`INTRODUCTION
`I have been retained by Sterne, Kessler, Goldstein & Fox P.L.L.C. on
`
`behalf of Volkswagen Group of America (“VWGoA” and/or “Petitioner”) for the
`
`above-captioned inter partes review proceeding. I understand that this proceeding
`
`involves U.S. Patent No. 10,075,941 (EX1001, “the ’941 Patent”), which is entitled
`
`“Methods and Apparatus for Multi-Carrier Communication Systems with Adaptive
`
`Transmission and Feedback,” and that the ’941 patent is currently assigned to Neo
`
`Wireless LLC (“Patent Owner”).
`
`Specifically, I have been retained as a technical expert by VWGoA to
`
`study and provide my opinions on the technology claimed in, and the patentability
`
`or unpatentability of, claims 1-14 of the ’941 patent (“the Challenged Claims”). This
`
`declaration is directed to the challenged claims of the ’941 patent, and sets forth the
`
`opinions I have formed, the conclusions I have reached, and the bases for each. For
`
`purposes of this declaration, I was not asked to provide any opinions that are not
`
`expressed herein.
`
`I am familiar with the technology described in the ’941 patent as of its
`
`earliest possible priority date of February 13, 2004. I have been asked to provide my
`
`technical review, analysis, insights, and opinions regarding the ’941 patent. I have
`
`used this experience and insight along with the references identified herein as the

`Petition for Inter Partes Review of the ’941 patent.
`
`I have reviewed and am familiar with the specification of the ’941
`
`patent issued on September 11, 2018. I understand that the ’941 patent has been
`
`provided as EX1001. I will cite to the specification using the following formats:
`
`EX1001, ’941 patent, 1:1-10 (long form) and EX1001, 1:1-10 (short form). These
`
`example citations both point to the ’941 patent specification at column 1, lines 1-
`
`10.
`
`I am being compensated by VWGoA at my standard hourly rate for the
`
`time I spend in connection with this proceeding. My compensation is not dependent
`
`in any way on the substance of my opinions or in the outcome of this proceeding.

`II. GROUNDS OF UNPATENTABILITY
`In forming my opinions about the ’941 patent, I have considered the
`
`following grounds of unpatentability. Based on my review of the prior art
`
`references that form the basis of these grounds, it is my opinion that claims 1-14 of
`
`the ’941 patent would have been obvious to a person of ordinary skill in the art

`I have been asked to consider how a POSITA would have understood
`
`the challenged claims in light of the disclosures of the ’941 patent. I also have been
`
`asked to consider how a POSITA would have understood the prior art references
`
`802.16a, Heath, Walton040, Li017, and Tufvesson. Further, I have been asked to
`
`consider and provide my technical review, analysis, insights, and opinions
`
`regarding whether a POSITA would have understood that the combinations of the
`
`prior art references listed in the table above render obvious claims 1-14 of the ’941
`
`patent.
`
`II. QUALIFICATIONS
`In formulating my opinions, I have relied upon my training, knowledge,
`
`and experience in the relevant art. I have over 32 years of experience working with
`
`wireless communication systems, and 30 years specifically working with OFDM
`
`systems. As detailed below, I have worked on many projects that are highly relevant
`
`to the subject matter of the ’941 patent.
`
`In particular, I have experience in the field of wireless communications
`
`through my education, my research work and my teaching. I earned a Bachelor of
`
`Arts in mathematics with honors from Bryn Mawr College in 1979. After working
`
`in industry as a programmer/analyst for the IIT Research Institute and SRI
`
`International, I went back to school at Stanford University and earned a Master’s in
`
`Electrical Engineering. I then worked for a medical electronics company as a signal
`

`processing engineer and in 1989 returned to Stanford to pursue my Ph.D. in
`
`Electrical Engineering in wireless communications; my thesis was on Orthogonal
`
`Frequency Division Multiplexing (OFDM).
`
`Since graduating from Stanford with my Ph.D., I have published over
`
`60 journal and conference papers in digital communications, two book chapters, and
`
`edited one book on transmission techniques for wireless communications. My
`
`research has focused mainly on OFDM and has spanned the areas of cellular
`
`communications, wireless LANs, digital subscriber lines (DSL), LiFi and
`
`underwater communications. I am a joint inventor on three US Patents, one on smart
`
`antennas and two on DSL.
`
`I have researched wireless communications and
`
`taught both
`
`undergraduate and graduate courses in digital and wireless communications at
`
`universities in the United States (Stanford University, Purdue University, and Santa
`
`Clara University) and Sweden (Lulea University of Technology and the Royal
`
`Institute of Technology). I also worked in industry at Agilent Laboratories, and
`
`ArrayComm, a smart antenna company. I have also consulted for companies. While
`
`a researcher at Lulea University of Technology in the late 90’s I worked with my
`
`students on OFDM; we published papers that have been heavily cited including one
`
`on multiple access for OFDM in cellular system. During the period of 2005-2006, I
`
`consulted for Texas Instruments on the LTE standard, working on modeling the
`

`physical layer and on handover schemes. Since 2006, I have been teaching at Santa
`
`Clara University in the Electrical and Computer Engineering Department where I
`
`am a full professor.

`I have worked within my professional society,

`IEEE
`
`Communications Society as an associate editor for top-tier journals. From 2009-
`
`2011, I was the Editor-in-Chief of IEEE Communications Letters. Then from 2012-
`
`2013, I was Director of Journals and from 2014-2015 I was the Vice-President for
`
`Publications for the IEEE Communications Society.
`
`My community has acknowledged this work through awards. I became
`
`an IEEE Fellow in 2014 “for contributions to OFDM.” I also received the Joseph
`
`LoCicero Award for Exemplary Service to Publications, “For sustained and
`
`innovative contributions to Publications” in 2017 from the IEEE Communications
`
`Society. In 2018, I was awarded the IEEE Education Society Harriett B. Rigas award
`
`for “for excellence in communications engineering, education and promoting
`
`equity.”
`

`further details on my experience, technical expertise, and other qualifications.
