`I, Sam Kinon, hereby declare and state that:
`
`I am an account manager in printing sales for Sheriar Press in Myrtle Beach,
`
`South Carolina. I have held this position since 1989. I have worked on the AVX
`
`account since the early 1990s. I am familiar with the AVX product catalog entitled
`
`“AVX Surface Mount Ceramic Capacitor Produces” (referenced as Exhibit 1008 in
`
`the present Post Grant Review proceeding and in the present declaration).
`
`My understanding is that Exhibit 1008 was printed in March of 2008 by
`
`Sheriar Press. This understanding is informed by the publishing code “S-
`
`lVl1.CC7.5M308-C” located on the last page of Exhibit 1008. The publishing codes
`
`used on the back of the AVX catalogs were generated by AVX and Sheriar Press to
`
`differentiate between each AVX publication. This code was used by AVX to
`
`identify each individual publication among the hundreds designed, laid out, and
`
`printed by She-riar Press for AVX. Distributors, sales representatives, and
`
`marketers used this code to order the individual publications from the warehouse
`
`for distribution to customers. This code allowed easy access and reference to the
`
`publications. The code described the printer, name of the article, the number of
`
`copies printed, and the month and year printed. The code also identified whether
`
`the article was new, a reprint, or if there were changes made to the article.
`
`The publishing code “S-IVlLCC7.5M308-C” can be deciphered as follows:
`
`S- — Sheriar Press
`
`M — Multi
`
`L — Layer
`
`C - Ceramic
`

`7.5M — 7500 copies printed

`3 — March
`
`08 — 2008
`
`C — Changes.
`
`Accordingly, the publishing code indicates that 7500 copies of Exhibit 1008
`
`were printed in March of 2008 by Sheriar Press. Furthermore, the “C” at the end
`
`of the publishing code indicates that this print included a change from a prior
`
`printing.
`
`It is my understanding that after printing of Exhibit 1008, 7500 copies of
`
`Exhibit 1008 were provided to AVX. The code identifies that the printing was
`
`delivered to AVX in March of 2008 or shortly thereafter. It is the practice of
`
`Sheriar Press to deliver prints to clients including AVX as soon as possible after
`
`the printing. As such, Exhibit 1008 would have been delivered to AVX in March
`
`of 2008 or shortly thereafter.
`
`I hereby declare that all statements made herein of my own knowledge are
`
`true and that all statements made on information and belief are believed to be true;
`
`and further that these statements were made with the knowledge that willful false
`
`statements and the like so made are punishable by fine or imprisonment, or both,
`
`under Section 1001 of Title 18 of the United States Code, and that such Willfill
`
`false statements may jeopardize the validity of the application or any patent issued
`
`thereon.
