`voice message on the speakers of the recipient PDA/cell phone and show the

`Cellco Partnership d/b/a Verizon Wireless (“Verizon”) requests inter partes
`
`review of claims 2 and 10-13 of U.S. Patent No. 8,213,970 (“’970 patent”) (Ex.
`
`1001), owned by AGIS Software Development LLC (“AGIS”). The challenged
`
`claims recite a combination of known features. These claims recite sending
`
`“forced message alerts,” which are electronic messages that require a response, and
`
`tracking the recipient’s receipt of those “forced message alerts.” IBM, Bellcore,
`
`and Micron Technology, however, described these limitations well before the ’970
`
`patent’s filing date.
`
`In the 1990s (well before the ’970 patent’s earliest filing date), Bellcore, for
`
`instance, disclosed personal digital assistants (PDAs) for sending/receiving
`
`electronic messages (e.g., emails). Ex. 1008. IBM and Micron Technology also
`
`worked on systems for sending/receiving mandatory-response messages. Exs.
`
`1006, 1007. In fact, IBM applied its work with mandatory-response messages to
`
`PDAs with a touchscreen user interface and a stylus. Exs. 1005, 1009. These
`
`disclosures illustrate that it was known to use a PDA to send, receive, and track
`
`forced-message alerts, as claimed in the ’970 patent.
`
`The Examiner, without considering such systems, allowed the claims, but
`
`only after amendments to recite providing a recipient with a list of possible
`
`responses to an incoming message. But even that concept was known in the prior
`
`

`art. Kubala discloses a system in which a PDA receives a mandatory-response

`message and displays a menu of possible responses that may be selected “as a
`
`quick response to the … message.” Ex. 1005, ¶[0057]. Similarly, Pepe discloses a
`
`PDA providing a menu of possible responses from which a user may choose in
`
`order to respond to a message. Ex. 1008, 36:16-20, 40-42, Figs. 42, 45.
`
`While the ’970 patent has undergone reexamination, the reexamination did
`
`not consider references that teach limitations added during reexamination.
`
`Because the references teach the challenged claims, the Board should
`
`institute review and find the claims unpatentable.
`
