`PETITIONER’S REQUEST FOR ORAL ARGUMENT
`

`Pursuant to the Board’s September 28, 2022, Scheduling Order (Paper 12),
`
`Petitioner respectfully requests oral argument for the trial currently scheduled on
`
`June 29, 2023. The present challenged ’208 Patent (IPR2022-00601) is related to the
`
`challenged ’705 Patent in IPR2022-00602 (for which a Request for Oral Argument
`
`is being concurrently filed). The issues for both the ’602 and ’601 IPRs are similar.
`
`As such, Petitioner requests a single hearing for both IPRs be held. Petitioner
`
`requests forty-five (45) minutes of argument for each party. Petitioner’s and Patent
`
`Owner’s counsel have conferred on the matter of a single hearing for both IPRs and
`
`a 45-minute argument time for each Party and jointly submit this request.
`
`If the Board is allowing in-person hearings, Petitioner further requests the
`
`hearing take place in the USPTO’s Alexandria, Virginia location.
`
`Pursuant to 37 C.F.R. § 42.70(a), Petitioner specifies the following issues,
`
`without intent to waive consideration of any issue not requested, to be argued for this
`
`proceeding:
`
`1. Whether Claims 1, 3-7, 9-11, and 13 are obvious under § 103 over U.S.
`
`U.S. Patent Application Publication No. 2004/0123113 to Mathiassen, et al.
`
`(“Mathiassen”) in view of U.S. Patent No. 6,766,456 to McKeeth (“McKeeth”) and
`
`U.S. Patent No. 6,509,847 to Anderson (“Anderson”);

`
`Any claim constructions, unpatentability grounds, or other issues raised in
`
`the Petition or Petitioner Reply, the Patent Owner Preliminary Response, the Patent
`
`Owner Response, the Patent Owner Sur-Reply, or the Board’s Institution Decision;

`Any issues regarding motions to exclude or motions to strike that may be
`
`filed or pending; and
`
`4.
`
`Any issues otherwise raised by the Board.
