`The Inclusion of URL to PC Magazine is Proper
`One dispute in the proceeding is the meaning of “memory module.” Netlist
`
`has provided evidence regarding its meaning, including both intrinsic evidence and
`
`the claim construction order from the district court. POR 1-3. The POR notes that
`
`its proposed construction, which follows that of the district court and whose proper
`
`meaning is not objected to by Samsung, is also consistent with testimony by
`
`Samsung’s expert, Dr. Wolfe. POR 2. The POR states, “[t]he Court’s finding
`
`accords with testimony by Samsung’s expert that the term memory modules
`
`typically refers to ‘main memory modules,’ which ‘are designed to connect to the
`
`primary memory controller for the purpose of the holding general purpose code and
`
`data in a computer system.’” Id. (emphasis in original). Notably, when referencing
`
`“main memory modules,” the POR underlines both “main” and “memory” because
`
`the term “main memory” is a term of art referencing the primary, internal workspace
`
`in a computer, commonly known as RAM.
`
`In its Reply, Petitioner emphasized only the word “main” in “main memory
`
`modules,” making it appear that “main” is used to modify “memory module.” See
`
`Reply 1. In response to that, Netlist explained that “main memory” “is commonly
`
`known as RAM” by citing to the PC Magazine URL. Sur-Reply 1 n.2. This is
`
`consistent with Dr. Mangione-Smith’s testimony in EX2031, ¶ 53 (cited on POR 3),
`
`where he testified as follows with reference to EX2034’s Figure 7.6 that depicted
`
`

`In other words, the URL is in response to the Reply’s mischaracterization of
`
`the term “main memory module” and to explain what “main memory” means in case
`
`Petitioner is truly confused about the subject “main” is intended to modify. The AIA
`
`rules cannot be interpreted in a manner that allows the Petitioner to interject
`
`
`

`mischaracterization in the Reply while tying Patent Owner’s hand to respond. The
`
`URL at issue here is to clarify a potential term of confusion that Netlist could not
`
`foresee as it first arose in the Reply.
`
`Applied Materials is not on point. There, the ruling is in connection with a
`
`motion to strike a new argument. Applied Materials v. Ocean Semiconductor LLC,
`
`IPR2021-01340, Paper 52, 60 (PTAB Feb. 7, 2022). Here, Petitioner does not assert
`
`that the argument is new. Nor can it, given the POR, the cited testimony by Dr.
`
`Mangione-Smith, and the fact that the Reply injected confusion by mischaracterizing
`
`the term “main memory module.”
`
`II. The Inclusion of URL for Two Related Images Are Proper
`For the Spiers-based grounds, one issue is whether Spiers PCI card having
`
`memory modules on it qualifies as a memory module itself. The POR provides an
`
`illustration of a PCI card with a memory module inserted into a memory slot on the
`
`PCI card. See POR 47 (excerpted below).

`In response to the Reply’s continued attempt to confound memory modules
`
`on the one hand and the PCB board with which the memory modules are mated via
`
`memory slots on the other hand, the Sur-reply provides additional illustrations to
`
`show PCI cards having memory slots for DIMMs. The one on Sur-Reply page 24
`
`shows a PCI card with four inserted DIMMs, and the one on page 26 shows a PCI
`
`with four empty memory slots.

`Unlike URLs, the images in the sur-reply are non-transitory. Petitioners do

`not seem to object to the images themselves, but only to the referenced URLs.

`Moreover, there is no need to submit the images as exhibits because they serve as
`
`the same demonstrative purpose as the figures on, e.g., pages 16 and 22. And just
`
