`Die vorliegende 9., durchgesehene Auflage der Text(cid:173)
`ausgabe des Europaischen Patentubereinkommens
`enthalt die Texte des Ubereinkommens uber die
`Erteilung europaischer Patente (Fassung vom 4. Juli
`1997) und seiner Ausfuhrungsordnung (Fassung
`vom 1. Juli 1997), des Zentralisierungsprotokolls
`vorn 5. Oktober 1973, des Anerkennungsprotokolls
`vom 5. Oktober 1973, des Protokolls uber Vorrechte
`und lmmunitaten vom 5. Oktober 1973 und der
`Gebuhrenordnung (f=assung vom 1. Juli 1997). Sie
`enthalt auBerdem ein Verzeichnis der veroHent(cid:173)
`lichten Entscheidungen/Stellungnahmen der GroBen
`Beschwerdekammer (Anhang I) und eine Ubersicht
`uber die Rechtsauskunfte des EPA (Anhang II).
`In der 9. Auflage sind der revidierte Artikel 63 EPU,
`der am 4. Juli 1997 in Kraft getrete.n ist (ABI. EPA
`1992, 1 ff.), und folgende Beschlusse des Verwal(cid:173)
`tungsrats erstmals berucksichtigt: BeschluB vom
`20. Oktober 1995 zur Anderung des EPU - Artikel 97
`Absatz 6 - (ABI. EPA 1995, 741 ff.); BeschluB vom
`14. Juni 1996 zur Anderung der Ausfuhrungsord(cid:173)
`nung zum E PU - Regeln 28 und 28a - (ABI. EPA 1996,
`390 ff.); BeschluB vom 5. Dezember 1996 zur Ande(cid:173)
`rung der Gebuhrenordnung -Artikel 2 Nummern 1
`bis 3a (ABI. EPA 1997, 12 H.); BeschluB vom 5. De(cid:173)
`zember 1996 zur Anderung des EPO und seiner Aus(cid:173)
`fuhrungsordnung - Artikel 79 Absatz 2, Regeln 23a
`und 51 Absatz 8a ( ABI. EPA 1997, 13 ff.).
`Die vom Verwaltungsrat der Europaischen Patent(cid:173)
`organisation seit dem lnkrafttreten des Ubereinkom(cid:173)
`mens am 7. Oktober 1977 beschlossenen Anderun(cid:173)
`gen des Ubereinkommens, der Ausfuhrungsord(cid:173)
`nung und der Geb0hrenordnung sind in FuBnoten
`zu den betroffenen Bestimmungen kenntlich ge(cid:173)
`macht. Sie weisen das Datum des entsprechenden
`Verwaltungsratsbesch lusses, den Zeitpunkt seines
`-ln~rafttretens und d ie Fundstelle seiner Veroffent-
`lichung im Amtsblatt des Europaischen Patentamts
`(ABI. EPA) aus.
`Bei einigen wenigen Vorschriften, deren redaktio(cid:173)
`nelle Fassung zu Zweifeln AnlaB geben konnte,
`erschien es nutzlich, durch Randvermerke darauf
`hinzuweisen.
`Neben den Texten des Obereinkommens und der
`Ausfuhrungsordnung erscheinen Verweisungen auf
`einschlagige Artikel und Regeln. In den einzelnen
`Vorschriften selbst bereits zitierte Artikel und Regeln
`werden jedoch nicht nochmals angefuhrt. Es wird
`ausdrucklich darauf hingewiesen, daB diese Verwei(cid:173)
`sungen nicht Bestandteil der offiziellen Texte des
`Ubereinkommens sind, sondern, ohne Anspruch
`auf Vollstandigkeit zu erheben, die praktische Hand(cid:173)
`habung der Textausgabe erleichtern sollen.
`Hierzu dienen auch die o.g. Anhange I und II. Hin(cid:173)
`weise auf die Aktenzeichen der Entscheidungen/
`Stellungnahmen der GroBen Beschwerdekammer
`und auf die Nummern der Rechtsauskunfte sind bei
`den betroffenen Artikeln und Regeln als FuBnoten
`abgedruckt.

`This 9th, revised edition of the European Patent
`Convention contains the texts of the Convention on
`the Grant of European Patents (version as of 4 July
`1997} and its Implementing Regulations (version
`as of 1 July 1997), the Protocol on Centralisation
`of 5 October 1973, the Protocol on Recognition of
`5 October 1973, the Protocol on Privileges and
`Immunities of 5 October 1973 and the Rules relating
`to Fees (version as of 1 July 1997). Moreover, it
`encompasses an index of published decisions/
`opinions of the Enlarged Board of Appeal (Anne.x I)
`and Legal Advice from the EPO in brief (Annex II}.
`This 9th edition takes account for the first time of
`Article 63 EPC as revised, which entered into force
`on 4 July 1997 (OJ EPO 1992, 1 ff) and the following
`decisions of the Administrative Council: decision
`of 20 October 1995 amending the EPC - Article 97,
`(OJ EPO 1995, 741 ff); decision of

`The amendments made to the Convention, the
`implementing Regulations and the Rules relating to
`Fees by decisions of the Administrative Council of
`the European Patent Organisation since the Con(cid:173)
`vention entered into force on 7 October 1977 are in(cid:173)
`dicated in footnotes to the provisions in question.
`These footnotes give the date of the Administrative
`Council decision concerned, the date on which it
`entered into force and the reference to the Official
`Journal of the European Patent Office (OJ EPO) in
`which it was published.
`It has been thought useful to indicate. by way of
`marginal notes, some provisions the drafting of
`which might give rise to misinterpretation.
`References to pertinent Art.icles and Rules appear on
`the right-hand side of the text of the Convention and
`its Implementing Regulations. However, Articles
`and Rules already quoted in the provisions them(cid:173)
`selves are not again indicated. It is expressly pointed
`out that these references do not form part of the
`official text. They are simply intended to facilitate its
`use, and do not claim to be exhaustive.
`Annexes I and II as mentioned above are designed
`to serve the same purpose. The reference numbers
`of the decisions/opinions of the Enlarged Board of
`Appeal and the Legal Advice numbers are indicated
`in a footnote to the Articles and Rules in question.

`La neuvieme edition revisee de la Convention sur le
`brevet europeen comprend les textes mis a jour de
`la Convention sur la delivrance de brevets euro(cid:173)
`peens (redaction du 4" juillet 1997) avec son regle(cid:173)
`ment d'execution (redaction du 1" juillet 1997), du
`protocole sur la centralisation du 5 octobre 1973, du
`protocole sur la reconnaissance du 5 octobre 1973,
`du protocole sur les privileges et immunites du
`5 octobre 1973 et du reglement relatif aux taxes
`{redaction du 1"' juillet 1997). Elle contlent en outre
`une liste des decisions/avis publies de la Grande
`Chambre de recours (Annexe I) et un tableau recapi(cid:173)
`tulatif des renseignements juridiques communiques
`par l'OEB (Anne,ce II).
`La neuvieme edition tient compte pour la premiere
`fois de !'article 63 CBE tel que revise et entre en
`vigueur le 4 juillet 1997 (JO OEB 1992, 1s) ainsi que

`dans les notes en bas de page correspondant aux
`dispositions en cause. Ces notes indiquent la date a
`laquelle la decision du Conseil d'administration est
`intervenue, la date de l'entree en vigueur et la
`reference de la publication de la dedsion au Journal
`official de !'Office europeen des brevets (JO OEB).
`Dans les quelques cas ou la redaction de certaines
`dispositions pourrait susciter des doutes, ii nous a
`paru opportun de l'indiquer en marge.
`La presente edition de la Convention sur le brevet
`europeen et de son reglement d'execution com(cid:173)
`porte en marge, a droite du texte de dispositions de
`la Convention et du reglement d'execution, des ren(cid:173)
`vois aux articles et aux regles pertinents. Toutefois,
`les articles et regles cites dans le texte de ces dispo(cid:173)
`sitions ne soot pas repris en marge. II convient de
`souligner que ces renvois ne font pas partie inte(cid:173)
`grante des textes officials de la Convention, mais
`que, sans toutefois pretendre a l'exhaustivite, ils
`sont destines a en faciliter la consultation.
`C'est aussi a cette fin qu'ont ete joints les annexes I
