As discussed during the 1/19/2022 oral argument, the Court reviewed in camera four emails to determine whether Plaintiff waived attorney-client privilege, as Defendant argues in its 55 motion to compel. The Court determines that these documents are privileged. Further, based on the content of the documents, and Defendant's arguments regarding waiver, the Court does not find that Plaintiff waived attorney-client privilege as to these documents. ORDER. The Court has received emailed summaries from counsel regarding several discovery disputes. In light of the nature of the disputes, the Court will resolve the disputes after receiving relevant briefing. Thus, the parties shall file any motions to compel by 1/12/2022; responses shall be filed by 1/17/2022. Briefs shall be no more than 10 pages. The parties should include a proposed order with their motions/responses, because, if appropriate, the Court will resolve the disputes by entering one of the competing proposed orders. Further, consistent with the Court's Practices & Procedures, the parties shall include support for attorneys' fees and costs related to the present discovery disputes as part of their motions. The Court will hear argument on the discovery disputes, as well as the parties' request for a discovery extension, at the currently scheduled discovery conference on 1/19/2022 at 3:00 p.m. IT IS FURTHER ORDERED that the discovery conference set for 1/19/2022 at 3:00 p.m. is hereby converted to a videoconference.
