`
`Pursuant to 37 C.F.R. § 42.70(a) and the Board’s Second Modified
`
`
`
`
`
`Scheduling Order (Paper 38) entered on March 11, 2024, Petitioner Samsung
`
`Bioepis Co., Ltd. (“Petitioner”) hereby respectfully requests oral argument in this
`
`proceeding. The oral hearing is currently scheduled for August 23, 2024. Paper
`
`38 at 3. Petitioner requests that the Board allot 60 minutes total for the oral
`
`argument, which would be divided equally between the parties (30 minutes per
`
`side). Patent Owner Regeneron Pharmaceuticals, Inc. has indicated it is not in a
`
`position to join this request at this time.
`
`
`
`Petitioner would prefer an in-person hearing, assuming that is convenient for the
`
`Board. Petitioner further requests that in-house counsel and any other non-arguing
`
`attorneys be permitted to attend the oral argument remotely. Petitioner will advise the
`
`Board as to any audio/video request as soon as practicable.
`
`
`
`The issues to be argued include:
`
`1.
`
`The patentability of Claims 1-30 of U.S. Patent No. 11,253,572;
`
`2. Any other issues the Petitioner and Patent Owner properly raised in the
`
`Petition, Patent Owner Response, and Reply in the proceeding;
`
`3. Any other issues that the Board deems necessary for issuing a Final
`
`Written Decision.
