`I, Don J. Mizerk, declare as follows:

`I am a lawyer at the law firm of Husch Blackwell LLP, attorneys for
`
`Petitioner in the above-captioned proceeding. I am over the age of eighteen,
`
`competent to make this declaration, and do so based on personal knowledge. I
`
`provide this declaration in support of Petitioner’s Motion for my pro hac vice
`
`admission. My testimony in this declaration is based on personal knowledge and, if
`
`called as a witness, could competently testify to the facts below.
`

`I am an experienced litigating attorney and have approximately 26
`
`years of experience in litigating patent infringement suits. My practice has been
`
`predominantly patent infringement litigation before district courts around the
`
`country and the Federal Circuit Court of Appeals.
`

`
`I am a member in good standing of the Bars of the States of Illinois
`
`and California, and am admitted to practice before the U.S. District Court for the
`
`Northern District of Illinois, the United States Bankruptcy Court for the Northern
`
`District of Illinois, the U.S. District Court for the Northern District of California,
`
`the U.S. District Court for the Central District of California, the U.S. District Court
`
`for the Southern District of California, the Third Circuit Court of Appeals, the
`
`Sixth Circuit Court of Appeals, the Seventh Circuit Court of Appeals, the U.S.
`
`Court of Appeals for the Federal Circuit, and the United States Supreme Court.

`I have never been suspended or disbarred from practice before any

`court or administrative body.

`I have read and will comply with the Office Patent Trial Practice

`Guide and the Board’s Rules of Practice for Trials set forth in § 42 of 37 C.F.R.

`issue in these proceedings as I have engaged extensively in counseling with
`
`Petitioner concerning issues relating to this patent, including consideration relating
`
`to this inter partes review.
