`To the Honorable Board:
`
`On April 16, 2020, in accordance with the schedule set forth in the Revised Scheduling Order
`(Paper No. 38), Patent Owner filed a Reply to Petitioner’s Opposition to Patent Owner’s Revised
`Motion to Amend (Paper No. 43; “Patent Owner’s Reply”). As admitted in the Certificate of
`Compliance attached thereto, however, Patent Owner’s Reply “contains 20 pages and 3,321
`words, per computer generated information” (emphasis added). Patent Owner’s Reply thus did
`not comply with the twelve (12) page limit set forth in 37 C.F.R. § 42.24(c)(3) for replies to
`oppositions to motions to amend.
`
`Counsel for Petitioner therefore contacted counsel for Patent Owner and requested that Patent
`Owner withdraw Patent Owner’s Reply for non‐compliance with 37 C.F.R. § 42.24(c)(3). Patent
`Owner subsequently filed Patent Owner's Withdrawal of Patent Owner's Reply to Petitioner's
`Opposition to Patent Owner's Revised Motion to Amend of 16 April 2020 (Paper No. 45) on April
`27, 2020. Patent Owner, however, also filed Patent Owner's Amended Reply to Petitioner's
`Opposition to Patent Owner's Revised Motion to Amend (Paper No. 44; “Patent Owner’s
`Amended Reply”).
`
`Patent Owner did not request authorization from the Board to extend Due Date RMTA2, nor did
`it try to seek an agreement with Petitioner to stipulate to a new date for Due Date RMTA2 as
`shown in the attached email chain. Patent Owner’s filing of Patent Owner’s Amended Reply
`was therefore untimely. Moreover, in view of the fact that Petitioner now has less than half the
`time that it should have had to prepare and file its Sur‐Reply (Due Date 7) – a date which cannot
`be extended – Petitioner has been substantially prejudiced by Patent Owner’s late filing of
`Patent Owner’s Amended Reply.
`
`Significantly, at the outset of these proceedings, the Board expressly cautioned Patent Owner
`about failures to comply with the Board’s deadlines following its late filing of Patent Owner’s
`Corrected Preliminary Response (Paper No. 9):
`
`“We caution Patent Owner that the Board expects compliance with all deadlines. Any further
`late filings or lack of diligence to ministerial tasks on the part of Patent Owner will not be
`tolerated, and Patent Owner is on notice that any further failings in this regard will most likely
`result in the Board declining to consider such non‐compliant papers.”
`
`See Order – Conduct of the Proceeding dated July 17, 2019 (Paper No. 14). Accordingly,
`Petitioner requests authorization to file a Motion to Strike Patent Owner’s Amended Reply as
`untimely and therefore highly prejudicial to Petitioner’s ability to timely prepare a Sur‐Reply by
`Due Date 7.
