`On March 22, 2021, Plaintiff Align Technology, Inc (“Align”) filed a Motion for Leave to
`
`Amend Complaint (Dkt. No. 97) to add U.S. Patent No. 10,945,609 (the “’609 patent”). Align and
`
`Defendants 3Shape A/S and 3Shape TRIOS A/S (“3Shape”) conferred regarding the motion and
`
`hereby stipulate and agree to the following:
`
`1.
`
`3Shape does not oppose Align’s Motion for Leave to Amend Complaint (Dkt. No.
`
`97) to add the ’609 patent.
`
`2.
`
`3Shape’s invalidity contentions for the ’609 patent and production of prior art
`
`referenced in said contentions will be due May 10, 2021. All other deadlines from the Scheduling
`
`Order (Dkt. No. 82), including the August 11, 2021 Markman Hearing, will apply to the ’609 patent.
`
`3.
`
`Align agrees that its Amended Complaint will not include its claim for infringement
`
`of U.S. Patent No. 10,791,934 (“the ’934 patent”) (Count Five of the original Complaint), without
`
`prejudice to its ability to assert that claim in the future.
`
`4.
`
`3Shape agrees that it will not assert declaratory judgment counterclaims for non-
`
`infringement and invalidity of the ’934 patent in this case (currently Counts XI and XII of the
`
`
`

`Amended Counterclaims, Dkt. No. 62), in response to the Amended Complaint, without prejudice
`
`to its ability to assert those claims in the future.

`3Shape agrees that it will dismiss its declaratory judgment claim for non-infringement
`
`of the ’934 patent in 3Shape’s Delaware DJ action (Count V of the Complaint for Declaratory
`
`Judgement of Non-Infringement, Dkt. No. 1, Case No. 1:20-cv-01492-LPS), without prejudice to its
`
`ability to assert that claim in the future.
`
`6.
`
`Attached is Align’s proposed First Amended Complaint with the claim for
`
`infringement of the ’609 patent added and the claim for infringement of the ’934 patent no longer
`
`included. If the Court grants the now-unopposed motion for leave to amend, Align will file this
`
`version of the First Amended Complaint.
