`Subject: IPR2022-00853 - Patent Owner's Request for Authorization to File Response to Petitioners’
`Petition for Rehearing
`
`CAUTION: This email has originated from a source outside of USPTO. PLEASE CONSIDER THE SOURCE before
`responding, clicking on links, or opening attachments.
`
`Your Honors:
`
`In response to Petitioners’ Petition for Rehearing in IPR2022-00853, Patent Owner respectfully
`requests leave to file a 15-page response, which Patent Owner proposes to file on or before
`December 2nd.
`
`Petitioners have indicated that they will consent to this request only if they are permitted to file a 5-
`page reply a week thereafter. Patent Owner does not agree to a reply and submits that no further
`
`Exhibit 3004
`
`

`

`briefing is necessary beyond providing Patent Owner an opportunity to respond. However, if the
`Board grants a reply, Patent Owner respectfully requests a sur-reply, which Petitioners do not agree
`is necessary given that Petitioners are effectively the moving party.
`
`Should the Board wish to have a call, both parties are available Monday, November 28th after 3 PM
`ET, or Tuesday, November 29th 12-1 PM ET. The parties will, of course, be happy to look for other
`times if those dates and times are not convenient for the Board.
`
`Respectfully submitted,
