`
`PATENT OWNER’S REQUEST FOR ORAL HEARING
`
`
`
`
`1 IPR2023-00016 has been joined with this proceeding.
`
`
`
`
`
`

`

`The Board tentatively scheduled oral hearing for this proceeding for June 14,
`
`2023. Paper 17 at 12 (DUE DATE 8). Pursuant to 37 C.F.R. § 42.70(a), Patent
`
`Owner Bausch Health Ireland Limited requests oral hearing on all instituted grounds
`
`of unpatentability for claims 1-6 of U.S. Patent No. 7,041,786, any motion to exclude
`
`filed by either party, and any other issues that may affect the Board’s determination
`
`in this proceeding. Patent Owner also requests hearing on any issues specified by
`
`Petitioner in its Request for Oral Argument and any issues that the Board deems
`
`necessary for issuing a final written decision.
`
`Patent Owner requests that it and Petitioner each be allotted 60 minutes of
`
`argument time. To the extent the Board schedules the hearing to last less than or
`
`more than 120 minutes of total argument time, however, Patent Owner requests that
`
`it be allotted half the length of the hearing.
`
`Patent Owner requests that the panel hear oral argument virtually by remote
`
`means. To the extent the panel prefers to hold oral argument by in-person hearing
`
`at the San Jose, California, USPTO Regional Office, Patent Owner requests that two
`
`spaces be reserved for counsel at counsel’s table and that three additional spaces be
`
`reserved in the hearing room to accommodate additional counsel and/or corporate
`
`representatives, and Patent Owner requests the ability to use computers and
`
`audio/visual equipment to display demonstrative exhibits and evidence, including
`
`the use of a projector and screen.
