`
`again when
`
`t is that cimeof year
`
`the annual taeto aprons gam-
`ing comes to a close with the
`upcoming Novemberelection. A num-
`ber ofissues are up for popular vote,
`although, what was felt to be the most
`likely pass over the last two years—slots
`ar tracks in Maryland—was defeatedin
`the state legislature once again. It should
`be noted that getting on the ballor does
`not mean passage is guaranteed.
`A popular voteis always a tough
`way to get approval because of the way
`the electorate typically votes, It is com-
`mon knowledge that a typical U.S.
`voter shows up less than 50 percent of
`the time to vote in an election—pro-
`gaming individuals vote this way.
`However, anti-gaming voters are not
`your typical vorers. In many oftheir
`minds, they are voting against sin andit
`becomes more ofa malian and ethical
`issue. Hence, anti-gamers tend to vote
`in a much higher percentage. Theycare
`aboutthe issues more passionately than
`the pro-gamers. This leads to winning
`polls nor always resulting in winning
`gaming votes.
`To give you an example ofthis, a 60
`percent-40 percent pro-gamingpoll will
`pnt end up
`in a losing vote. Ifonly
`0 percentofthe 60 percent polled vote
`pro-gaming, while 80 percentof the 40
`percentpolled vote anti-gaming, then
`the actual vote will turn out to be 57
`percentagainst gaming andthereferen-
`dum loses.
`This makes
`gettin
`bli
`approved heats a Spar ea diffi-
`cult. The fact this is a tight presidential
`election year should help gamin
`though,since the typical voter should
`show up a higher percentage ofthe time.
`
`Issue Oriented
`This year a numberof key issues are to
`be voted on andindividual operators
`should benefit, However, if any of these
`issues pass, the big winner would be the
`slot manufacturers with new slot
`machineorders.
`Florida has a constitutional amend-
`menton theballor to allow voters
`statewide to decide whether Miami-
`
`18
`
`Dade and Broward counties can allow slot
`machines at seven racetracks and for Jai-
`| Alai facilities. If approved, the issue would
`then go to local referendum in March. The
`driving force for this vote is the gray-
`area—Native American casinos in those
`counties that
`pay no taxes to the state. The
`new success of
`the Hard Rock casino has
`madethis issue more visible. Currently the
`vote looks tight, but has a chance to pass.
`Beneficiaries of the passage includeIsle of
`Capri and Magna Entertainment.
`In Nebraska, there are twobills on the
`ballot. The first wouldlegalize two casinos
`in Omaha andallow close to 5,000 video
`lottery terminals in bars, restaurants and
`horse tracks in the state. The second ballot
`issue would allow two casinos to be any-
`wherein the state. Unfortunately for gam-
`ing, when two competing gambling meas-
`ures are up
`for vote at the same time, they
`tend to dilute each other and lower the
`chances either is approved. We thinkthis
`will be a tough oneto get approved.If
`pees. Boyd Gaming and the Venetian are
`ooking like front-runners to get licenses,
`| while n
`Iowa casino operators
`P
`Harrah's and Ameristar would get hurt.
`In California, there are two competing
`slot proposals goingto vote, althou
`deal
`Governor Schwarzenegger's recent
`with a numberoftribes probably hurt both
`measures’ chances. The governoris publicly
`against both proposals. One proposal
`Pee ofslot
`| would lift limits on the num
`machines at the tribal casinos, while
`uiring
`the tribes to pay 8.84
`percent of
`their aeprofito the nds Theother
`ro-
`posal would tax tribes at 25 percento
`their slot machine revenue. If the tribes
`refuse, then thestate’s 11 card rooms and
`five horse-racing tracks would be allowed
`to operate 30,000 slots machines at a 33-
`percent tax rate. Given the governor's
`recent maneuvers, we believe these meas-
`ures are likely to fail.
`In Oklahoma, Governor Brad Henry
`signed a bill to allow a referendum to deter-
`mine whetherto allow tribes and racetracks
`in the state to operate modified Class-II slot
`machines. This measure is too close to call.
`MagnaEntertainmenthas a track in
`Oklahoma and would benefitif passed.
`In Michigan, a referendum would
`
`require voters to give their approval
`re any new gambling could begin in
`Michigan, except at Native American
`casinos and thethree existing Detroit
`casinos. The amendment would be
`retroactive to January 1, 2004, Any gam-
`bling expansion would require both
`statewide andlocal voter approval. This
`measure is being heavily supported by
`both the tribes and the Detroit casinos.
`The state's racetracks here have been
`pushingforslots at tracks feeling the
`pressure ofall rhe casinos operating in
`the state. Passage of this measure would
`make racinos much moredifficult to
`allow, If it fails, we anticipate a racino
`bill will be proposed in the state's legisla-
`ture quickly thereafter.
`bling measures
`Approval of new
`but we were
`is always a long shot
`encouraged by last year's passage of gam-
`bling measures in Pennsylvania and
`Maine and we plan on writing more on
`this after the Novemberelections.
