`I, Benny D. Puck, do hereby declare as follows:
`1.
`I am over the age of 18. I currently reside in Manning, Iowa.
`2.
`I am the Founder of Puck Custom Enterprises, Inc. (“Puck”). I started
`Puck in 1979. Since then, Puck has been designing and manufacturing pumps and
`pumping equipment for various industries, including firefighting, fuel transport, and
`agricultural industries. I have been working with pumps for 45 years.
`3.
`I am the inventor listed on U.S. Patent Application Publication No.
`2014/0112093; U.S. Patent No. 9,462,741; and U.S. Patent No. 9,572,297.
`4.
`In 2012, I was employed by Puck and involved in new product
`development, including the development of pumps that are used for firefighting, and
`pumps that are used for pumping liquid manure.
`5.
`Through my many years in the industry, I am personally familiar with
`various pumps, including centrifugal pumps, positive displacement pumps, their
`structure, how they operate, and their capabilities. I am personally familiar with
`pumps used for pumping liquid manure and pumps used for firefighting in 2012 and
`before.
`High pressure / high volume pumps available in 2012 for pumping

`water from lakes and streams for firefighting are capable of pumping liquids with
`suspended solids, especially if the suspended solids had a total solid content of about
`5% or less. Such pumps could pump liquid with an even higher solid content. Such
`pumps are also capable of pumping liquid manure (mixtures of water and animal
`waste with a total solid content of less than about 5%). Such pumps could also pump
`mixtures of water and animal waste with even higher solid contents.
`7.
`Agricultural irrigation pumps are also capable of pumping liquids with
`suspended solids, especially liquids with a total solid content of less than 5%.
`Agricultural irrigation pumps, which are water pumps, are commonly used to pump
`liquid manure and were commonly used to pump liquid manure prior to 2012.

`I am not being compensated for my testimony or involvement in this
`matter. I have no financial interest in the outcome of this proceeding.
