`INTRODUCTION
`Nike, Inc. (“Petitioner”) respectfully requests inter partes review (“IPR”) and
`
`cancellation of claims 1, 2, 4, and 7 (“Challenged Claims”) of U.S. Patent No.
`
`9,289,016 (the “’016”) (NIKE-1009).
`
`The ’016 claims a bra with pockets on the chest strap. This is not novel: bras
`
`and pockets have been known for centuries. For example, a bra excavated from a
`
`castle in Austria was estimated to date back to the late 14th to second half of the 15th
`
`century:

`Pockets and their use in clothing have similarly been long understood.

`Pockets on pants, shirts, jackets, and other clothing have been a universal feature of

`fashion for over a century. See NIKE-1035 at 148; NIKE-1001 ¶109. This includes
`
`the combination of bras with pockets: for decades, companies and individuals
`
`worldwide have designed and created bras with pockets so that women may
`
`conveniently carry items. NIKE-1001 ¶110. Indeed, patents have disclosed pockets
`
`on bras for more than 50 years, decades before the ’016. NIKE-1027; NIKE-1022;
`
`NIKE-1021; see also generally NIKE-1019 (prior art bra with pockets on the breast
`
`cups); NIKE-1020 (same); NIKE-1025 (same); NIKE-1023 (same); NIKE-1030
`
`(prior art bra with pockets on the cups and chest strap); NIKE-1024 (prior art bra
`
`with pockets on the cups for holding a cell phone). Indeed, even the named inventor
`
`agreed that bras with pockets were “pretty obvious” at the time of her alleged
`
`invention. NIKE-1036.

`For example, Vidai, filed in 1985, almost 30 years prior to the ’016, discloses

`SUMMARY OF THE ’016 PATENT
`A. Overview of U.S. Patent No. 9,289,016
`The ’016 Patent issued on March 22, 2016, from U.S. Application No.
`
`14/614,873, a continuation-in-part application filed on February 5, 2015. NIKE-
`
`1009 at Cover. The ’016 purports to be a continuation-in-part of U.S. Patent No.
`
`9,295,288 (the “’288”), which purports to be a continuation-in-part of U.S. Patent
`
`No. 8,597,072 (“the ’072”). The ’288 resulted from Application No. 14/082,777,
`
`filed November 18, 2013, and the ’072 resulted from Application No. 13/066,822,
`
`filed April 26, 2011. See NIKE-1003; NIKE-1050. The purported advantage of the
`
`claimed invention is “removably receiving a handheld electronic device while
`
`providing support and shape to the breasts of a wearer, the receiving and supporting
`
`
`

`and shaping being done in a safe, convenient and economical manner.” Id. at 1:8-
`
`11. Consistent with known bra design, the claimed bra is comprised of “left and
`
`right cups” adhered to the wearer via “a chest strap and shoulder straps.”
`

`
`NIKE-1009 at Fig. 9. While the ’016 as originally filed claimed pockets “operatively
`
`associated with each cup,” i.e., pockets 204 in Figure 9, those claims were rejected
`
`as anticipated by the prior art. See NIKE-1010 at 110–11 (May 22, 2015 Non-Final
`
`Rejection). The applicant amended the claims in response to that rejection to instead
`
`claim pockets on “each side of the chest strap adjacent to each of the [breast cups],”
`
`where “each side pocket extends onto the adjacent cup.” NIKE-1010 at 129–33
`
`(Aug. 24, 2015 Amendment in Response to Non-Final Rejection); see also NIKE-
`
`1009 at Cl. 1. In addition to amending the claims, the applicant added new language
`
`

`to the specification similar to the new claim language, and two additional figures
`
`illustrating this new language:

`NIKE-1009 at Figs. 14–15, at 5:57 –61 (“In still a further embodiment, side pocket
`
`268 may further extend at least partially into, over, or beneath the cup such that the
`
`pocket, and potentially the upper opening 278 span both part of the chest strap and
`
`part of the cup.”). The apparent reason for allowance of the ’016 is the inclusion of
`
`pockets on the side of a bra’s chest strap that “extend onto” the cups.
`
`The ’016 has 7 claims total. Only four of those claims—independent Claim
`
`1, and dependent Claims 2, 4, and 7—are challenged here. Vidai, Pintor, and
`
`Handras are all directed toward storing personal items in a bra pocket, and render
`
`the Challenged Claims obvious.

`Effective Priority Date of the Challenged Claims
`B.
`Patent Owner (“PO”) admits that November 18, 2013 is the earliest priority
`
`date to which the ’016’s challenged claims are entitled.3 See NIKE-1049; Nat.
`
`Alternatives Int'l, Inc. v. Iancu, 904 F.3d 1375, 1383 (Fed. Cir. 2018) (explaining
`
`that priority is assessed on a claim-by-claim basis for continuation-in-part
`
`applications, and that claims reciting new matter are not entitled to the parent
`
`application’s earlier filing date). The claims of the ’016 require “a side patch on one
`
`of an inside or outside surface of each side of the chest strap adjacent to each of the
`
`left cup and right cup.” NIKE-1009 at Cl. 1. The earliest purported disclosure of
`
`this is in the ’288, not the grandparent ’072. See NIKE-1003 at 5:9–11, Cl. 5, Figs.
`
`11–12; NIKE-1050. Indeed, the applicant added Figures 11 and 12 during
`
`prosecution of the ’288:

`priority date as early as November 18, 2013, and reserves the right to challenge

`the priority date in any other proceeding. However, Petitioner does not contest

`Petition because the prior art asserted here is prior art under the conceded date.

`Thus, such disclosure constitutes new matter and is only entitled to priority of the
`
`filing date of the ’288—November 18, 2013. See NIKE-1003 at Cover; see also

`Regents of the Univ. of Minnesota v. Gilead Scis., Inc., 61 F.4th 1350, 1356 (Fed.
`
`Cir. 2023) (“each application in the chain … must comply with the written
`
`description requirement” to be entitled to an earlier priority date); MPEP § 211.05.

`
`OVERVIEW OF THE PRIOR ART
`A. Vidai
`
`1. Overview of Vidai
`
` Vidai is a European Patent Application filed July 22, 1985, and published
`
`February 25, 1987. NIKE-1026; NIKE-1027. Vidai generally relates to a bra with
`
`side pockets. See id. As illustrated below, Vidai discloses a bra with breast cups,
`
`shoulder straps, and a chest strap encircling the torso of the wearer:

`Id. at Fig. 1 (showing only the left side of the chest strap). Additionally, Vidai
`
`discloses pockets formed on either side of the chest strap, under the arm of the
`
`wearer. Id. at 2:35-42. The pockets are formed “of a piece of fabric of which at
`
`least three edges are combined with the side strip by any suitable means, in particular
`
`by sewing.” Id. at 3:2-5. Vidai discloses the purpose of the pockets is to “hide
`
`valuable objects” that would normally keep within a woman’s handbag during the
`
`day. See id. at 1:2-7.
`
`2. Vidai Is Prior Art to the ’016
`
`Vidai is prior art to the ’016 under at least pre-AIA 35 U.S.C. §§ 102(b) or (e)
`
`and AIA 35 U.S.C. § 102(a). Vidai is a European Patent Application, filed July 22,
`
`1985, and published February 25, 1987, which is before the ’016’s earliest possible
`
`priority date. See infra § VII.B. The ’016’s inventor is not named as an inventor on
`
`
`

`Vidai. Vidai is therefore prior art to the ’016 under at least 35 U.S.C. § 102(a)(2).

`Vidai was not cited or considered during the prosecution of the ’016.

`
`Pintor
`1. Overview of Pintor
`
`Pintor issued on July 13, 2010, from U.S. Patent Application No. 12/240,408,
`
`filed September 29, 2008. See NIKE-1022. Pintor generally relates to a bra with
`
`concealed pockets on the inside surface of the upper, outer edge of the breast cups
`
`for the storage of personal items. Id. Specifically, Pintor describes “a brassiere
`
`containing concealed pockets for concealing objects such as portable electronic
`
`devices, keys, toiletries, money and other valuables.” Id. at 4:59–61. As shown
`
`below, the bra is comprised of two breast cups, a “medial portion” joining the cups,
`
`as well as a “torso band” and “shoulder straps.” Id. at 5:25–36.

`right cup). Further, the pocket (30) is “attached to the interior surface of the breast
`
`cover by any known means such as stitching.” Id. at 3:51–53. Pintor discloses that
`
`the cups and pockets may be formed of “elastomeric woven or nonwoven material,
`
`including spandex, materials comprising [Lycra], polyurethane, nylon, polyolefins,
`
`and the like.” Id. at 7:53–58.
