`I, Martin Palmer, hereby declare:

`1. My name is Martin Palmer. I am an employee of STRAND Lighting
`
`LLC (Subsidiary of Signify Holdings). I am over the age of eighteen and otherwise
`
`competent to make this declaration. I have personal knowledge of the facts herein,
`
`and, if called as a witness, can competently testify to these facts.
`

`I am the Vari-Lite and Strand Luminaires Product Manager at Signify.
`
`I have been employed in this role since April 2013. I was first hired in this role by
`
`Royal Philips Lighting, but the employer I work for has changed several times, due
`
`to various acquisitions of the group I work for.
`

`As further background, Vari-Lite Inc. was incorporated in the 1980s
`
`and was one of the first companies to manufacture moving lights for entertainment
`
`lighting effects. Around 2002, the Vari-Lite luminaire manufacturing and sales
`
`divisions were sold to Genlyte Group. Separately, Strand was formed in 1914 in
`
`London, United Kingdom, and was acquired by various companies over the years,
`
`before Genlyte Group also acquired Strand on or around July 11, 2006. Genlyte
`
`Group was thereafter acquired by Royal Philips Lighting around 2008. The
`
`lighting division of Royal Philips Lighting was spun off around 2016. ln 2018,
`
`Royal Philips Lighting renamed as Signify. "Vari-Lite" and "Strand Lighting" and
`
`their legacy product ranges of Showline and Selecon lwninaires are now run as
`
`independent brands within the Signify parent group.

`Through my role as Product Manager, I have personal knowledge
`
`about the Vari-Lite and Strand Lighting luminaires and their documentation,
`
`including (a) past and current production lighting products, including the Showline
`
`SL PAR 155 ZOOM RGBW LED Luminaire (the "SL PAR 155") and (b) the
`
`preparation and provision of user documentation, both in physical paper and digital
`
`or online formats, including to customers who purchase such products. In
`
`particular, I have personal knowledge regarding the SL PAR 155 "QuickStart
`
`Guide" bearing a date of23 October 2013, attached as Exhibit A (the "SL PAR
`
`155 Quick Start Guide"), and the SL PAR 155 "Installation and User's Manual"
`
`bearing a date of 10 December 2013, attached as Exhibit B (the "SL PAR 155
`
`Manual").

`Vari-Lite's documentation, like the SL PAR 155 Quick Start Guide
`
`and SL PAR 155 Manual, are written by a technical writer for the Vari-Lite and
`
`Strand brands, based on technical specification data provided by the engineering
`
`group and product manager. They then go through a rigorous checking procedure
`
`from the technical support team and are ultimately approved by me, in my role as
`
`Product Manager. I was personally involved in the preparation, and provisioning to
`
`customers and others, of the SL PAR 155 Quick Start Guide and SL PAR 155
`
`Manual. This includes the final approval on the documentation and the release of
`
`the documentation in the Quick Start Guide, included in the box with SL PAR 155
`

`luminaires shipped to a purchaser or distributor. The same documentation is also
`
`released via our marketing, communication, and digital services team, including
`
`publishing of the full user manual to our website.

`As mentioned, Vari-Lite includes a "Quick Start Guide" in the box of
`
`the products it sells. The Quick Start Guide contains safety instructions and basic
`
`usage and specifications. It also includes an Internet link and a QR code that leads
`
`to a Philips Showline webpage, where the full User's Manual, like the SL PAR 155
`
`Manual, can be viewed, printed, and downloaded. See Exhibit A at 2. Information
`
`describing the full operation and features of products, including the SL PAR 155,
`
`is only provided in the full User's Manual (not the Quick Start Guide), with the
`
`User Manual being readily accessible on the website and clear guidance provided
`
`in the Quick Start Guide for users to download such User Manual. For
`
`environmental reasons, however, Vari-Lite does not print and include a physical
`
`copy of the full User's Manual in the box of each product.
`

`The SL PAR 155 was an update on a prior product, the SL PAR 150.
`
`The SL PAR 155 is a professional-grade lighting Juminaire providing users with
`
`the ability to generate many lighting patterns and effects, and is often used in
`
`entertainment lighting and to provide special lighting effects in video and studio
`
`filming environments. Vari-Lite began transitioning from the SL PAR 150 and
`
`selling the SL PAR 155 to U.S. customers around late 2013, through distributors.

`At that time, Vari-Lite sold the SL PAR 155 in the U.S. through multiple
`
`distributors, including the following companies: Barbizon lighting, 4Wall, B&H
`
`Photo, Production Resources Group, The Lighting design group, Century Lighting
`
`Services, Batts AV, Bulbtronics and Clair Solutions. Sales on the SL PAR 155
`
`started immediately after launch, as it was a transition from the SL PAR 150
`
`already on the market as a direct replacement product. The first sales of the SL
`
`PAR 15 5 were in December 2013 to dealers, and these dealers started shipping to
`
`end user customers in January 2014, with more than 1,800 SL PAR 155 units being
`
`sold within the United States from its launch around October of 2013 through the
`
`end of 2014. Around an additional 900 SL PAR 155 units were sold globally in
`
`this time period. To date, more than 10,000 SL PAR155 luminaires have been sold
`
`globally, and it can be found in all most countries around the world where Vari(cid:173)
`
`Lite is represented.
`

`The SL PAR 155 product ships with a "Quick Start Guide" to ensure
`
`that users can operate the luminaire via its correct DMX control map structure, and
`
`this SL PAR 15 5 Quick Start Guide directs users to download the full SL PAR 15 5
`
`User Manual from the product website page. The SL PAR 155 User Manual
`
`includes not only important safety and care information, but also includes the full
`
`DMX data structure map and its specific functions required to control the
`
`luminaire from any lighting control console. The full SL PAR 155 User Manual
`

`further provides details regarding function and control of the SL PAR 155
`
`luminaire through the Display and Menu System having an interface for user input
`
`on the back of the SL PAR 155 product.

`The SL PAR 155 Quick Start Guide bears a publication date of23
`
`October 2013, and the SL PAR 15 5 Manual bears a publication date of 10
`
`December 2013. Based on my personal knowledge, the SL PAR 155 Quick Start
`
`Guide (attached as Exhibit A) and the SL PAR 155 Manual (attached as Exhibit B)
`
`are true and correct copies of what Vari-Lite has distributed to distributors,
`
`retailers, and customers in the United States from 2013.
`
`10. The attached SL PAR 155 Quick Start Guide (Exhibit A) was
`
`included in the boxes of SL PAR 15 5s sold, directly or indirectly, from Vari-Lite
`
`to distributors, retailers, and end-user customers since around late 2013. As
`
`mentioned above, from late 2013 until the end of 2014, around 1,800 SL PAR units
`
`were sold to in the United States to over 300 customers, and each of these
`
`customers received a copy of this Quick Start Guide with the purchase of their SL
`
`PAR 155. These same customers were also provided with a copy of the SL PAR
`
`155 Manual (Exhibit B) through the link and QR code on page 2 of the SL PAR
`
`155 Quick Start Guide. Providing our customers with easy access to the full SL
`
`PAR 155 Manual in this way was important; this enabled our customers to get
`

`information required for the operation of the SL PAR 15 5, which was not included
`
`in the SL PAR 15 5 Quick Start Guide itself.
`
`11. Since late 2013, persons interested in the SL PAR 155, including
`
`customers and other interested parties, could also obtain information about the SL
`
`PAR 155 and copies of the SL PAR 155 Manual from our website. In 2013, this
`
`website was www.philips.com/showline. Such can be seen on page two of the SL
`
`PAR 155 Manual. This same manual still remains available
`
`via www.philips.com/showline, which now redirects to our current website
`
`at www.vari-lite.com. Beginning in 2019, as part of the restructuring of the four
`
`product Philips lines-Vari-Lite, Strand Lighting, Selecon & Showline-into two
`
`brands, the legacy Showline and Selecon websites are redirected to the Vari-Lite
`
`and Strand website pages.
`
`12. Vari-Lite posted the attached SL PAR 155 Manual to its website for
`
`customers and the public in general to view, access, and download in late 2013,
`
`after the product was launched ( as noted above). Our website in 2013 ( and still
`
`now) has a section titled "Products," which includes the SL PAR 155. The SL PAR
`
`155 product page then (and now) has various sub-sections, including product
`
`descriptions, features, related product information, and datasheets, along with a
`
`section titled "Downloads." The "Downloads" section in tum has links to various
`
`documentation on the SL PAR 155, including the SL PAR 155 Manual (labeled
`

`"User Manual"). This web page, and the downloadable version of the SL PAR 155

`User Manual thereon, were available to the public following the release of the

`The SL PAR 155 ZOOM RGBW LED Lwninaire operates on AC input voltages from JOO 10240 VAC.

`WARNING: This unit does not contain an ON/OPF switch. Always disconnect power input cable to completely remove power from unit when not in use.

`AC Power Operation
`When connected to an AC source, the unit operates on I 00 to 240 volts AC (+/- I 0%, auto-ranging). The lurninaire contains an auto-ranging power supply.
`Each luminaire can draw up to I 50 Watts.

`Connecting Power
`Units can be powered in one of two ways:
`Dire~-t connection to a AC power source using an AC input cable. For wiring of AC input connector, refer to Connecting a SL PAR I 55 ZOOM
`RGBW LED Luminaire to AC Power.
`Connection from the AC output of another SL PAR 155 ZOOM RGBW LED Luminaire. When using this method, it is very important not to connect any
`other type of equipment
`
`WARNING: Only connect other SL PAR 155 ZOOM RGBW LED Luminaires to the AC Output (Tbru) connector of a SL PAR 155 ZOOM RGBW LED
`Luminaire.
`
`Connecting a SL PAR 155 ZOOM RGBW LED Luminaire to AC Power
`Table 1-2, AC lnpul Connections describes how to connect power to your SL PAR 155 ZOOMRGBW LED Luminaire. Field wiring of the SL PAR 155
`ZOOM RGBW LED Luminaire is straight forward. A total of3 wires/conductors is supplied to the unit.

`Connecting to the DMX Network
`Basic DMX512 installation consists of connecting multiple SL PAR 155 ZOOM RGBW
`LED Luminaires together (up to 32 luminaircs) in "daisy-chain' fashion. A cable runs
`from the control console (or DMX512 control source) to the OMX connector on the fits!
`SL PAR 155 ZOOM RGBW LED Luminairc. Another cable nms from the other DMX
`connector on the first unit to a OMX connector on the next SL PAR 155 ZOOM RGBW
`LED Luminaire (or OM.XS 12 device to be controlled).

`Mounting Luminaire
`The SL PAR 155 ZOOM RGBW LED Luminaire is provided with the ability to hang via truss books, clamps, etc. (sold separately). Simply attach hook,
`clamp, etc. to theSJ. PAR 155 ZOOM RGBW LED Luminaire yoke assembly in the provided M L2 holes. It is recommended (and may be required by local
`and national safety codes) to use and install a safety cable (sold separately). When hanging the fixture, be sore to leave enough space around the luminaire to
`allow proper, uninterrupted airflow for cooling.
`
`SAFETY CABLE: Is sold separately and
`recommended for all hanging installation and may
`be required by national and local codes. Use
`safety cable anchor points for safety cable
`attachment for this fixture.

`Floor Mounting
`The SL PAR 155 ZOOM RGBW LED Luminaire is designed to sit
`directly on its yoke assembly in a floor installation application. When
`used in this type of application, using the provided 5 mm Allen wrench.
`loosen the locking alien-head screw securing the inner portion of the yoke
`assembly and pivot out (as shown below). Retighten the alien-head screw
`to secure in place. Be sure to leave enough space around the luminaire to
`allow proper. UJJintem:tpted airflow for cooling.

`The SL PAR 155 ZOOM RGBW LED Luminaire has a user-adjustable, manual zoom. The zoom is easily changed by loosening both the zoom adjustment
`knobs on each side of the luminaire head and sljding the zoom mechanism backwards or forwards as desired. Once desired zoom is set, simply hand-tighten
`the two zoom knobs. Do not over lighien or tighien with a tool!

`Note: The zoom range for this lwninaire is 15 to 70 degrees. The movement oflhe zoom mechanism is a very shon travel disiance. The narrow output is

`The SL PAR 155 ZOOM RGBW LED Luminaire's LCD Display and Menu System provides local control for accessing the following fixture's settings:

`Toe LCD Display Menu system consists of several categories. Use the Menu Bunons to access and make changes to the menu items. When the desired menu
`item is reached, press the desired Menu Bu11nn to display the menu options and lo navigate and configure the menu options as required.
`To navigate and access menu settings/selections:

`The SL PAR 155 ZOOM RGBW LED Luminairc offers two S-bit OMX control modes. Below is a summary of each mode:
`Enhanced 8-Bil Mode: Table 1-4 provides DMX channel mapping of all DMX512 control values when the SL PAR 155 ZOOM RGBW LED
`Lwninaire is in Enhanced 8-bil DMX512 Mode (as set by the lumirutires menu ~-yslt.m).
`Slmple8-Bit Mode: Table 1-5 on page 9 provides DMX channel mapping of all DMX512 conbnl values when the SL PAR 155 ZOOM RGBW LED
`Lum.inaire is in Simple 8-Bh DMX511 Mode (as set by the lwninairc's menu system).
