`CoolIT Systems, Inc. (“Petitioner”) hereby seeks inter partes review of
`
`Claims 1-19 (the “Challenged Claims”) of U.S. Patent No. 10,599,196. (Ex-1001
`
`(the “’196 patent”).) This Petition is supported by the declaration of Dr. Himanshu
`
`Pokharna, an engineer holding a Ph.D. in Nuclear Energy Engineering from Purdue
`
`University and a Bachelor of Technology and a Master of Technology in mechanical
`
`engineering from the Indian Institute of Technology. Dr. Pokharna has over 25 years
`
`of experience in a variety of leadership roles, and his educational, research, and work
`
`experience has revolved primarily around energy, materials, and thermal
`
`technologies with a major thrust being liquid cooling in various contexts.
`
`(Ex-1003, ¶¶1-6.)
`
`I.
`
`INITIAL STATEMENT
`A. Asetek Did Not Invent the “All-in-One” Cooler
`The ’196 patent discloses a liquid cooling system used in a computer system.
`
`The use of liquid cooling to cool semiconductor chips in computer systems was
`
`generally known to a person of ordinary skill in the art (“POSITA”) long before the
`
`claimed May 6, 2005 priority date of the ’196 patent claims. (Ex-1001, 1:4-12;
`
`Ex-1003, ¶27.) The use of closed liquid cooling loops that utilize what is sometimes
`
`referred to in the industry as an “all-in-one” cooler (i.e., a modular pumping
`
`mechanism, what Patent Owner calls a “reservoir” in the ’196 patent, that pumps the
`
`liquid through the loop) was also generally known to a POSITA long before the
`

`claimed priority date. (Id.; see also Ex-1004, Duan; Ex-1005, Duan-1.) The ’196
`

`patent only discloses and claims a specific embodiment of such known “all-in-one”
`
`coolers. (Ex-1003, ¶27.)
`
`B. The ’196 Patent Claims Are Very Similar to Claims for Which IPRs
`Have Been Instituted.
`The ’196 patent (Ex-1001) at issue in this Petition is a direct continuation of
`
`U.S. Patent No. 10,078,355 (Ex-1009 (the “’355 patent”)). (Ex-1001, 1:4-5
`
`(“continuation of U.S. application Ser. No. 15/626,706”); Ex-1009 (the ’355 patent),
`
`at p. 1 (“(21) Appl. No.: 15/626, 706”).) The ’355 patent is a direct continuation of
`
`U.S. Patent No. 9,733,681 (Ex-1010 (the “’681 patent”)). (Ex-1001, 1:5-7.) Both
`
`the ’355 and ’681 patents are subject to pending IPRs that have been instituted. (See
`
`Ex-1007 and Ex-1008 (Institution Decisions in IPR2020-00522 and IPR2020-
`
`00524, respectively).). The IPR relating to the ’355 patent is instructive given that
`
`the Challenged Claims of the ’196 patent are very similar to claims in the ’355 patent
`
`for which the Board determined Petitioner is likely to prevail. (See Ex-1007,
`
`at 14-18 (Board finding that Petitioner likely to prevail regarding anticipation of
`
`claims 10, 11 and 13 of the ’355 patent); compare, e.g., Ex-1001 claims 1, 2, 6, 10
`
`and 13 with Ex-1009 claims 10, 11 and 13). The same is true with respect to the IPR
`
`relating to the ’681 patent. (See Ex-1008, at 26-30 (Board finding that Petitioner
`
`likely to prevail regarding invalidity of claims 8, 11, 15 and 16 of the ’681 patent);

`III. OVERVIEW OF THE ’196 PATENT
`The ’196 patent relates to a liquid-cooling system for a computer system. The
`
`specification purports to disclose embodiments of a liquid-cooling system that are
`
`more efficient, easier to use, and more compact with integrated components than
`
`

`prior art cooling systems. (Ex-1001, 1:15-2:27.) The ’196 patent explains that it
`

`provides an “integrate element” to limit the number of separate elements and an
`
`“entire pump [that] is placed inside the reservoir” or placed “outside the reservoir in
`
`the immediate vicinity of the reservoir.” (Id., 2:20-21 and 2:28-34.) The ’196 patent
`
`further states (and subsequently claims) that these purported improvements may be
`
`achieved by having an integrated element comprising the heat exchange interface,
`
`the reservoir of cooling liquid, and the pump for pumping the cooling liquid. (Id.,
`
`1:57-2:39; claims 1-19.) But as shown in detail in this Petition, the Challenged
`
`Claims of the ’196 patent are not inventive. (Ex-1003, ¶28.)

`and 20, reproduced below-right. “FIG. 17 shows a preferred possible embodiment

`of a reservoir according to the invention. The reservoir housing 14, as shown in

`FIGS. 17 and 20, is in the form of a double-sided chassis configured to mount an
`

`outlet [connection] lead to a radiator (not shown [in FIGS. 17 or 20]) intended for

`cooling the cooling liquid after having been heated by the processing unit via a heat

`exchanging surface[.]” (Id., 22:35-42.) A POSITA would have understood that the

`
`out of the thermal exchange chamber 47A via second passage 49 and into connecting
`
`tube 25, and then finally flows back to the radiator 11 and fan 10 to get cooled, and
`
`the cycle repeats. (Ex-1003, ¶¶29-33.)
`
`B.
`Priority Date
`The ’196 patent issued on March 24, 2020, from Application No. 15/991,384
`
`filed on May 29, 2018, and claims the benefit of Application No. 11/919,974, filed
`
`as application No. PCT/DK2005/000310 on May 6, 2005. Petitioner does not
`
`concede that the ’196 patent is entitled to an effective filing date of May 6, 2005 but
`
`assumes that this date applies for purposes of this Petition.
`
`C.
`The Relevant Prosecution History of the ’196 Patent
`On July 8, 2019, the Examiner issued a non-statutory double patenting
`
`rejection of all pending claims based on: (a) U.S. Patent No. 9,733,681 (the “’681
`
`patent”) in view of Barnes; and (b) U.S. Patent No. 10,078,355 (the “’355 patent”)
`
`in view of Barnes. (Ex-1002, pp. 221-226.) In rejecting the claims based on the ’681
`
`patent, the Examiner stated:
`
`“Regarding claim 10, ’681 also discloses mounting legs to secure the
`heat-exchanging interface to a heat generating component of a
`computer (claim 10 of ’681), but does not disclose a set of four

`mounting legs, however, the use of four legs would have involve a mere
`duplication of the essential working parts of a device which is generally
`recognized as being within the level of ordinary skill in the art when the
`device will still carry out its intended tasks with the arrangement.”
`
`(Ex-1002, p. 224). On July 16, 2019, Patent Owner filed a Terminal Disclaimer to
`
`obviate the double patenting rejections. (Id., pp. 208, 209, 211.) In the Reply filed
`
`with the Terminal Disclaimer, the Patent Owner did not make any substantive
`
`arguments in response to the double-patenting rejection. (Id., pp. 218-220;
`
`Ex-1003, ¶34.)
`
`IV. PERSON OF ORDINARY SKILL IN THE ART (“POSITA”)
`A POSITA working in the field of the ’196 patent (liquid cooling systems for
`
`computer systems) as of the earliest possible effective filing date of May 6, 2005
`
`would have earned at least a bachelor’s degree, such as a B.S. (bachelor of science),
`
`or equivalent thereof, in mechanical engineering or a closely-related field and
`
`possessed at least three years of specialized experience in heat transfer devices for
`
`thermal management in electronics and computer systems, or in similar systems. A
`
`person with less education but more relevant practical experience, depending on the
`
`nature of that experience and degree of exposure to liquid cooling systems for
`
`computer systems, could also qualify as a POSITA in the field of the ’196 patent.
`
`(Ex-1003, ¶¶23-26.)

`V. CLAIM CONSTRUCTION
`A.
`“reservoir”
`The parties stipulated in the pending district court action to construe
`
`“reservoir,” as used in the claims of the ’196 patent, to mean a “single receptacle
`
`defining a fluid flow path.” (Ex-1012 at 2.) With respect to claims 1, 10, and 16, the
`
`reservoir is claimed to include “a pump chamber,” “a thermal exchange chamber,”
`
`and “a heat-exchanging interface” amongst other elements. Thus, the claims are
`
`drafted such that the “reservoir” refers to an overarching collection of components
`
`that form a single receptacle defining a fluid flow path. (Ex-1003, ¶39.)
`
`B.
`“chamber”
`The parties stipulated in the pending district court action to construe
`
`“chamber,” as used in the claims of the ’196 patent, to mean “compartment within
`
`the reservoir.” (Ex-1012 at 2.) The claims are directed to both a “pump chamber”
`
`and a “thermal exchange chamber.” Petitioner submits that these claimed
`
`“chambers” should be given their plain and ordinary meaning in accordance with the
`
`stipulated construction for “chamber” above. (Ex-1003, ¶40.)
`
`C.
`“double-sided chassis”
`The parties stipulated in the pending district court action to construe “double-
`
`sided chassis,” as used in the claims of the ’196 patent, to mean a “two-sided frame”
`
`

`per the Court’s claim construction order in the pending district court action. (Ex-

`D.
`“stator”
`The parties stipulated in the pending district court action to construe “stator,”
`
`as used in the claims of the ’196 patent, to mean “stationary parts of the motor that
`
`perform or support an electrical or magnetic function of the motor,” per the Court’s
`
`claim construction order in the pending district court action. (Ex-1012 at 2; see Ex-
`
`1011 at 11-16; see also Ex-1003, ¶42.)
`
`E.
`
`“either a first end or a second end of the thermal exchange
`chamber”
`The parties stipulated in the pending district court action to construe “either a
`
`first end or a second end of the thermal exchange chamber,” as used in the claims of
`
`the ’196 patent, to mean “either the first end or the second end of the thermal
`
`exchange chamber” in order to correct an antecedent basis issue. (Ex-1012 at 2.)2
`
`Petitioner submits that, beyond the corrected antecedent basis issue, this term need
`
`not be construed further and should be given its plain and ordinary meaning
`
`consistent with the Court’s claim construction order in the pending district court
`
`action. (Ex-1003, ¶43; see Ex-1011 at 8-10.)

`“an inlet … positioned below a center of the impeller”
`Petitioner submits that “an inlet … below a center of the impeller”
`
`encompasses an “opening for fluid entrance near the center of the impeller along the
`
`axis around which the impeller rotates.” The term “below a center of the impeller”
`
`in the context of an impeller does not appear in the written description of the ’196
`
`patent. Instead, the ’196 patent states, “[t]he inlet of the pump chamber 46 is the
`
`entire opening into the cavity that the pump chamber configures, said cavity being
`
`in direct communication with the interior of the reservoir housing 14 as such.”
`
`(Ex-1001, 23:5-10). This is illustrated in FIG. 20 of the ’196 patent:
`
`
`
`(Ex-1001, FIG. 20 (red rectangle added to show inlet).) As depicted above, FIG. 20
`
`shows an inlet opening (area within the red rectangle) positioned near the center of
`
`impeller 33 along the axis around which the impeller rotates (indicated in blue).

`When read in context, claim 1 states “an inlet defined by the impeller cover

`positioned below a center of the impeller configured to enable a cooling liquid to

`flow into the center of the pump chamber.” This is shown in FIG. 20, where the
`
`inlet provides liquid towards the center of the pump chamber. In other words, a
`
`POSITA would have understood that the word “below” refers to the side of the
`
`cooling liquid supplied by the inlet relative to the center of the impeller.
`
