`Title: On Demand Function Beverage Dispenser
`
`PGR2023-XXXX
`
`DECLARATION OF MATT CREMINS
`
`

`

`I, Matt Cremins, hereby declare as follows:
`
`1.
`
`I am above the age of 18 and have personal knowledge of the facts
`
`contained in the declaration.
`
`2.
`
`I am currently the co-founder of CivilTalk, a civic engagement
`
`service.
`
`3.
`
`Before founding CivilTalk, I founded Voda, a beverage dispensing
`
`company.
`
`4.
`
`Voda developed the SmartWell Beverage Dispenser which included a
`
`touchscreen interface, allowed users the option of selecting pure or sparkling water,
`
`and enabled users to customize their drink with any combination of flavors,
`
`electrolytes, and vitamins.
`
`5.
`
`I started developing the SmartWell dispenser in 2012 while I was a
`
`student at the University of Connecticut. The first SmartWell dispenser was sold
`
`by Voda in 2016.
`
`6.
`
`In 2018, Voda was acquired by Elkay Manufacturing (“Elkay”). After
`
`the acquisition, I joined Elkay to lead the SmartWell sales team.
`
`7.
`
`After
`
`the acquisition,
`
`the SmartWell Beverage Dispenser was
`
`available for purchase by distributors and end-users from Elkay. The SmartWell
`
`Beverage Dispenser was installed in various offices, healthcare, and hospitality
`
`1
`
`

`

`facilities and publicly accessible for users to interact with and use. The first
`
`SmartWell beverage dispenser sold by Elkay was in 2019.
`
`8.
`
`The SmartWell Beverage Dispenser allows users to select a flavor and
`
`enhancement, such as caffeine, vitamin C, and electrolytes.
`
`9.
`
`The video titled “Feature and Benefits of Elkay SmartWell IOT
`
`Beverage Dispenser” (available at https://vimeo.com/384394240) accurately
`
`describes the SmartWell Beverage Dispensers that were sold by Elkay prior to
`
`March 2021.
`
`10.
`
`The video titled “Feature and Benefits of Elkay SmartWell Beverage
`
`Dispensers” (available at https://vimeo.com/332051430) accurately describes the
`
`SmartWell Beverage Dispensers that were sold by Elkay prior to March 2021.
`
`11.
`
`The SmartWell User Manual
`
`(attached as Exhibit 1007) was
`
`distributed to customers of the SmartWell Beverage Dispensers and accurately
`
`describes the SmartWell Beverage Dispensers that were sold by Elkay prior to
`
`March 2021.
`
`12.
`
`The SmartWell Troubleshooting Guide (attached as Exhibit 1008) was
`
`distributed to customers of the SmartWell Beverage Dispensers and accurately
`
`describes the SmartWell Beverage Dispensers that were sold by Elkay prior to
`
`March 2021.
`
`2
`
`

`

`13.
`
`The SmartWell Custom Beverage Guide (attached as Exhibit 1009)
`
`accurately describes the SmartWell Beverage Dispensers that were sold by Elkay
`
`prior to March 2021.
`
`I declare under penalty of perjury under the laws of Connecticut that the
`
`foregoing is true and correct.

`2.2 Safety Alert Symbol and Signal Words
`The safety alert symbol is used to alert you to
`potential hazards. The hazards are identified
`with this safety alert symbol along with a signal
`word such as "WARNING" or "CAUTION".
`Signal words help focus your attention on potential
`hazards. The signal words used in this manual
`are WARNING, CAUTION, NOTICE, SAFETY
`INSTRUCTION, and Note. The safety messages must
`be followed to prevent personal injury or death as well as
`prevent product damage.
`
`2.3 Safety Signal Words
`WARNING Indicates a potentially
`A
`hazardous situation which,
`if not avoided, could result in death or serious injury.
`CAUTION Indicates a potentially
`A
`hazardous situation
`which, if not avoided, may result in minor or
`moderate injury.
`Indicates that equipment or
`NOTICE
`property damage can result if
`instructions are not followed.
`Safety instructions (or
`SAFETY
`INSTRUCTIONS
`equivalent) signs indicate
`specific safety-related instructions or procedures.
`
`2.1 General
`The Elkay Manufacturing Company (Elkay) cannot
`anticipate every possible circumstance that might involve
`a potential hazard during the use or maintenance of this
`product. The warnings and instructions in this manual
`are, therefore, not all-inclusive. If a tool, procedure, or
`work method that is not specifically recommended by
`Elkay is used, you must be satisfied that it is safe for
`yourself and others. You should also make sure that the
`product will not be damaged by the methods you choose.
`
`Most work-related accidents are caused by failure to
`observe basic safety rules or precautions. An accident
`can often be avoided by recognizing potentially
`hazardous situations before an accident occurs. As you
`install, use, or maintain this product, you must be alert to
`potential hazards. You should also have the necessary
`training, skills, and tools to perform any installation or
`maintenance procedure.

`

`

`2.4 Personal Safety
`WARNING These warnings indicate a
`A
`potentially hazardous
`situation which, if not avoided, could result in serious
`injury or death. Follow all instructions related to the
`use and care this product (unit).
`Personal Protection
`Be sure to use all personal protective
`equipment, such as safety glasses and
`protective gloves, whenever necessary, to ensure
`your own safety.
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`To avoid eye injury, always wear protective
`glasses with side shields when working
`near CO2 tanks and lines. Also, make sure
`no one else can be injured by escaping CO2 gas
`should a hose or fitting break.
`Shock and Electrocution Hazards
`Contact with live electricity can cause serious
`bodily injury and in some cases, death.
`
`4,
`e
`A
`
`Do not touch any electrical device with wet hands
`or allow water to come into contact with electrical
`devices. Water will conduct electric current to
`create a short circuit, resulting in injury or death.
`DO NOT create a short circuit between a
`source of electricity and a liquid by being in
`contact with both simultaneously.
`
`Pressurized Vessel Hazards
`As with personal protections follow all of the
`safety recommendations from the supplier of
`the CO2 tank such as but not limited to:
`
`
`
`A carbon dioxide cylinder is a pressure
`vessel and therefore has explosive
`capabilities.
`Due to the possibility of an explosion
`which could result in personal injury or
`property damage, never allow carbon
`dioxide cylinder and its contents to reach a
`temperature exceeding 115° F.
`
`If a CO2 gas leak is suspected, particularly
`in a small area, immediately ventilate the
`contaminated area before attempting to
`repair the leak. People exposed to a high
`concentration of CO2 gas will experience tremors
`which are followed rapidly by loss of
`consciousness and suffocation.
`
`Do not drop a CO2 cylinder or strike
`it a foreign object. Protect cylinders
`from damage. Use a suitable hand
`truck to move cylinders; do not drag, roll, slide,
`or drop.
`
`
`
`Both filled and empty cylinders should be
`ru
`stored indoors in a cool, dry, ventilated
`location away from any source of heat.
`Chain or secure the cylinders in an upright
`position when in use or storage. Store full and
`empty cylinders separately.
`
`
`
`0
`
`Never lay the cylinders on its side. Liquid
`CO2 entering the gas regulator may cause
`problems (rupture the tank or gas line) due
`to rapid expansion of the liquid CO2. The gas
`regulator could freeze up, preventing the
`regulator from shutting down, allowing CO2 to
`continue to flow from the cylinder.
`
`Gas cylinders must only be transported on an
`open back utility truck that is separate from the
`main body of the vehicle. Do not transport CO2
`tanks in the passenger compartment of a vehicle.
`
`CAUTION These cautions indicate a
`A
`potentially hazardous
`situation which, if not avoided, may result in minor or
`moderate injury. Follow all instructions related to
`installation and/or maintenance of this product.
`Personal Protection from CO2 Gas
`Follow all safety recommendations from supplier
`of the CO2 tank, such as but not limited to:
`Indirect eye contact with CO2 gas may
`cause mild irritation. Direct eye contact
`with the liquefied gas can freeze the eye
`causing permanent eye damage or blindness.
`CO2 gas (carbon dioxide) displaces oxygen.
`Make sure there are no CO2 gas leaks in
`any part of the Smartwell beverage system.
`
`
`
`
`
`
`
`0 ,
`
`
`
`
`
`
`
`
`
`
`
`
`
`Direct contact with the liquefied gas can
`chill or freeze the skin (frostbite).
`
`Lifting Hazard
`Use two people to move the unit. The
`Smartwell unit can weigh up to 200 lbs.
`Tripping Hazard
`
`Personal injury can result from tripping over
`power cords, tools, or other installation items.
`DO NOT leave items lying around the work area.
`Use Proper Tools
`
`Always use proper tools which are in good
`working condition during the installation of the
`product.

`
`4.1 Replacing a Pouch
`The unit is factory preset for the location of the startup.
`
`Note: A small amount of citric acid is injected into each
`drink. This citric acid acts as a fl avor enhancer, so

`pouches have expiration
`dates. The pouches are clearly marked with date
`codes and should be checked before placing
`pouches into the beverage dispenser. Using outdated
`pouches (food products) could cause some people to
`become sick.
`
`Daily status reports summarizing all low and empty
`consumables are sent to customers via email.
`Notifi cation settings and users can be managed through
`the Smartwell customer portal.
`
`The pouches should be stored in a cool, dark, dry place
`between 60° and 85°F (15° and 30°C).
`
`Each pouch comes with the pump and the fl avor
`dispenser nib connected to it.
`
`1. Unlock and open the hood of the unit.
`
`2. Locate the pouch or pouches that need to be replaced.
`
`3. Remove the pouch.
