`Pursuant to the Board’s authorization by email on January 5, 2024 and 37

`C.F.R. 42.10(e), Petitioner Cisco Systems, Inc. (“Petitioner”) submits this motion to
`
`withdraw Daniel W. McDonald (Registration No. 32,044) as back-up counsel for
`
`Petitioner.
`
`Petitioner files this motion because Mr. McDonald retired from the practice
`
`of law on December 31, 2023. As such, Mr. McDonald can no longer serve as back-
`
`up counsel for Petitioner. There will be no prejudice to the rights of Petitioner as a
`
`result of the withdrawal of Mr. McDonald because the undersigned will continue to
`
`serve as lead counsel for Petitioner. Lead counsel is up to speed on all issues, and
`
`there will be no delay in any scheduled filings in this proceeding.
`
`Patent Owner Orckit Corporation does not oppose this motion.
`
`If this motion is granted, Petitioner will file updated Mandatory Notices
`
`reflecting that Mr. McDonald is no longer back-up counsel.
`
