`
`Dear Honorable Board,
`
`
`Petitioners Apple Inc. and Fantasia Trading LLC d/b/a AnkerDirect (“Anker”) would like to jointly flag an
`issue for the Board’s consideration. Namely, several recent joinder (“copycat”) petitions filed by Apple
`and Anker have been accorded notice of filing dates prior to the respective petitions they are seeking to
`join. Specifically:
`• Anker filed a first-in-time petition challenging U.S. Patent No. 7,825,537. Apple filed a copycat
`petition and corresponding joinder motion 9 days after Anker’s original petition. Apple’s
`copycat petition, however, was accorded a filing date 15 days prior to Anker’s petition. (See
`table below).
`• Apple filed first-in-time petitions challenging U.S. Patent Nos. 9,490,652 and 10,193,392. Anker
`filed copycat petitions and corresponding joinder motions ~20 days after Apple’s original
`petitions. Anker’s copycat petitions were accorded filing dates prior to Apple’s petitions by one
`and two days, respectively.
`
`
`
`To correct the order in which these petitions are considered for institution, Apple and Anker propose
`shifting the POPR due dates for the joinder petitions to one day after the POPR due dates for the original
`petitions. We believe this solution does not incur any additional burden on the Board or Patent Owner
`Scramoge Technology Ltd.
`
`
`Apple and Anker have conferred with Patent Owner. Patent Owner does not oppose this proposal.
`
`
`While the parties do not believe that a conference call with the Board is necessary, the parties are
`available at these times if the Board should choose to schedule a conference call: 4/12 (before 1pm ET
`or after 4pm ET), 4/13 (10am ET to 5pm ET), or 4/14: (10am ET to 5pm ET).
`
`
`Thank you,
`Scott Jarratt
