`
`To the Honorable Board,
`
`Patent Owner respectfully requests authorization from the Board to promptly file a motion to submit supplemental
`information under 37 CFR § 42.123(c) in IPR2022‐00199, IPR2022‐00200, and IPR2022‐00223. The supplemental
`information that Patent Owner seeks to submit is portions of Petitioner’s “Final Invalidity Contentions,” which Petitioner
`recently served in the related district court case after Patent Owner filed its preliminary responses to the
`petitions. Patent Owner believes that information in the Final Invalidity Contentions, which shows that the invalidity
`grounds raised in each petition are also raised in the district court case, are relevant to the Fintiv factors addressed in
`Patent Owner’s Preliminary Responses.
`
`Accordingly, Patent Owner requests a conference with the Board to seek authorization to file a motion to submit
`Petitioner’s Final Invalidity Contentions as supplemental information under § 42.123(c). The parties met and conferred
`regarding this issue. Petitioner has no objection to the submission of the Final Invalidity Contentions as an exhibit, but
`opposes Patent Owner’s request for authorization to file a motion to submit them under 37 CFR § 42.123(c).
`
`Counsel for the parties are available for a conference on March 28 at 4:00pm EST and March 29 between 12:00 PM and
`1:00pm EST. Counsel for Petitioner are copied on this communication.
`
`Respectfully,
`Jennifer Kurcz
`Counsel for Patent Owner
