`Petition for Inter Partes Review
`
`
`I.
`
`PRELIMINARY STATEMENT
`
`Petitioner Samsung Electronics Co., Ltd., and Samsung Electronics
`
`America, Inc. (collectively “Samsung”) requests inter partes review of U.S. Patent
`
`No. 10,620,663 (Ex. 1001), assigned to Patent Owner Village Green Technologies,
`
`LLC (“VGT”) and cancellation of claims 1-7, 9-10, 15, 22-31, 34, and 41.
`
`All challenged claims are directed to a portable device comprising primary
`
`and secondary displays. While the claims specify various structural and operational
`
`features of the portable device, the Examiner only allowed the claims because she
`
`thought one particular combination of features was not in the prior art:
`
`[1e] “when the user of the device selects or identifies via
`an action first information in the primary display, said
`action causes the secondary display to display second
`information related to said first information displayed in
`the primary display; and [1f] when the user of the device
`selects or identifies via an action third information in the
`secondary display, the action causes the primary display
`to display fourth
`information related
`to …
`third
`information displayed in the secondary display” (emphasis
`added) in combination with [1d] “both the primary and
`secondary displays display information that is viewable by
`a user of the device during the at least one of a plurality of
`operating modes.”

`
`

`

`IPR2022-00957
`Petition for Inter Partes Review
`
`
`Ex. 1003, 38 (emphasis in original)1. But the Examiner did not have Chinese
`
`Patent Publication No. CN 1761267A (“Liu”).
`
`Liu discloses the very combination of features that led to allowance. As one
`
`example, in Liu, referring to Figure 6b2, “if an item of the submenu displayed on
`
`the second screen 116 is selected for running, the selected item will run on the first
`
`screen 122.” Liu, 13. As another example, in Liu, referring to Figure 6a, when the
`
`user selects “1. Text Message” in first screen 122 by placing cursor 122a over this
`
`item, this action causes second screen 116 to display “the submenu for ‘1. Text
`
`Message.’” Id.
`
`
`1 All emphasis in this petition has been added unless otherwise noted.
`
`2 All figures in this petition containing color are annotated relative to the original
`
`figures in the patent or prior art and all text in color is added.

`

`
`FIG. 6b
`
`Liu
`
`FIG. 6a
`
`
`
`Liu also discloses all the other features of the independent claims and several
`
`dependent claims. Infra Section VI.A. And Liu alone or in combination with U.S.
`
`Patent Publication No. 2005/0083642 (“Senpuku”) renders all the challenged
`
`claims obvious. Infra Sections VI.B-C. Despite both these references being in the
`
`same field of endeavor as the ’663 patent, portable devices with multiple displays,
`
`and thus being analogous art to the ’663 patent, the Examiner was not aware of
`
`either of them. As set forth below, Petitioner establishes at least a reasonable
`
`likelihood that each challenged claim is unpatentable, and thus respectfully
`
`requests that the Board institute review and cancel all challenged claims.

`
`II.
`
`PRIOR ART BACKGROUND
`
`A. Conventional Portable Devices
`
`Portable devices with multiple displays were well known long before the
`
`earliest claimed priority date of the ’663 patent, July 7, 2009.3 Ex. 1002
`
`(“Bederson”), Sections VI.A-B. Indeed, when the application leading to Liu was
`
`filed in April 2005, two-display devices were already described as “conventional.”
`
`Liu, 6. For example, Liu describes and illustrates in Figure 1, below, “a
`
`conventional mobile telecommunications terminal.” Id.
`
`
`3 Petitioner reserves the right to challenge the priority date here and/or in other
`
`proceedings.

`
`
`Liu, Figure 1. As shown, Liu’s conventional device is a flip phone “composed of a
`
`body 20 and a flip cover 30 that can be opened or closed using a hinge component
`
`40 on its top side.” Id., 6. The flip cover 30 includes “a flip cover case 32, which
`
`encapsulates a main screen (not shown in the drawing) that displays multiple types
`
`of information; [and] an auxiliary screen 31, which is located in the center of the
`
`front of the flip cover case 32 and provides basic terminal information.” Id. As Dr.
`
`Bederson explains, Liu’s conventional device is just one example of what was well
`
`known long before the ’663 patent. Bederson, ¶¶ 41-61, 64-71. For context, in
`
`addition to flip phones like that in Liu, so-called “candy bar” and “slider” phones
`
`had also long existed. Id., ¶¶ 41-42. Indeed, as recognized by the ’663 patent, many
`
`5
`
`

`

`
`structural and operational variations of portable devices were known long before
`
`IPR2022-00957
`Petition for Inter Partes Review
`
`the ’663 patent. Ex. 1001, 1:29-2:5.
`
`B. Known Structural Variations
`
`For example, recognizing the limited functionality and screen space of the
`
`“conventional” flip phone, Liu disclosed a structural variation in the form of an
`
`improved flip phone shown in Figures 2-3 and 5-6b. Bederson, Section VII.A. In
`
`this improved flip phone, the back side of flip cover 120 includes a first screen
`
`122, and terminal body 110 includes a second screen 116 mounted on an inclined
`
`protruding part 115 of body 110. Liu, 1, 2, 8, 10; Bederson, ¶¶ 64-65. When flip
`
`cover 120 is closed on terminal body 110, first screen 122 is stowed, protected, and
`
`hidden from the user while second screen 116 remains visible to the user through
`
`the opening between flip cover 120 and terminal body 110. Bederson, ¶ 65; see
`
`infra Sections VI.A.1.c, VI.B.2.c. When flip cover 120 is open, however, both first
`
`screen 122 and second screen 116 are simultaneously viewable by the user. Liu, 1,
`
`2, Fig. 2.

`
`
`
`As another example, recognizing that there was room for improvement in
`
`user operability for switching among multiple displays in conventional portable
`
`devices, Senpuku disclosed another structural variation in the form of a mobile
`
`communications device with a main display device 3a and a sub-display device 3b
`
`that changes from a closed status to an open status. Senpuku, Abstract, ¶¶ [0005],
`
`[0046]; Bederson, Section VII.B. In the closed status, as seen in Fig. 2, sub-display
`
`device 3b is stowed, protected, and hidden behind main display device 3a.
`
`Senpuku, ¶¶ [0049]-[0050], [0065]. To move the device to the open status, the user
`
`7
`
`

`

`
`pulls out sub-casing 21 to expose sub-display device 3b. Id., ¶ [0054].

`
`Senpuku
`
`
`
`As yet another example, Senpuku disclosed an embodiment where sub-
`
`display device 3b rotates about a hinge 30 from a closed or stowed configuration
`
`(see Figs. 21(b) and 22(b)) on the front of main body casing 20 to an open or
`
`deployed configuration above body casing 20 (see Figs. 21(a) and 22(a)) such that
`
`“the user can refer to both displays at once.” Id., ¶¶ [0058], [0122].

`
`C. Known Operational Variations
`
`Recognizing that the user cannot simultaneously view both displays on a
`
`conventional portable device (see Bederson, ¶¶ 49-51), Liu addressed several
`
`operational variations. Providing many examples involving different applications
`
`such as picture taking, top-level menu, menu, submenu, and message writing, Liu
`
`discloses a portable device that enables the user to select information displayed on
`
`one display, which in turn prompts related information to be displayed on the other
`
`display. Liu, 10, 12, 13; Bederson, ¶¶ 67-68. As one example, in Liu, referring to
`
`Figure 6b, “if an item of the submenu displayed on the second screen 116 is
`
`selected for running, the selected item will run on the first screen 122, and the first
`
`9
`
`

`

`
`
`screen will be activated.” Liu, 13. As another example, in Liu, referring to Figure
`
`6a, when the user selects “1. Text Message” in first screen 122 by placing cursor
`
`122a over this item, this action causes second screen 116 to display “the submenu
`
`for ‘1. Text Message.’” Id., 13.
`
`When an application is
`selected in primary display,
`it runs on secondary display
`
`When menu item is selected in
`secondary display, submenu of
`selected item is displayed in
`primary display
`
`FIG. 6b
`
`Liu
`
`FIG. 6a
`
`
`
`Senpuku likewise addressed several operational variations, allowing “the
`
`user [to] select the double screen display or single screen display simply by
`
`opening and closing the sub-display device 3b.” Senpuku, ¶ [0083]. For example,
`
`referring to Figure 6, when the user specifies content in the main display device 3a
`
`and sub-display device 3b changes from the closed to the open status, content
`
`related to the specified content on main display device 3a is displayed on sub-
`
`display device 3b. Id., Abstract, ¶¶ [0054], [0060], [0088], [0091]. In one particular
`
`10
`
`

`

`IPR2022-00957

`
`
`example, when in the email browsing mode, the main display device 3a displays a
`
`list of received emails, and when the user specifies a desired e-mail and pulls out
`
`sub-casing 21, sub-display device 3b is automatically activated, and details of the
`
`specified email are displayed on sub-display device 3b. Id., ¶¶ [0053]-[0054]; see
`
`also id., ¶¶ [0055]-[0058].

`
`III. THE ’663 PATENT
`A. Disclosure
`
`Viewed against this backdrop of the prior art, the ’663 patent simply
`
`describes known features of portable devices. Bederson, Sections VI.A-B, VIII.A.
`
`According to the patent’s summary, just like Liu and Senpuku, it is directed to a
`
`multiple display system. Ex. 1001, 2:37. And just like Liu and Senpuku, the patent
`
`contemplates structural variations with folding and sliding displays in Figures 1
`
`and 3 that allow for stowing and protecting one of the displays.
