`The issue is whether a police officer is overstepping his authority, and ensuring there is
`a record of an officer's abuse.
`A lawyer who is “remotely” on scene, could instruct his client what officer's requests
`must be complied with, and how best to preserve the client's rights.
`Even law abiding persons might fear police after the constant drumbeat of media
`reports on excessive force by rouge officers.

`In 40 years practicing law, yes, I have received telephone calls from a client made during
`a traffic stop. Either two or three. Something like that. Not exactly sure how many. I
`think it may have been the same client each time.
`when I first wrote an answer to this question it was an entirely different question. Said
`nothing about FaceTime. I should also perhaps mention that there was not any
`advantage to my client that I can think of because he called me. Certainly doesn’t tend

`even if the attorney shows up in person

`A lot of ppl will say they want a witness. You’re not actually entitled to a witness. You are
`entitled to a lawyer/translator if necessary.

`If it's on a speaker phone and you're not on your probationary license go for it. It's not
`illegal to call someone on speaker phone but I'd make sure that rule applies for your
`state.

`Can you? Yes, if the officer agrees. Most won’t. It wastes his time. The time to argue the
`law (which is what a lawyer is for) is in court, not at the stop.

`Generally speaking, in the US, no, you cannot call your lawyer for advice while you are
`on a traffic stop. It is perfectly legal and justifiable for officers to tell you to stay off the

`Thanks all. Yeah this is not a personal thing, but I am seeing articles in the press now
`about this activity, and along with so many other civil rights being diminished, it just
`adds to my bad mood about the state of the country, and how difficult it is becoming to
`deal with so many forces being driven by money. I do plan a trip across country with my
`daughter and I literally feel sick to my stomach at the thought of this stuff happening.
`There will be no cause and no evidence, but that won't stop them from destroying my
`time and bank account, and my sense of what it used to be to be an American.

`are going to be reluctant to allow you to make phone calls to your lawyer or anyone

`I would think that this would be up to the discretion of the officer, but my assumption is
`that they would not allow it, for much the same reason as they would not consent to
`you videotaping the interaction. The officer has no way of knowing whether that's your
`lawyer or your friend on the phone, nor whether the video is being otherwise stored or
`broadcast at the time.
`I will say that you don't have a right to do so, that much would be pretty clear. And your
`answer to his threat should be, "You may search the car if you can provide me with a
`warrant authorizing you to do so." Followed by, "Am I under arrest," and, "I invoke my
`5th Amendment right to answer no questions until my attorney is present."
