`Plaintiff Multimodal Media LLC (“Multimodal” or “Plaintiff”) hereby makes the following

`infringement disclosures under the Patent Local Rules with respect to United States Patent Nos.

`7,929,949 (“’949 Patent”), 8,107,978 (the “’978 Patent”), 9,185,227 (the “’227 Patent”), and
`
`10,552,030 (the “’030 Patent”) (collectively, “Multimodal Patents” or “Asserted Patents”).
`
`Multimodal’s investigation is ongoing, and discovery is in its preliminary stages. Accordingly,
`
`these disclosures are based on information available to Multimodal at this time. Multimodal
`
`reserves the right to supplement this disclosure after further discovery from Defendants and non-
`
`parties, particularly documents and other discovery regarding Defendants’ Accused Products.

`Multimodal also reserves the right to assert additional claims of the Asserted Patents, accuse
`
`different products, or find alternative literal and/or equivalent infringing elements in Defendants’

`products.

`Multimodal believes that the Accused Products cited in the claim charts are representative of all

`versions of the Accused Products.

`Multimodal reserves the right to amend these claim charts, as well as other information
`
`contained in this document and the Appendices attached hereto, to incorporate new information
`
`identified after these contentions were served or learned during the course of discovery including,
`
`but not limited to, information that is not publicly available or readily discernible without
`
`discovery. Multimodal further reserves the right to amend these claim charts, as well as other
`
`information contained in this document and the Appendices attached hereto, pursuant to Patent
`
`Local Rules 3-1(g) and 3-6.

`LITERAL INFRINGEMENT AND DOCTRINE OF
`EQUIVALENTS
`
`Multimodal asserts that, under the proper construction of the asserted claims and their
`
`claim terms, the limitations of the asserted claims of the Multimodal Patents are literally present
`
`in the Accused Products as set forth in the claim charts attached hereto as Appendices A–D.
`
`Multimodal contends that any and all elements found not to be literally infringed are infringed
`

`under the doctrine of equivalents because the differences between the claimed inventions and the
`
`Accused Products, if any, are insubstantial. Multimodal contends that Defendants have directly
`
`infringed, and/or continues to directly infringe the asserted claims by making, using, offering for
`
`sale, selling, and importing into the United States the Accused Products. Multimodal also contends
`
`that Defendants indirectly infringe by contributing to and/or inducing others (e.g., Defendants’
`
`network operators, server operators, Samsung’s customers, and end-users) to directly infringe
`
`those claims by making or using the Accused Products. In addition, Multimodal contends that
`
`Defendants directly infringe to the extent that activities of third parties may be legally attributable
`
`to Defendants. Multimodal contends that Defendants induce infringement of the Multimodal
`
`Patents by others (e.g., end-users of the Accused Products and Defendants’ customers) by inducing
`
`others to make or use the Accused Products with the knowledge that this making or using directly
`
`infringes the Multimodal Patents or, in the alternative, with the belief that there was a high
`
`probability that others infringe the Multimodal Patents, but while remaining willfully blind to the
`
`infringement.
`
`Pursuant to Patent Local Rule 3-6(a)(1), Multimodal reserves the right to amend its
`
`Infringement Contentions as to literal infringement or infringement under the doctrine of
`
`equivalents, e.g., in light of the Court’s claim construction.

`
`Each of the asserted claims of the ’949 patent has a priority date (i.e., earliest invention
`
`date) at least as early as February 3, 2009, with diligent reduction to practice at least through its
`
`February 3, 2009 filing date.
`
`Each of the asserted claims of the ’978 patent has a priority date (i.e., earliest invention
`
`date) at least as early as April 25, 2007, with diligent reduction to practice at least through its
`

`date) at least early as April 22, 2012 (see produced inventor emails), with diligent reduction to
`
`practice at least through its December 12, 2013 filing date. Each claim further is entitled to a
`
`priority date no later than its earliest application, U.S. Provisional Patent Application No.
`
`61/737,274, with a filing date of December 14, 2012.

`Each of the asserted claims of the ’030 patent has a priority date (i.e., earliest invention
`
`date) at least as early as October 15, 2012, with diligent reduction to practice at least through its
`
`October 11, 2013 filing date. Each claim further is entitled to the priority date of its earliest

`application, U.S. Provisional Patent Application No. 61/713,635, with a filing date of October 15,

`Plaintiff contends that users of the Accused Products, including Samsung itself during testing and qualification of the Accused Products,
`perfo1m each step of the claimed method. Alternatively, backend se1vers, under the direction and control of the Samsung handsets, pe1fo1m
`ce1tain steps of the claimed method. Samsung and its users deiive benefit from their use of the infiinging method by: (i) saving bandwidth in the
`initial notification by using a pointer to point to the multimodal message that is stored on a se1ver; (ii) increasing convenience to the user by
`enabling the sender's multimodal message to be quickly received; and (iii) allowing the method to operate in situations in which it would not
`othe1wise be able to operate such as when the user does not have a data connection.
