`On August 6, 2021, Petitioners filed a Petition requesting Inter Partes Review
`
`of U.S. Patent No. 10,344,999 (the “’999 Patent”). IPR2021-01355, Paper 1. The
`
`’999 Patent has 25 claims. Exhibit 1001. Prior to the Board’s institution decision,
`
`Patent Owner disclaimed claims 15-24 of the ’999 Patent under 37 C.F.R. §1.321(a).
`
`Exhibit 2001.
`
`On February 15, 2022, the Board ordered institution of inter partes review for
`
`the remaining claims, namely, claims 1–14 and 25. Paper 12. Subsequently, on May
`
`6, 2022, Patent Owner indicated that it intended to disclaim all remaining claims and
`
`in fact did disclaim claims 1–14 and 25 under 37 C.F.R. § 1.321(a). Paper 21; see
`
`also Paper 22 at 3 (“Mr. McDonough stated that a Response to the Petition would
`
`not be filed, instead, a disclaimer of all remaining challenged claims would be timely
`
`filed. Mr. Shamoon indicated that he had directed the filing of such disclaimer.”);
`
`Ex. 1053, 15:10-22. Accordingly, all claims of the ’999 Patent are disclaimed. 35
`
`U.S.C. § 253(a); see also Vectra Fitness, Inc. v. TNWK Corp., 162 F.3d 1379, 1382
`
`(Fed. Cir. 1998) (holding that a § 253 disclaimer is immediately “recorded” on the
`
`date that the Office receives a disclaimer meeting requirements of 37 C.F.R. §
`
`1.321(a) and that no further action is required in the Office). Because Patent Owner
`
`did not file a Response to the Institution Decision and because all claims have been
`
`disclaimed, at this time, Petitioners are not addressing the merits or the Institution
`
`Decision.

`In view of Patent Owner’s disclaimer of all remaining claims and
`
`abandonment of the proceedings, Petitioners filed a Request for Adverse Judgment
`
`on June 1, 2022. Paper 24. Petitioners requested adverse judgement because 37
`
`C.F.R. § 42.73(b) expressly permits the Board to enter adverse judgment where a
`
`patent owner cancels claims post-institution. Additionally, the Federal Circuit’s
`
`decision in Arthrex v. Smith & Nephew, 880 F.3d 1345 (Fed. Cir. 2018), held that
`
`the Board has authority under 37 C.F.R. § 42.73(b) to enter adverse judgment where,
`
`as here, a patent owner cancels claims preinstitution. This Request remains
`
`unopposed by Patent Owner – despite Patent Owner acknowledging the motion and
`
`the relief being sought by Petitioner (Exhibit 1054) – and the deadline to oppose has
`
`long since passed. See 37 C.F.R. § 42.25(a)(1) (“An opposition is due one month
`
`after service of the motion.”).
`
`Accordingly, Petitioners respectfully request that the Board terminate the
`
`current proceedings and enter adverse judgment against claims 1–25.
