`
`INTRODUCTION
`
`Pursuant to the Court’s October 24, 2022 Scheduling Order (D.I. 17), Defendant Clover
`
`Network, LLC1 (“Clover” or “Defendant”) hereby serves its Preliminary Invalidity Contentions
`
`(“Preliminary Invalidity Contentions”) with respect to the asserted claims of U.S. Patent No.
`
`9,400,640 (“the ’640 patent”), U.S. Patent No. 10,083,012 (“the ’012 patent”), and U.S. Patent
`
`No. 11,226,793 (“the ’793 patent”) (the “Asserted Patents”), identified by CloudofChange, LLC
`
`(“CloudofChange”) in CloudofChange’s Preliminary Infringement Contentions, served on
`
`September 30, 2022 (“Preliminary Infringement Contentions”).
`
`In its Preliminary Infringement Contentions, CloudofChange has asserted the following
`
`claims (the “Asserted Claims”) against Clover:
`

`With respect to each asserted claim and based on its investigation to date, Clover:
`
`(a) identifies each item of prior art that anticipates each asserted claim or renders it obvious;
`
`(b) explains why the prior art anticipates and/or renders obvious each asserted claim, and
`
`identifies any combinations of prior art showing obviousness; (c) submits charts specifically
`
`identifying where and how in each item of prior art each limitation of each asserted claim is
`
`found;2 (d) identifies the grounds of invalidity based on indefiniteness or lacking written
`

`II.
`
`RESERVATIONS
`
`Clover reserves the right to revise its contentions depending upon the Court’s
`
`constructions of the asserted claims. Clover reserves to revise its contentions depending upon
`
`CloudofChange’s final infringement contentions, and/or any subsequent infringement
`
`contentions CloudofChange is allowed to serve in this case. Clover notes that discovery has not
`
`yet commenced in this case, and reserves the right to supplement its Preliminary Invalidity
`
`Contentions based on any information identified during discovery. Clover also expressly
`
`reserves the right to supplement its Preliminary Invalidity Contentions with third-party
`
`documents produced after the Preliminary Invalidity Contentions deadline. Clover further
`
`reserves the right to supplement its Preliminary Invalidity Contentions with third-party
`
`deposition testimony taken and third-party declarations provided after the Preliminary Invalidity
`
`Contentions deadline.
`
`The aforementioned reservations and general comments apply to all charts referenced in
`
`Clover’s Preliminary Invalidity Contentions, including the attached Exhibits.
`
`

`

`III. GENERAL COMMENTS APPLICABLE TO ALL ASSERTED PATENTS
`
`The Supreme Court has held that “[t]he combination of familiar elements according to
`
`known methods is likely to be obvious when it does no more than yield predictable results.”
`
`KSR Int’l Co. v. Teleflex Inc., 550 U.S. 398, 416 (2007). “When a work is available in one field
`
`of endeavor, design incentives and other market forces can prompt variations of it, either in the
`
`same field or a different one.” Id. at 417. As the Supreme Court made clear, “[f]or the same
`
`reason, if a technique has been used to improve one device, and a POSITA would have
`
`recognized that it would improve similar devices in the same way, using the technique is obvious
`
`unless its actual application is beyond his or her skill.” Id.
`
`To determine whether there is an apparent reason to combine the known elements in the
`
`fashion claimed by the patent at issue, a court can “look to interrelated teachings of multiple
`
`patents; the effects of demands known to the design community or present in the marketplace;
`
`and the background knowledge possessed by a person having ordinary skill in the art.” Id. at
`
`418. For example, obviousness can be demonstrated by showing “there existed at the time of
`
`invention a known problem for which there was an obvious solution encompassed by the patent’s
`
`claims.” Id. at 420. “[A]ny need or problem known in the field of endeavor at the time of
`
`invention and addressed by the patent can provide a reason for combining the elements in the
`
`manner claimed.” Id. Common sense also teaches that “familiar items may have obvious uses
`
`beyond their primary purposes, and in many cases a person of ordinary skill will be able to fit the
`
`teachings of multiple patents together like pieces of a puzzle.” Id.
`
`Thus, the motivation to combine the teachings of the prior art references disclosed herein
`
`is found in the references themselves and/or: (1) the nature of the problem being solved; (2) the
`
`express, implied and inherent teachings of the prior art; (3) the knowledge of persons of ordinary
`
`skill in the art; (4) the fact that the prior art is generally directed towards the same or similar
`
`
`
`problems; and/or (5) the predictable results obtained in combining the different elements of the
`
`prior art.

`The foregoing general comments are relevant to how a person of ordinary skill in the art
`
`(“POSITA”) at the time of the alleged invention of the Asserted Patents would have understood
`
`prior art references in the field of the Asserted Patents, and also relevant to which concepts a
`
`POSITA would have deemed obvious—both for single-reference obviousness and obviousness
`
`combinations.
`
`IV. IDENTIFICATION OF PRIOR ART
`
`In addition to the disclosures provided below, Clover attaches separate charts detailing its
`
`invalidity contentions on a claim-by-claim basis. (See Exs. A-’640-01 through A-’640-21, B-
`
`’012-01 through B-’012-21, and C-’793-01 through C-’793-21). Moreover, Clover hereby
`
`discloses and reserves the right to rely upon all references incorporated by reference into the
`
`references disclosed below and in the accompanying charts.4 For the avoidance of doubt (where
`
`not separately identified), identification of a granted patent by patent number also identifies the
`
`corresponding publication numbers and provisional application numbers.

`Clover also contends that the ’640 patent is invalid in view of public knowledge and uses
`
`and/or offers for sale or sales of products and services that are prior art under 35 U.S.C. § 102(a)
`
`or (b) that anticipate and/or render obvious the asserted claims at least when applying
`
`CloudofChange’s apparent interpretation of the claims in its Initial Infringement Contentions.

`Clover’s investigation of these sources of prior art is ongoing. The following lists each item of
`
`prior art under 35 U.S.C. § 102(a), and/or (b), by the name of the item and, to the extent now
`
`
`
`known, when the item became publicly known or was used, offered for sale, or sold. Clover
`
`contends that the below are stated on information and belief, and are supported by the
`
`information and documents that will be produced by Clover and/or third parties. Clover
`
`continues to investigate these events and reserves the right to add additional prior art products
`
`and services and/or to rely on additional documents or portions of documents describing the
`
`products and services below.
