`On November 5, 2018, the government filed a petition for a writ of certiorari before
`
`judgment in each of the above-captioned cases. On November 19, the government filed a
`supplemental brief in United States Department of Homeland Security v. Regents of the University
`of California, No. 18-587, to bring to the Court’s attention the opinion of the Ninth Circuit issued
`in that case after the filing of the government’s petition. In discussing the impact of the Ninth
`Circuit’s decision on the pending petition in Nielsen v. Batalla Vidal, No. 18-589, the government
`mistakenly stated that respondents in Batalla Vidal had cross-appealed to the Second Circuit the
`district court’s order granting in part and denying in part the government’s motion to dismiss in
`that case. The government has filed today a revised supplemental brief, correcting the
`misstatement and revising the discussion of the pending petition in Batalla Vidal accordingly. The
`government also has made other minor revisions to bring the brief into compliance with the word
`limit in Rule 33.1(g)(iv). I would appreciate it if you would substitute the corrected brief for the
`supplemental brief filed on November 19 before you distribute the petition to the Members of the
`Court.
