`
`
`I, Jennifer A. Babbitt, hereby declare under penalty of perjury as follows:
`
`I.
`
`INTRODUCTION
`
`I am an Electronic Services Librarian at Kirkland & Ellis LLP. I am
`
`making this declaration of my own personal knowledge.
`
`
`
`I make this declaration in support of Petitioner’s Petition for Inter
`
`Partes Review (“IPR”) of U.S. Patent No. 10,492,038 (“the ’038 Patent”). I submit
`
`this declaration, including Appendices 1–7 attached hereto, as supplemental
`
`evidence under 37 C.F.R. § 42.64(b)(2).
`
`II. QUALIFICATIONS
`
`I obtained a master’s degree in Library and Information Science from
`
`San Jose State University in 2013. In connection with that degree, my coursework
`
`focused on library operation and catalog management.
`
`
`
`From 2012 to 2014, I worked as an Archive Consultant at the Golden
`
`Gate National Recreation Area. I assisted in the archival of Golden Gate National
`
`Recreation Area’s documents and the maintenance of active division records. I also
`
`created finding aids for discrete collections and worked in preserving and arranging
`
`active records for multiple divisions within the Golden Gate National Recreation
`
`Area, including the superintendent’s office.
`
`
`
`From 2014 to present, I have been working as a Research Assistant at
`
`Kirkland & Ellis LLP. My primary responsibilities include the following:
`
`1
`
`Epic Games Ex. 1038
`Epic Games v. IngenioShare
`IPR2022-00294 p. 6
`
`

`

`
`
`(1) maintaining the library catalog, including by coordinating the cataloging of new
`
`material and routing of serial publications; (2) working with outside vendors to
`
`maintain/update standing orders and facilitate new orders; (3) coordinating
`
`interlibrary loans; (4) cataloging and maintaining technical book collections; and
`
`(5) assisting with research and document retrieval.
`
`
`
`Through my education and experience described above, I have
`
`interacted with and have become personally familiar with the Education Resources
`
`Information Center (ERIC) and its collection of education resources. I understand
`
`that ERIC is an online library of education resources maintained by the Institute of
`
`Education Sciences, which is a branch of the U.S. Department of Education. I have
`
`used and am familiar with ERIC, including by performing searches on its online
`
`database to find information about the availability of educational articles and other
`
`references, and by downloading these articles and references.
`
`
`
`Through my education and experience described above, I have also
`
`interacted with and have become personally familiar with Semantic Scholar. I
`
`understand that Semantic Scholar is an online search engine for scholarly articles
`
`that aims to use artificial intelligence to provide summaries of scholarly articles
`
`across a variety of scientific disciplines. I have used and am familiar with Semantic
`
`Scholar, including by performing searches through its search engine to find

`A Play Theory Analysis of Computer-Mediated
`Telecommunication.
`Kuehn, Scott A.
`
`The computer user has played an active part in uncovering changes brought
`on with microcomputer technology. Electronic mail (or "E-mail"), which
`enables users to send and receive messages through bulletin board
`services ("BBSs"), is often considered one innovation of the computer
`revolution. A BBS provides opportunities for both "live," real-time exchanges
`with the BBS host or a fellow user and "asynchronous" message exchanges.
`BBS telecommunication differs from other forms of computer-controlled
`communication in that it occurs in a non-task-oriented, active environment.
`Play theory, which examines the relationship of a medium user to the
`medium, may explain why computer users choose to employ the BBS.
`According to play theory, "communication play" is a form of self-expression
`that takes advantage of a medium in promoting a feeling of individuality.
`Computer-mediated telecommunication is an example of what has been
`called "participatory play," which occurs when communicators are free to
`alter interaction to achieve goals. Analysis of computer-mediated
`telecommunication must consider both the decision to use the medium and
`the unique features of the medium that provide content cues of
`communication play. A network analysis (examining who talks to whom
`about what) might also shed light on the influence of play communication.
