`For each of the above-referenced cases (IPR2022-01078 and IPR2022-01106), Petitioners request
`authorization to file a 5 page preliminary reply to Patent Owner’s preliminary response. In each
`case, Petitioners’ preliminary reply would be limited to addressing why the Board should not
`exercise its discretion to deny institution based on the proper application of the Fintiv factors in view
`of the Director’s interim guidance. Petitioners could not have reasonably addressed these issues in
`the petitions because, among other reasons, the interim guidance issued after the petitions were
`filed.

`Petitioners and Patent Owner met and conferred regarding this request, and Patent Owner does not
`oppose Petitioners’ request, provided that Patent Owner is authorized to file a 5-page Preliminary
`Sur-Reply to respond to Petitioners’ Preliminary Reply within seven business days of the filing of
