`

`message, the voice message being periodically repeated by the
`speakers of the recipient PDA/cell phone while said response list is

`voice message and clearing the response list from the display of the

`
`10. [preamble] A method of receiving, acknowledging and responding to a
`forced message alert from a sender PDA/cell phone to a recipient PDA/cell phone,
`wherein the receipt, acknowledgment, and response to said forced message alert is
`forced by a forced message alert software application program, said method
`comprising the steps of:
`
`[a] receiving an electronically transmitted electronic message;
`
`[b] identifying said electronic message as a forced message alert, wherein said
`forced message alert comprises of a voice or text message and a forced
`message alert application software packet, which triggers the activation of
`the forced message alert software application program within the recipient
`PDA/cell phone;
`
`[c] transmitting an automatic acknowledgment of receipt to the sender
`PDA/cell phone, which triggers the forced message alert software
`application program to take control of the recipient PDA/cell phone and
`show the content of the text message and a required response list on the
`display recipient PDA/cell phone or to repeat audibly the content of the
`voice message on the speakers of the recipient PDA/cell phone and show the
`required response list on the display recipient PDA/cell phone; and
`
`[d] transmitting a selected required response from the response list in order to
`allow the message required response list to be cleared from the recipient's
`cell phone display, whether said selected response is a chosen option from
`the response list, causing the forced message alert software to release control
`of the recipient PDA/cell phone and stop showing the content of the text
`message and a response list on the display recipient PDA/cell phone and or
`stop repeating the content of the voice message on the speakers of the
`recipient PDA/cell phone;
`
`[e] displaying the response received from the PDA cell phone that transmitted
`the response on the sender of the forced alert PDA/cell phone; and
`
`
`
`- xv -
`
`

`

`[f] providing a list of the recipient PDA/cell phones have automatically
`acknowledged receipt of a forced alert message and their response to the
`forced alert message; and

`
`
`[g] displaying a geographical map with georeferenced entities on the display of
`the sender PDA/cellphone;
`
`[h] obtaining location and status data associated with the recipient
`PDA/cellphone; and
`
`[i] presenting a recipient symbol on the geographical map corresponding to a
`correct geographical location of the recipient PDA/cellphone based on at
`least the location data.
`
`
`
`11. The method as in claim 10, wherein each PDA/cell phone within a
`predetermined communication network is similarly equipped and has the forced
`message alert software application program loaded on it.
`
`
`
`12. The method as in claim 10, wherein said forced message alert application
`software packet contains a response list, wherein said response list is a default list
`embedded in the forced message alert software application program.
`
`
`
`13. The method as in claim 10, wherein said forced message alert application
`software packet contains a response list, wherein said response list is a custom
`response list that is created at the time the specific forced message alert is created
`on the sender PDA/cell phone.

`I.
`
`INTRODUCTION
`
`IPR2023-00056
`U.S. Patent No. 8,213,970
`
`
`Cellco Partnership d/b/a Verizon Wireless (“Verizon”) requests inter partes
`
`review of claims 2 and 10-13 of U.S. Patent No. 8,213,970 (“’970 patent”) (Ex.
`
`1001), owned by AGIS Software Development LLC (“AGIS”). The challenged
`
`claims recite a combination of known features. These claims recite sending
`
`“forced message alerts,” which are electronic messages that require a response, and
`
`tracking the recipient’s receipt of those “forced message alerts.” IBM, Bellcore,
`
`and Micron Technology, however, described these limitations well before the ’970
`
`patent’s filing date.
`
`In the 1990s (well before the ’970 patent’s earliest filing date), Bellcore, for
`
`instance, disclosed personal digital assistants (PDAs) for sending/receiving
`
`electronic messages (e.g., emails). Ex. 1008. IBM and Micron Technology also
`
`worked on systems for sending/receiving mandatory-response messages. Exs.
`
`1006, 1007. In fact, IBM applied its work with mandatory-response messages to
`
`PDAs with a touchscreen user interface and a stylus. Exs. 1005, 1009. These
`
`disclosures illustrate that it was known to use a PDA to send, receive, and track
`
`forced-message alerts, as claimed in the ’970 patent.
`
`The Examiner, without considering such systems, allowed the claims, but
`
`only after amendments to recite providing a recipient with a list of possible
`
`responses to an incoming message. But even that concept was known in the prior

`
`
`message and displays a menu of possible responses that may be selected “as a
`
`quick response to the … message.” Ex. 1005, ¶[0057]. Similarly, Pepe discloses a
`
`PDA providing a menu of possible responses from which a user may choose in
`
`order to respond to a message. Ex. 1008, 36:16-20, 40-42, Figs. 42, 45.
`
`While the ’970 patent has undergone reexamination, the reexamination did
`
`not consider references that teach limitations added during reexamination.
`
`Because the references teach the challenged claims, the Board should
`
`institute review and find the claims unpatentable.
`
`II. MANDATORY NOTICES UNDER 37 C.F.R. § 42.8
`A. Real Parties-in-Interest
`
`The real party in interest is Cellco Partnership d/b/a Verizon Wireless.
`
`Additionally, out of an abundance of caution in light of prior challenges to the
`
`named real parties-in-interest in separate and unrelated IPR petitions, Petitioner
`
`further identifies Verizon Communications Inc., Verizon Enterprise Solutions,
`
`LLC, Verizon Business Global LLC, Verizon Business Netw
