`Dear Mr. Harris:

`I write on behalf of respondents the States of California, Maine, Maryland, and
`Minnesota in the above-captioned matter. Petitioners filed a petition for certiorari before
`judgment on November 5, 2018. The Ninth Circuit issued its decision on November 8, and
`petitioners filed a supplemental brief addressing that decision on November 19, followed by a
`corrected supplemental brief on November 27. They have suggested that the Court now treat
`their petition as an ordinary one seeking review after judgment. The States have no objection to
`that proposal.
`
`Responses to the petition originally filed and docketed on November 5 are currently due
`on December 5. We have been notified that at least three amicus briefs supporting the petition
`will be filed by that date. Under the circumstances, the state respondents respectfully request
`that the time for filing a response to the petition be extended by twelve days, to and including
`December 17, 2018. The extension is necessary so that the response can take due account of the
`intervening developments and filings, to allow for coordination among the respondents in the
`five related cases addressed by the decision below, to permit appropriate internal review and
`approval by the state respondents, and because of a heavy press of other business.

`authorized to inform the Court that all respondents in No. 18-587 join in this request. Counsel
`for petitioners have indicated that they do not oppose this request.
