`We write regarding our on-going litigation, in which XR Communications LLC
`dba Vivato Technologies asserts U.S. Patent Nos. 10,715,235 (the “’235 patent”) against
`Google LLC.
`
`Google is planning to submit a petition for inter partes review (IPR2022-01362)
`challenging claims 8-14 of the ’235 patent. By this letter, Google stipulates that, unless the
`Board denies or later vacates institution of this petition, Google will not seek resolution of
`invalidity in this litigation based on the specific grounds asserted in this petition.
