be descriptive when used in connection with medications and the like.
`
`Therefore, just as the wording was not found to the descriptive of medications and the like in the
`
`related previously registered and approved marks the wording should not be considered to be
`
`descriptive of the goods in the present application.
`
`Conclusion
`
`Applicant has shown that the mark CHRONOMETRIC SYSTEM is not descriptive of
`
`Applicant’s goods, is at most suggestive. Accordingly, Applicant respectfully requests that the
`
`refusal to register under Section 2(e)(1) be withdrawn.
