`
`We write regarding the pending petitions for inter partes review (IPR) filed against the
`patents in suit to inform you that Samsung hereby stipulates that, if the Patent Trial and Appeal
`Board (PTAB) institutes one or more of the IPR petitions on the grounds presented (a table of
`which is included below), then Samsung Electronics Co., Ltd. and Samsung Electronics, America,
`Inc. (collectively, “Samsung”) will not pursue those same instituted grounds against the same
`patent claims in the above-captioned litigation, 2:21-cv-413-JRG.
`
`In so stipulating, Samsung seeks to avoid multiple proceedings addressing the validity of
`the patents-in-suit based on the same grounds. Rather, consistent with Congressional intent,
`Samsung wishes the patentability of these patents over those grounds to be addressed at the PTAB.
`But, for the sake of clarity and to avoid any doubt, if the PTAB declines institution of one or more
`IPRs, Samsung reserves the right to pursue the grounds of those IPRs in this litigation.
`
